TITLE: Blackball Regulations Review
ABSTRACT:
The City of Newport Beach adopted Resolution No. 6347 in 1966 that created restrictions on specific uses
in open water within City limits. Subsequent resolutions modified restrictions based on public opinion and
professional input. There have been a total of 14 resolutions adopted by the City Council since 1966 with
the last being in 1995. With increasing popularity of all forms of recreational use, the Blackball Working
Group was formed at the request of a former Council Member in September 2013. The Working Group was
tasked with evaluating and possibly revising the current regulations to enhance public access while
maintaining public safety. See Exhibit A for a more in -depth look into the history of the resolution.
RECOMMENDATION:
The Parks, Beaches and Recreation (PB &R) Commission met in April, 2015 to review recommendations
from the Blackball Working Group and voted to recommend the below proposals. Staff requests direction
on these recommendations, or to provide suggestions for other proposals, to potentially be placed on a
future Council Agenda:
a) Year round and Citywide, the supervising Marine Operations Watch Commander, or designee, has the
authority to blackball (prohibit surfing) in Surfing Area No. 1, No. 2, or No. 3 when an unsafe condition
exists between, but not limited to, hard board surfers, skim boarders, other flotation device users and other
ocean water users (swimmers);
b) Adjust the distances of surfing Area 3 in "Little Corona' to be defined by the area of ocean between the
prolongations of Poppy Avenue and Cameo Shores Road;
c) Prohibit surfing in the area between the midline of the rock groins located on the prolongation of 40th
Street and 44th Street from 10:00 a.m. — 5:00 p.m. daily, from the Saturday before Memorial Day through
Labor Day; and
d) Adjust the location defining the area known as the Wedge to 20' from the West Jetty of the Newport
Harbor entrance channel to 600' northwest along the mean high tideline.

DISCUSSION:
Overview of Process
The 'Blackball' is a yellow flag with a black circle in the center of the flag. When posted, the flag indicates
that hard -board surfing is not allowed — instead, only soft -board surfing, bodysurfing and swimming is
allowed. The dynamic between hard -board surfers and the remainder of the ocean user community can be
challenging, as each perspective seeks more time in the ocean in a safe environment.
The Blackball Working Group was established in September 2013 to review current municipal codes and
Council resolutions regarding regulation of surfing and flotation device restrictions. The Blackball Working
Group members are:

The goals of the working group were to solicit input from the community on current blackball surfing
regulations and to:
1. Develop and discuss thoughtful, educated changes to existing rules (if any) pertaining to the dates,
times and locations of Blackball; and
2. Bring forth recommendations to the Parks, Beaches, and Recreation Commission for review prior to
their recommendation to the City Council.
The Working Group first met on September 11, 2013, and discussed the purpose of the review and history
of blackball regulation. The Working Group identified a course of action as well as a public outreach
program. The public outreach program included the development of a City webpage, email for public
comments, a community open forum, and small group discussions with organized groups.
In February 2014 the PB &R Commission asked for additional data to make an informed decision on
Blackball regulations. From May 2014 through October 2014, the Marine Operations Division collected data
about usage across various beach areas.
In April 2015, the PB &R Commission voted on five recommendations from the Working Group. Four of the
recommendations received consensus and are discussed below.
The four recommendations were approved for City Council consideration:
Recommendation #1 — (See Exhibit B)
Year round and Citywide, the Marine Operations Watch Commander, or designee, has the authority to
blackball (prohibit surfing) in Surfing Area No. 1, No. 2, or No. 3 when an unsafe condition exists between,
but not limited to, hard board surfers, skim boarders, other flotation device users and other ocean water
users (swimmers).
. The current resolution states that from June 15 to September 10 of each year, surfing is prohibited in
Area No. 1, No. 2, or No. 3, or any portion thereof, whenever the blackball flag is displayed on the
beach or on the closest lifeguard tower. The blackball flag shall generally be displayed from 12:00
noon to 4:00 p.m. during this period, unless, in the opinion of the supervising Marine Safety

