TITLE: Acceptance of 2015/2016 State of California, Office of Traffic Safety DUI Enforcement,
Awareness, and Traffic Safety Programs Grant #PT1631
ABSTRACT:
The Police Department seeks acceptance of a grant totaling $363,740 from the State of California, Office of
Traffic Safety ( "OTS ") to fund a Driving Under the Influence ( "DUI ") Enforcement and Awareness Program,
Traffic Safety Enforcement, and DUI Sobriety Checkpoints.
RECOMMENDATION:
a) Authorize the City Council to accept a $363,740 Selective Traffic Enforcement Program ( "STEP ") award
granted to the Newport Beach Police Department by the OTS per Council Policies F -3 and F -25. To comply
with Council Policy F -3, City Council must formally accept the award of $363,740 and create a new
appropriation to expend the money; and
b) Approve Budget Amendment No. 16BA -003 increasing Police revenue estimates and expenditure
appropriations by $363,740.
FUNDING REQUIREMENTS:
The Budget Amendment records and appropriates $363,740 in additional revenue from the OTS STEP Grant
and $363,740 in increased expenditure appropriations.
The revenue will be posted to the OTS STEP FY16 Account #11035 - 431360 -G1601 and the expenditure
appropriations will be posted to the various expenditure accounts within the OTS Fund, according to the
following breakdown:

DISCUSSION:
Background:
The City of Newport Beach is a unique and dynamic community at approximately 53 square miles, including
areas of water. Newport Beach consists of rugged coastline, inland waterways, and has a diverse mix of
commerce, tourism, and distinct residential communities.
Newport Beach routinely competes with other cities for the most Department of Alcoholic Beverage Control
licensed establishments in the State of California (per capita). According to Alcohol- Sensitive Information
Planning System (ASIPS -GIS) data, Newport Beach has a population density three times that of the state
average for on -sale establishments. The population of Newport Beach is approximately 86,000 residents;
however, during the summer months, the City experiences an influx of transient population that can exceed
100,000 daily visitors. While this tourist population generates positive tax revenue for the City, it also stresses
infrastructure and departments, including the Police Department.
In 2007, the City's first grant was requested and awarded through the OTS. Since then, the Department has
been dedicated to the reduction of DUI - related collisions, community education, and enforcement. The City
continues to recognize the need for ongoing DUI enforcement and education.
The most recent data (2012) available from the OTS reveals that the City of Newport Beach was in the top 10
of similar -sized cities in several collision - related categories, including speed - related collisions, motorcycle
collisions, and bicycle collisions. As a function of previous grant years related to DUI enforcement efforts, the
City of Newport Beach was rated in the top 10 of 102 cities for DUI arrests in 2012.

The Newport Beach Police Department has applied for and has been awarded a grant from the State of
California, OTS, to increase DUI Enforcement and Awareness and to fund additional traffic safety enforcement
in the City of Newport Beach. Grant number PT1631, STEP, will become effective October 1, 2015, and will
expire September 30, 2016.
The grant funds will pay for overtime costs for officers specifically assigned to DUI enforcement and awareness
programs, including six DUI checkpoint operations, warrant service operations, stakeout operations, and traffic
enforcement operations related to distracted driving, motorcycle safety, and bicycle /pedestrian enforcement
operations. In -state travel and training expenses are also included in the grant for officers attending
Standardized Field Sobriety, Advanced Roadside Impaired Driving, and Drug Recognition Expert training.
New to the grant this year is the "Know Your Limits" program. The "Know Your Limits" program is a
collaborative effort between the Police Department and the local bars to educate patrons about the dangers of

DUI. It is designed to have the Police Department provide patrons at the bars with breath tests in order to
learn their blood alcohol concentration. The program allows participants to "Know Your Limits" before they
might consider driving after they have consumed alcohol. Also included in the grant funds is an allocation for
new DUI /DL Checkpoint lighting equipment, which will allow for a safer and more efficient operation of DUI /DL
Checkpoints at night.
Almost all DUI efforts involve overtime, as they are unique and short-term assignments that do not involve the
personnel normally scheduled during DUI enforcement shifts; in other words, we retain the same number of
officers on patrol even as we have other officers work a DUI enforcement activity.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California Environmental Quality Act
( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable
indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section
15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which
the City Council considers the item).

Congratulations! Through a competitive process, the Office of Traffic Safety (OTS) has tentatively
approved your funding request for the proposal titled "Selective Traffic Enforcement Program (STEP)'
in the amount of approximately $363,740.00.
Your OTS Coordinator will contact you, to discuss your proposal and explain the Grant Agreement
process. It is our goal to have all new grants start no later than October 1, 2015. If approval from a
City Council or the Board of Supervisors is required, you should begin that process now. Do not incur
grant reimbursable costs prior to the receipt of your official approval packet from OTS or before your
grant start date.
OTS will initiate a statewide media news release regarding 2016 proposals selected for funding. Your
agency should not publically announce this tentative award until the grant agreement is fully
negotiated and signed by OTS.
