RECOMMENDATIONS
Recommendation #1
Year -round and Citywide, the Marine Operations Watch Commander has the
authority to blackball (prohibit surfing or all floatation devices) in Surfing Area No. 1,
No. 2, or No.3 when an unsafe conditions exists between, but not limited to hard
board surfers, skim boarders, other flotation device users and other ocean water
users (swimmers).
Recommendation # 2
Adjust the distances of Surfing Area 3 in "Little Corona" to be defined by the area of
ocean between the prolongations of Poppy Avenue and Cameo Shores Road.

Prohibit surfing in the area between the midline rock groins located on the
prolongation of 40th Street and 44th Street from 10am — 5pm daily from the Saturday
before Memorial Day through Labor Day.

Adjust the location defining the area known as The Wedge to 20 feet from the West
Jetty of the Newport Harbor entrance channel to 600 feet northwest along the mean
high tideline.

Rationale:
An adjustment to the language clarifies the ability to
enforce blackball when a conflict arises at any location
due to safety concerns - versus the lack of conflict
during defined dates.
Current Resolution:
...From June 15 to September 10 of each year,
surfing is prohibited in Area No. 1, No. 2, or No. 3, or
any portion thereof, whenever the blackball flag is
displayed on the beach or on the closest lifeguard
tower.
The blackball flag shall generally be displayed from
12:00 noon to 4:00 p.m. during this period, unless, in
the opinion of the supervising Marine Safety
Lieutenant, the conditions in the water during that
period do not create any significant potential for
conflict between surfers and other users.
Recommendation 2
Recommendation:
Adjust the distances of surfing Area 3 in "Little Corona"
to be defined by the area of ocean between the
prolongations of Poppy Avenue and Cameo Shores
Road.
Current Terminology:
Surfing Area 3's southern boundary is defined by City's
Boundary, (including Crystal Cove State Park)
Rationale:
Defines boundary to align with Newport Beach's
jurisdiction
to enforce ocean regulations.

Prohibit surfing (Blackball) between 40th Street and 44th
Street from Memorial Day Weekend to Labor Day -10:00
am to 5:00 pm
Current Regulations:
40 -44th streets must be blackballed all hours from May
1 St through October 31 st
Rationale:
Data collected reveals that the months of May,
September and October do not always necessitate
prohibiting surfing in the area.

Recommendation 4
Rationale:
Tower "P" is a moveable object, moved for high surf and changing
beach profiles.
Changing the distance to 600' creates a finite consistent distance.
Impact:
Changing the Boundaries will exclude the surf break known as
Cylinders from the regulations of the Wedge.
Allows a place for flotation devices /boards near the Wedge
during regulated hours

Municipal Codes Related to Surfing
1 1.16.010 Surfing Defined.
The term "surfing," as used in this chapter, shall mean the use in
the water of a surfboard, paddle- board, skim board, bellyboard,
or similar device made of any hard material or substance. (1949
Code § 4250 added by Ord. 1162; May 9, 1966)
1 1.16.020 Designation of Surfing Areas.
The City Council by resolution may designate certain areas of the
Pacific Ocean where surfing shall be permitted, specify the dates
and hours when such surfing areas may be used for surfing, and
adopt other regulations relating to surfing. (1949 Code § 4251
(a) added by Ord. 1162; May 9, 1966)
1 1.16.030 Surfing Prohibited.
No person shall have in his possession or use a surfboard,
paddleboard or similar device at any place in the Pacific Ocean
within the City except within designated surfing areas on such
dates and during such hours when surfing is permitted as
provided by resolution of the City Council or shall violate any
o egulation relating to surf in adopted by resolution of the
City Co 1949 Code § 4251 () added by Ord. 1162; May 9,
1966)
1 1.16.040 Swimming Prohibited in Surfing Areas.
The City Council may by resolution adopt regulations specifying dates
and hours when wading, bathing or swimming shall not be permitted in
any designated surfing area by any erson, unless such person has in his
possession and is using a surfboard, paddleboard or similar device. No
person shall wade, bathe or swim in a designated surfing area in
violation of any such regulation. (1949 Code § 4251 (c) added by Ord.
1162; May 9, 1966)
1 1.16.050 Hazardous Surfing — Endangering Others.
No person shall use any surfboard, paddleboard, bellyboard, skim board,
ski, canoe or any similar device made of any hard substance in the
Pacific Ocean in a manner that constitutes a hazard to any other person.
(1 949 Code § 4252 (a) added by Ord. 1162; May 9, 1 966)
1 1.16.060 Order to Cease Surfing.
Any City police officer, City lifeguard, or other City employee designated
by the City Manager to enforce surfing regulations may prohibit surfing
with a surfboard, paddleboard or other similar device at any time that
such activity becomes hazardous as a result of storm, congestion of
people, or other conditions which endanger the safety of persons
participating in surfing or other persons using the beach. No person
shall fail, refuse or neglect to stop surfing activities or to leave the water
when ordered to do so by any City employee referred to above. (1949

1 1.16.070 Signal Flags.
The authority to prohibit surfing set forth in Sections
1 1 .16.060 may be exercised by displaying signal flags
consisting of a solid black circle on a yellow background.
When such flags are displayed on the each they shall
signify that surfing is prohibited. (1949 Code § 4252 (c)
added by Ord. 1162; May 9, 1966)
1 1.16.080 Surfboards on Private Property Prohibited.
No person shall place, leave or store any surfboard,
paddleboard or similar device on private property unless he
shall have first obtained the express consent of the owner
or other person having control of such private property.

1 1.16.090 Surfing Clearance.
No persons shall use or have in his possession in the harbor
entrance or in the Pacific Ocean within twenty (20) feet of
any public pier, wharf, seawall, groin, or jetty, or any natural
rock formation within the City, any surfboard, paddleboard