Lieutenant, the conditions in the water during that period do not create any significant potential for
conflict between surfers and other users.
. The proposed adjustment to the language clarifies the ability to enforce blackball when a conflict
arises at any location and any time versus the current language having suggested dates and times
when the blackball should generally be enforced, or the ability to not blackball when conditions don't
warrant enforcement.
Recommendation #2 — (See Exhibit C)
Adjust the distances of surfing Area 3 in "Little Corona" to be defined by the area of ocean between the
prolongations of Poppy Avenue and Cameo Shores Road.
• The current language states "to the end of the City Boundary."
• The proposed language would appropriately place Surfing Area No. 3 at the eastern -most edge of the
City's jurisdiction. To the east of this boundary is Crystal Cove State Park, which is under the control
of the California Department of Parks and Recreation. Any City regulation over surfing would not
apply there.
Recommendation #3
Prohibit surfing in the area between the midline of the rock groins located on the prolongation of 40th Street
and 44th Street from 10:00 a.m. — 5:00 p.m. daily from the Saturday before Memorial Day through Labor
Day.
• Currently the regulation states it must be blackballed all hours from May 1st through October 31st.
• The proposed language would reduce the blackball period from 6 months to approximately 3 months
and from all hours of the day to 7 hours per day.
Recommendation #4 - (See Exhibit D)
Adjust the location defining the area known as the Wedge to 20 feet from the West Jetty of the Newport
Harbor entrance channel to 600 feet northwest along the mean high tideline.
• Currently, the regulation states from 20 feet from the West Jetty to lifeguard Tower "P ". Tower "P" is
a moveable object and although it is moved infrequently, it does on occasion get moved due to high
surf and the changing demographics of the beach frontage.
• Changing the distance to 600' creates a distance which remains constant and is consistent with other
areas that use measurements rather than movable landmarks. The current location of Tower P is
approximately 750' on the water line from the west jetty.
• The current boundary includes the surf break known as "Cylinders." Implementing a 600' boundary
would exclude the Cylinders break from the Wedge regulation giving access to board users during
regulated periods.
• "Cylinders" is not a break traditionally ridden by Wedge bodysurfers. This change will allow board
users to access the "Cylinders" when conditions do not warrant blackball due to safety concerns.
The following recommendation was not approved by the PB &R Commission:
. Modify the area known as the Wedge to prohibit flotation devices from 10:00 a.m. — 5:00 p.m. daily
from the Saturday before Memorial Day through Labor Day. Flotation devices are any device that
has the ability to float an individual on or near the surface of the water. Examples include, but not
limited to, surfboard, skim board, body board, kickboard, etc.

Beach Usage Observation Data (Exhibit E)
In February 2014, the PB &R Commission asked for additional data to make an informed decision on
Blackball regulations. From May 1, 2014 through October 31, 2014 (6 months), the Marine Operations
division collected data about usage across various beach areas.
2014 Data Collection Summary from Tower 40 to 44. May 1 — October 31
2014 Lifeguard Staffing
• Tower staffing data indicated a lower crowd load in May and in September /October. Tower 44 was
staffed with a lifeguard 3 of 23 days (13 %) in May, pre - Memorial Day weekend, and 17 of 60 days
(28 %) post -Labor Day. The staffing for tower 44 outside of the period from Memorial Day through
Labor Day was 24 percent, or 1 of 4 days.
• Towers are staffed when there is an expectation of crowds and /or conditions, such as conflicts
between hard board surfers and other water users that warrant the staffing of a lifeguard. This staffing
data directly indicates a low number of beach users and a proportional decrease in need for
regulations.
Water Usage Observations
• The usage of the area by swimmers was statistically small in the mornings. During the 7:30 a.m.
observations, only 7% of the users were swimmers; this climbs to 28% at 10 a.m. and by midday
swimmers comprised over 53% of the water users.
• Conversely the data indicates a high level of surfing use in the morning and little surfing in the 40 -44
area during the mid - day /afternoon.
• The data reflects when either lifeguard tower 40 or 44 were staffed, compliance with the blackball
regulations were greater than when the towers were not staffed. This was noted from our daily data
collection at 7:00 a.m., 10:00 a.m., 1:00 p.m. and 4:00 p.m.
• Data collected reveals that the months of May, September and October do not necessitate entirely
prohibiting surfing in the area. The Marine Operations Watch Commander would evaluate locations
daily to determine if blackball should be enforced based on safety.
The Commission's Recommendations are summarized in two pages (Current Regulations and Proposed
Regulations) on Exhibit F.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California Environmental Quality Act
( "CEQX) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable
indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in
Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the City Council considers the item). Additionally, we reached out to persons who attended the
Working Group and Commission meetings to inform them of the Council's study session on this issue.

