TITLE: Approve Resolution to Establish Permanent Parking Restrictions on Central Avenue for Lido Marina Farmer's Market ABSTRACT: Through an agreement with the City, the Lido Marina Farmer's Market has reserved seven public parking spots along Central Avenue to facilitate operations of the market. To reserve these parking spots, temporary no parking /tow away signs are placed for each event, requiring staff to erect and verify the signage weekly. To streamline the process, staff proposes creation of Central Avenue parking restrictions and the installation of fixed signs to restrict parking for the duration of the agreement. Approve Resolution 2011- 95 to establish "No Parking -Tow Away" restrictions for seven parking meter - controlled spots on Central Avenue from 7AM to 4PM, Sundays, during the Lido Marina Farmers Market. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: Through an agreement with the City, The Lido Marina Farmer's market occurs Sundays on Via Oporto between Central Avenue and Via Lido. During the event, Central Avenue is closed to vehicular traffic, including parking. To facilitate the operation of the event, the applicant is permitted use of seven public parking meter - controlled parking stalls for vendor parking. Approve Resolution to Establish Permanent Parking Restrictions on Central Avenue for Lido Marina Farmer's Market October 11, 2011 Page 2 Reservation of these parking spots requires weekly posting, verification, and removal of temporary no parking /tow away signs, which the City provides to the applicant. This process places a weekly burden on City and Farmer's Market staff to ensure the process is followed properly. To streamline the process, staff proposes creation of parking restrictions, allowing for permanent signs to be placed. The proposed restrictions would prohibit parking within the seven dedicated parking spots during the farmers market (SUNDAYS, .7:00 AM to 4:00 PM), except for permitted vehicles. The restrictions would also allow vehicle removal to allow the Police Department to clear the parking spots for the intended use. Per Municipal Code Sections 12.44.150 (A) and 12.40.190 (B), approval of Resolution 2011 - would allow staff to create and enforce the necessary parking restrictions and allow for removal of vehicles parked within a posted zone. If approved, parking restrictions related to the Lido Marina Village Farmer's Market would be in place for the duration of the agreement. The restrictions would be removed if the agreement expires or is terminated. The current agreement will expire on May 31st, 2016, and can be extended for an additional five years. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Exhibit Attachment A RESOLUTION NO. 2011 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH PROHIBITING PARKING ON CENTRAL AVENUE SUNDAYS BETWEEN 7:00 AM AND 4:00 PM AND ESTABLISHING A TOW -AWAY ZONE WHEREAS, Section 12.44.150 of the Newport Beach Municipal Code provides that the City Council shall by resolution designate streets or portions of streets on which the parking or standing of vehicles is to be prohibited, and shall designate in the resolution the days of the week and the exact hours during which such prohibition shall be in effect; and WHEREAS, Section 12.40.190 of the Newport Beach Municipal Code provides that any vehicle which is parked or left standing on a street or highway, public beach or tidelands at any place that has been established as a no- parking area by resolution of the City Council when signs are posted giving notice that vehicles parked in such area are subject to removal; and WHEREAS, it is necessary to prohibit parking and establish a zone in which vehicles may be subject to removal as hereinafter provided; NOW, THEREFORE, be it resolved by the City Council of the City of Newport Beach that the parking of vehicles shall be prohibited and subject to removal within seven on- street, angled parking spaces located along the east shoulder of Central Avenue, north of Via Oporto on Sundays between 7AM and 4PM. BE IT FURTHER RESOLVED, that the City Traffic Engineer is authorized and directed to cause signs to be posted on such street giving notice of such parking restrictions.
