CURRENT BUSINESS CLARIFICATION OF ITEMS ON THE CONSENT CALENDAR. (3:30 P.M.) 2. BALBOA THEATER PROJECT UPDATE. (3:45 P.M.) Officials from the Balboa Performing Arts Theater Foundation (the theater is awned by the City and located in Balboa Village) will make a presentation to the Council and public about their capital campaign and related fundraising activities. Later in the evening session's agenda is a proposed amendment to the City's agreement with the Foundation for the Theater. 3. NEWPORT BANNING RANCH DRAFT ENVIRONMENTAL IMPACT REPORT REVIEW PROCESS. (4:00 P.M.) Community Development staff will brief the Council and community on the review and comment process associated with the Draft Environmental Impact Report (DEIR) for the Banning Ranch development on the west side of town. This presentation is not about the material within the DEIR, but the process to review that material. 4. WEST NEWPORT FACILITIES. (4:15 P.M.) Public Works staff will update the Council on possible community facility changes in and around West Newport, including the Corporate Yard, the Utilities Yard, and the current City Hall site. Staff will seek guidance from the Council as to moving forward with further analyses of the sites. The City provides a yellow sign -in card to assist in the preparation of the minutes. The completion of the card is not required in order to address the Council. Speakers must limit comments to five (5) minutes on agenda items. The Council has the discretion to extend or shorten the time limit on agenda or non- agenda items. As a courtesy, please turn cell phones off or set them in the silent mode. Any writings or documents provided to a majority of the City Council regarding any item on this agenda will be made available for public inspection in the Office of the City Clerk located at 3300 Newport Boulevard during normal business hours. In addition, such writings and documents will be posted on the City's website at www.newportbeachea.gov This meeting is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that the agenda be posted at least 72 hours in advance of each meeting and that the public be allowed to comment on agenda items before the City Council and items not on the agenda but are within the subject matter jurisdiction of the City Council. The City Council may limit public comments to a reasonable amount of time, generally either three (3) or five (5) minutes per person. It is the intention of the City of Newport Beach to comply with the Americans with Disabilities Act (ADA) in all respects. If, as an attendee or a participant at this meeting, you will need special assistance beyond what is normally provided, the City of Newport Beach will attempt to accommodate you in every reasonable manner. HARBOR SPEED LIMIT — PROPOSED CHANGES. (4:45 P.M.) Harbor Commissioners have been interested in making it clear that some sailing races should be allowed, under certain circumstances, to exceed the current speed limits in and around Newport Harbor — races like the Thursday "beer can" races out of the Balboa Yacht Club. This item allows staff and the Council to discuss the merits of amending the NBMC to specifically allow the speed limit to be exceeded for these (and other) races. III. PUBLIC COMMENTS Public comments are invited on Closed Session Agenda items, as reflected in Item 11 - Closed Session of the Regular Meeting agenda, and on non - agenda items generally considered to be within the subject matter jurisdiction of the Council.