Summary of the History of Blackball Policy in the City of Newport Beach
Blackball regulation in the City of Newport Beach commenced in May of 1966. Resolution 6347
created limitations from June 10 - September 15 each calendar year. During the restricted date
range, three designated surf areas were established. All other areas were closed to surfing,
and surfing areas were closed to swimmers.
• Area 1: 19th Street to 30th Street from 7:30 am to 11:00 am
• Area 2: 30th Street to the Westerly boundary of the City from 4:00 pm to sunset
• Area 3: 20ft- 200ft East of the East Jetty open from 6:00 am -12:00 pm (Monday through
Friday), and 6:00 am to 10:OOam and 6:00 pm — sunset (Holidays, Saturdays, and
Sundays).
Subsequent Council Resolutions from 1967 through 1978 modify the zones, times, and
created closure areas such as 40th —44 th streets.
On November 25, 1985 the Council approved Resolution 85 -94 that prohibited the use of all
flotation devices at the Wedge.
On March 13, 1989, Resolution 89 -10 further modified blackball restriction in the area from 40th
— 44th streets. At this time the Council voted to eliminate the 8:00 am to 6:00 pm time frame
and close the area at all times from May 1St to October 31St. Also, the Wedge flotation device
restriction was limited to summer months when the Wedge lifeguard tower was staffed and a
blackball flag was displayed.
In 1993, the Council revisited the 1985 Wedge restrictions. Mayor Turner noted several in
attendance at the May 10 meeting were present to address the Wedge issue. A letter and
petition (112 signatures) was submitted to the Council by Roger Darnell and a second letter
submitted by Bill Sharp (600 signatures) stating opposition to the 1985 Wedge restrictions, and
advocating for board riding to continue during the periods when the blackball flag is not
displayed. At this time, the Wedge Preservation Society and the Balboa Peninsula Point
Association endorsed a proposal to completely limit all flotation devices from the West Jetty to
"M" Street year round.
The outcome of the discussion in 1993 was clarification of the Wedge area to include the area
from the West Jetty to the water in front of Tower P. In Resolution 93 -33 (May 10, 1993) the
Council also moved to restrict floatation devices from 10:00 am to 5:00 pm from May 1 St to
October 31St. The Resolution passed 4 -2.
In 1995, Mayor Hedges referred the blackball issue to the PB &R Commission to review.
Mayor Hedges advocated a blackball program that would allow for more discretionary
enforcement.
On August 1, 1995 the PB &R Commission held a meeting and to listen to requests from the
Wedge Preservation Society and Newport Surf Council. The Commission unanimously
approved a motion to meet with representatives from the surf industry, Marine Division, and
the Commission "to formulate a compromise for the Commission's final recommendation at
their September 5 meeting." (PB &R Meeting Minutes, August 1, 1995)

