SUBJECT: RELEASE OF SURETIES FOR THE MAC ARTHUR BOULEVARD
WIDENING RELATED TO TRACT NO. 12105 AND TRACT NO. 14533
RECOMMENDATIONS:
1. Authorize the City Clerk to release the Labor and Materials Bond and the Faithful
Performance Bond for the construction of MacArthur Boulevard Improvements
along the residual parcel adjacent to Tract No. 12105 (Bond No. 5241 0025).
2. Authorize the City Clerk to release the Labor and Materials Bond and the Faithful
Performance Bond (Bond No. 17- 64 -49) for the construction of MacArthur
Boulevard Improvements along Tract No. 14533 frontage.
DISCUSSION:
The Irvine Company has asked the City to release the subdivision bonds guaranteeing the
completion of MacArthur Boulevard improvements adjacent to Tract No. 12105 and Tract
No. 14533 as these improvements have been completed (see attached letter).
The MacArthur Boulevard improvements were completed under a contract administrated
by the City using Circulation Improvement and Open Space Agreement (CIOSA) funds,
which were provided by the Irvine Company.
The final Tract Map for Tract No. 12105 was approved by the City Council on December 9,
1985, along with the agreement and bonds for the completion of the MacArthur Boulevard
improvements.
The Irvine Company purchased a bond (Bond No. 17- 64-49) to guarantee completion of
MacArthur Boulevard improvements adjacent to Tract No. 14533 in 1994. The City
approved the Tract Map for Tract No. 14533 on June 13, 1994, but has no record of

approving a subdivision agreement and bonds for the MacArthur Boulevard
improvements.
Environmental Review:
This report is for release of bonds. Environmental review was completed with the
construction project.

The Irvine Company has fulfilled their obligation on the above referenced
improvements, and hereby requests a release from Bond No. 52410025 in the
amount of $310,000.00 and Bond No. 17 -64-49 in the amount of $600,000
(copies attached).
In our previous conversations, you indicated that Dick Hoffstadt would be
processing the exoneration of these bonds. We appreciate the City's expeditious
handling of these bonds.
