Badum, Public Works Director 949 - 644 -3311, sbadum @newportbeachca.gov PREPARED BY: Antony Brine, City Traffic Engineer APPROVED: A TITLE: Overnight Parking Restriction on Back Bay Drive ABSTRACT: Staff reviewed a recent request to prohibit overnight parking on Back Bay Drive to address potential safety and trash issues. A Resolution has been prepared by staff which proposes a prohibition of overnight parking to address these issues. RECOMMENDATION: Adopt a Resolution prohibiting the parking of vehicles on Back Bay Drive between Jamboree Road and Shellmaker Road daily from 10:00 P.M. to 6:00 A.M. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The General Manager of the Newport Dunes sent the attached letter to the City outlining issues and concerns regarding the parking of RVs, boats, trailers and other vehicles on Back Bay Drive. The particular concerns are with the use of the Dunes' on -site facilities by individuals parking along Back Bay Drive. Staff believes the prohibition of overnight parking should eliminate the potential for problems in this area. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act ( "CEQA ") pursuant to Section 15378 of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. Location Map RESOLUTION NO. 2011 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH PROHIBITING OVERNIGHT PARKING ON BACK BAY DRIVE BETWEEN JAMBOREE ROAD AND SHELLMAKER ROAD WHEREAS, Section 12.44.160 of the Newport Beach Municipal Code provides that the City Council shall by resolution designate streets or portions of streets on which the parking or standing of vehicles after 6:00 P.M. and before 6:00 A.M. the next day is to be prohibited; and WHEREAS, the City Council shall designate in the resolution the days of the week and the exact hours during which such prohibition shall be in effect; and provided; WHEREAS, it is necessary to prohibit overnight parking as hereinafter NOW, THEREFORE, be it resolved by the City Council of the City of Newport Beach that the parking of vehicles shall be prohibited on Back Bay Drive between Jamboree Road and Shellmaker Road daily from 10:00 P.M. to 6:00 A.M. BE IT FURTHER RESOLVED, that the City Traffic Engineer is authorized and directed to cause signs to be posted on such street giving notice of such parking restrictions. Back Bay Drive has become a favorite "free" parking location for transients and undesirables in this part of Newport Beach. I would like to see overnight parking prohibited along the street for several reasons. People parking on Back Bay Drive right outside of Newport Dunes Waterfront Resort are usually transients with some of their vehicles looking unsightly and the occupant's undesirables for the city. We have seen many RV's, boats, trailers and other types of vehicles parked on the street. Some even sleep inside their vehicles. The occupants come on to our facility to use our showers and other facilities that are available for our guests. They also leave their trash on our property and on the street with empty alcohol containers, food wrappers from fast food establishments, and generally debris. I feel that these are not the type of people we want to attract to the city and they could lead to other problems within the city. Please feel free to contact me to discuss the situation further.