Between August 1 and September 4, 1995 the Blackball Revision Subcommittee met with
various groups and received correspondence outlining various proposals and opinions
regarding the blackball issue.
Correspondence included:
• On August 8, 1995 Bill Sharp and the Newport Surf Council advocated for areas open to
mixed use (surfing and swimming).
• On August 24, 1995 the Lido Sands Community Association advocated to uphold the
current policies on blackball.
• On September 4, 1995 the West Newport Beach Association advocated to uphold the
current policies on blackball and a petition to "Keep blackball hours as they are" with
211 signatures from homeowners along Seashore and adjacent blocks
• Five letters from private citizens both in support and against blackball regulations
On August 22, 1995 the Blackball Revision Subcommittee held a meeting to review proposed
costs of six potential proposals, liability information, and the Fire /Marine Department
swimmer /surfer use survey.
On August 29, 1995 the Blackball Revision Subcommittee sent their recommendations to the
Parks Beaches and Recreation Commission to amend Resolution 93 -33 to three all -day surf
and swim areas from 36th — 40th streets, 44th —48 th streets, and 52nd —56 th streets.
On October 9, 1995, the Community Services Director and Fire and Marine Director reported
to the Council the findings of the PB &R Commission. Several groups were involved in the 1995
discussion. The Newport Surf Council submitted a petition with 2,082 signatures that
supported an end to Blackball regulation. The Wedge Preservation Society proposed
extending blackball to 8:OOam until 6:00 pm (set at 10:00 am to 5:00 pm in 1993) and
modifying the dates in favor of a year -round blackball. In addition to the various groups,
several individuals spoke at the meeting supporting both proposals. Congressman Dana
Rohrabacher spoke in support of three all -day surf areas.
The PB &R Commission recommended to Council three all -day surf and swim areas from 36th _
40th streets, 44th — 48th streets, and 52nd — 56th streets, and to extend the blackball time at the
Wedge from 5:00 pm to 6:00 pm. The fiscal impact of the PB &R proposal was estimated at
$4458.00 (labor and signage) for the first year and $2692.00 subsequent years. Several of the
Council Members asked questions to the Marine Safety Director regarding enforcement,
staffing, and how the discretionary policies would be implemented. A motion was made by
Councilmember Glover to adopt the PB &R Commission plan but keep the current policies at
the Wedge. Councilmember Watt then motioned to amend the previous motion to extend the
blackball time to 6:00 pm. The motion was carried and voted on, but the amendment did not
pass.
In Council Resolution 95 -116 sets times of blackball as generally between 12pm to 4pm at the
discretion of the supervising Marine Safety Lieutenant.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DESIGNATING SURFING AREAS,
ESTABLISHING DATES AND HOURS WHEN SURFING
AREAS MAY BE USED, AND RESCINDING RESOLUTION
NO. 93 -33.
WHEREAS, The City of Newport Beach is the grantee of tide and submerged lands,
including ocean beaches, within the corporate limits of the City of Newport Beach; and
WHEREAS, Members of the general public have certain constitutional and statutory
rights relative to the use of, and access to, ocean beaches; and
WHEREAS, Municipal regulation of the use of ocean beaches will promote the public
health, safety and welfare by reducing the potential for conflict between various users such as
surfers and swimmers; and
WHEREAS, The City Council is authorized, pursuant to provisions of Newport Beach
City Charter and the Newport Beach Municipal Code, to adopt reasonable regulations
specifying the days of the years, and hours of the day when ocean beaches may be used for
surfing, swimming, and other activities; and
WHEREAS, The City Council has considered public testimony from representatives of
interest groups and users of ocean beaches, reports from the Fire and Marine and Community
Services Departments, as well as the record of the proceedings conducted by the Parks,
Beaches, and Recreation Commission prior to adopting this Resolution; and
WHEREAS, The City finds and declares as follows:
A. Restrictions on the use of ocean beaches specified in this Resolution are
intended and designed to minimize any conflict between users and thereby
reduce the potential for personal injury or property damage;
B. These restrictions and regulations are consistent with the authority of the City
Council to regulate the public's right to use and access ocean beaches.
C. These restrictions and regulations are the product of extensive review and
analysis of the interests and desires of all potential users of ocean beaches, as
well as homeowners and property owners who are impacted by members of the
public who use ocean beaches; the regulations satisfy these often competing
interests and desires to the maximum extent possible; and these restrictions and
regulations represent fundamental policy decisions on the use of an important
public resource.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows:
Section 1. Definitions.
(A) Surfboard. The term surfboard shall mean:

