RECOMMENDATION: Adopt the attached Resolution allowing businesses to display promotional temporary banners for up to eight (8) times per calendar year not to exceed 120 days total through December 31, 2013. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. However, increasing the allowed duration will require more staff time for the issuing and monitoring of promotional temporary banner permits. DISCUSSION: A promotional temporary banner is a temporary sign or banner displayed to advertise temporary events such as sales, seasonal events, and going- out -of- business sales. Section 20.42.090 (Standards for Temporary Signs) of the Municipal Code allows promotional temporary banners up to four (4) times per year, not to exceed 60 days total per year. Twice in recent years the City Council has extended this duration to up to eight (8) times per year, not to exceed 120 days total per year. FI Duration of promotional temporary banners (PA2011 -176) October 25, 2011 Page 2 On October 28, 2008, the City Council adopted Resolution No. 2008 -90, allowing a temporary increase in the number of times and total days for promotional temporary banners. The change was effective until December 31, 2009. On January 12, 2010, the City Council adopted Resolution No. 2010 -1, allowing a temporary increase in the number of times and total days for promotional temporary banners. The change was effective until December 31, 2010. For the previous two approvals, the Economic Development Committee (EDC) recommended to the City Council approval of the temporary extension based on the economic condition of the City in order to provide additional support to the business community during the economic downturn. Staff has received feedback from business operators interested in a time extension for temporary banners. The previous EDC recommendations are still applicable today as the economic conditions have not remarkably improved. All other standards for temporary banners would remain in place, including the number and location of banners. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is covered by the general rule that the California Environmental Quality Act (CEQA) applies only to projects that have the potential for causing a significant effect on the environment (Section 15061.b.3 of the CEQA Guidelines). It can be seen with certainty that there is no possibility that this activity will have a significant effect on the environment. Therefore, this activity is not subject to CEQA. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). WHEREAS, Section 20.42.090 (Standards for Temporary Signs) of the Municipal Code allows promotional temporary banners up to four (4) times per year, not to exceed 60 days total per year; WHEREAS, the City Council wishes to cooperate with and support local businesses during difficult economic times, and is willing to relax the promotional temporary banner standards for a limited period of time; WHEREAS, this action is covered by the general rule that the California Environmental Quality Act (CEQA) applies only to projects that have the potential for causing a significant effect on the environment (Section 15061.b.3 of the CEQA Guidelines). It can be seen with certainty that there is no possibility that this activity will have a significant effect on the environment. Therefore, this activity is not subject to CEQA; and WHEREAS, a public meeting was held on October 25, 2011, in the City Hall Council Chambers, 3300 Newport Boulevard, Newport Beach, California. A notice of time, place and purpose of the meeting was given in accordance with the Newport Beach Municipal Code. Evidence, both written and oral, was presented to, and considered by, the City Council at this meeting. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach hereby adopts temporary standards for the display of promotional temporary banners, as follows: Section 1: Temporary Suspension of Standard Zoning Code Section 20.42.090 (A) Table 3.18, Duration of promotional temporary banners: "Up to 4 times per year, not to exceed sixty (60) days total per year' is suspended. Section 2: Establishment of Temporary Standard Zoning Code Section 20.42.090 (A) Table 3.18, Duration of Promotional temporary banners: "Up to 8 times per year, not to exceed 120 days total per year" is substituted. 5 City Council Resolution No. 2011- Section 3: All Other Standards All other standards relating to the use, number, placement, maximum area, maximum height and permitting of temporary promotional banners shall remain in full force and effect. Section 4: Expiration of Temporary Standard Effective January 1, 2014, Zoning Code Section 20.42.090 (A) shall return to the provisions in effect prior to the adoption of this Resolution, unless the City Council amends this section of the Municipal Code prior to that date.