(i) Any device which floats on or about the surface of the water, is
more than forty -four (44) inches long, has a skeg or other device on the bottom to control
direction, and is capable of being ridden by a person while standing; or
(ii) Any device with a surface made or covered, in whole or in part,
with any hard substance, including wood, metal, fiberglass, or hard plastic, which is used, or is
capable of being used, on water or ocean beaches, including, without limitation, skim boards,
knee boards, and belly boards.
(B) Floatation Device. The term floatation device shall mean any object other
than a surfboard which is buoyant or adds to the buoyancy of the user (other than fins).
(C) Blackball Flag. The Blackball Flag is any flag or sign with a yellow
background with a large black circle in the center which is posted by an employee of the City of
Newport Beach.
(D) Wedge. Shall mean the area of water and ocean beach between the West
Harbor Jetty and Lifeguard Tower P.
beach.
(E) Surfing. Shall mean the use of any surfboard in or • on the ocean or ocean
Section 2. Surfing.
(A) Surfing Areas/ Surfing Permitted. Surfing is permitted in the following areas
subject to the restrictions and regulations specified in Section 3 of this Resolution.
(i) Area No. 1 The area of ocean and ocean beaches between the area
between the west boundary of the City of Newport Beach and the West Harbor Jetty;
(ii) Area No. 2 The area of ocean and ocean beaches between the area
beginning 20 feet easterly of the East Harbor jetty and extending to a point 200 feet from the
East Harbor Jetty;
(iii)Area No. 3 The area of ocean and ocean beaches between the area which
lies between a prolongation of Poppy Avenue and the East boundary of the City of Newport
Beach including, without limitation, the area known as Little Corona Beach.
Section 3. Surfing Restrictions and Regulations. Surfing is permitted in Areas No. 1,
No. 2, and No. 3 subject to the following restrictions and regulations:
A. From June 15 to September 10 of each year, surfing is prohibited in Area No. 1,
No. 2, or No. 3, or any portion thereof, whenever the blackball flag is displayed on the beach or
on the closest lifeguard tower. The blackball flag shall generally be displayed from 12:00 noon
to 4:00 p.m. during this period, unless, in the opinion of the supervising Marine Safety
Lieutenant, the conditions in the water during that period do not create any significant potential
for conflict between surfers and other users.

B. Surfing is prohibited at the Wedge between the hours of 10:00 a.m, and 5:00
p.m., from May 1st through October 31st of each year.
C. Surfing is prohibited in the area between the midline of the rock groins located
approximately on the prolongation of 40th Street and 44th Street between May 1 st through
October 31 st of each year. Surfing is permitted in this area from November 1 st through
April 30th.
D. Surfing is prohibited except in those places at and those times expressly permitted
by this Resolution.
Section 4. Special Restrictions. No person shall use or possess any floatation device
at the Wedge between the hours of 10:00 a.m. and 5:00 p.m., from May 1st through October
31st during each year.
BE IT FURTHER RESOLVED that Resolution No. 93 -33 is hereby rescinded.

save one small area of the ocean for swimmers, bodysurfers, and body boarders that is free from the danger of the hardboards all
day long. There are no restrictions against hardboard use for half of the year. Me and my family love this place, it's the only place
where my kids can play safe in the water without having to campmate with aggressive surfers. We only want a small area for
swimmers, Body surfers and body boarders. My family and me beg you keep this area safe for our kids and regular beach goers,
after all there are the majority.
