Bludau, City Manager 949 - 644 -3000, HBludau @city.newport- beach.ca.us SUBJECT: Council Consideration of City Council Candidates' Interview and Selection Procedure ISSUE: What are the "rules" the City Council wants to utilize in conducting Council Candidate interviews, which are open to the public? RECOMMENDATION: Discuss and provide direction. DISCUSSION: Background: On September 23rd, the City Council accepted Council Member Proctor's Letter of Resignation, effective September 30`h. From the time the office is vacant, the City Charter gives the City Council 30 days to name a replacement from the district vacated. If the City Council does not name a replacement within the 30 day window, the Charter says the replacement will then be selected through an election. Council Member Proctor represented Council District 2; this position will be up for election again in November, 2004. The City Council has already determined that it intends to name a replacement within the 30 days prescribed by the City Charter, and will do so by interviewing all legally qualified candidates in a meeting open to the public. Issue: Given Council's decision to conduct candidate interviews in public, there are some parameters that Council will want to place on the interview process in advance, so all candidates will know the "rules" for the interviews. The City Manager is posing the City Council Candidates' Interview & Selection Procedure October 14, 2003 Page 2 following questions which Council will want to answer to assist in establishing the interview parameters. They are as follows: 1. What is the date and time of the interviews? 2. How long will each interview be scheduled for? 3. How will the interview order be determined? 4. Will candidates be allowed in the audience prior to their interview? (Will they be allowed to hear the questions in advance ?) 5. Will Council ask each candidate the same basic questions? If so, how will those questions be determined? 6. Will the Council have discussion on the candidates immediately after the interviews, and does Council intend to make a decision immediately after the discussion? 7. When will the new Council Member be sworn in? 8. If Council believes there are too few applicants, does it want to consider extending the application deadline? The application deadline closes at noon, Thursday, October 9th. The City Manager will provide the Council with all applications that arrive prior to the deadline. A supplemental agenda item with the complete list of candidates and applications will be distributed on Friday, October 10th Should the interviews be held during a weekday morning or afternoon, the public channel is not available to carry this program live. However, it could be taped for replay. If the interviews are conducted between 4:00 p.m. and 11:00 p.m., the program could be shown live. Council may want to consider the date of October 2151, which would allow for the new Council person to be seated for the October 28th meeting. Submitted by: Homer L. My wife, Jeri, and I have enjoyed the benefits of living, recreating, and working in Newport Beach for 27 years. District 2 uniquely consists of some of the oldest areas as well as one of the largest undeveloped parcels (Banning Ranch) in the city. The combination of aging infrastructure and growth issues dictate that now is the time to devise a "game plan" for District 2. The Banning Ranch General Plan Amendment, 20+ years ago, was my first experience with land use issues in the city. Initially as Co- Chairperson of the West Newport Legislative Alliance and later independently, I strove for a compatible balance between residential, light industrial, and commercial development with adequate accommodation for traffic, recreation and open space, fire and police protection, and schools. The Banning Ranch remains an opportunity and a concern for West Newport that, as an applicant to this position, I am uniquely qualified to address. As a planning commissioner I was involved in several General Plan Amendments and advocated certification of our Local Coastal Plan. I have served the community in many and various capacities. (Please see previous page and attachment.) I have demonstrated an ongoing interest in, and understanding of, issues of importance to our city. I founded Comstar Industries 16 years ago with one employee. Today Comstar is financially successful, employing 23 people with annual sales well in excess of a million dollars. I have built and managed the business myself; developed business plans and budgets, financed long term equipment loans and short term lines of credit, signed vendor checks and payroll checks. I understand the motivations and concerns of business owners and recognize their importance to the community. I will work with the business community, including those along Pacific Coast Highway at the western entrance to our city, to pursue revitalization and beautification as has been accomplished in other parts of town. I want to put my experience, seasoned by many years of continued interest and participation, to work for the city during the current economic climate and to ignite a revitalization of District 2. I believe that my legal and business background will be an asset to the City in charting a fiscally and socially responsible course at a time when many decisions will need to be made. Up to this point, I have served the community on several levels. I have been a Cubmaster for Cub Scout Pack 37 on Lido Isle and for the last seven years I have been an Assistant Scoutmaster with Boy Scout Troop 90 at the Sea Base on Newport Harbor. Additionally, the upcoming General Plan Amendments, the revisions to the City tree policy, the continuing issues with John Wayne Airport and the intelligent growth and vitality of our City will all need to be addressed. The "visioning process" is a noteworthy example, followed by the expansion of the Environmental Quality Affairs Committee and the restructuring of other Committees. The Mayor often notes that there are at present over 150 individuals in this City, myself included, who give their time and energies to making these Committees contribute to the overall well being of the City. Last month, Mayor Bromberg pointed out that the City Charter does not specify a process in such matters.. While I appreciate the short time constraints placed on Council to fill a vacancy and the City Manager's concern, I strongly suggest that this does not preclude some reasonable form of public participation. In that vein, I am making the following proposal to you this evening. The City's various Boards and Commissions involve over 150 members of the citizenry. I recommend that, at a minimum, the interview process include participation by 7 citizens, accompanied by 7 alternates, chosen through a random process. Using the recent statewide election random selection of letters (listed below), I applied those letters to the August 27, 2003 list of city Boards, Commissions and Committees. (A more recent list with updates may be available, changing the actual random selection possibly) Once a "letter" was used, I proceeded to the next "letter", culling the next name in order of appearance In so doing, I came up with a list of citizens that is composed of the following: Citizens: Skoro, Val (PB & R) Garrett, William (PB & R) Toerge, Michael (Planning) Cunningham, John (Aviation) Ishikawa, Michael (GPAC) Englebrecht Roy (PB & R) Krotee, Don (GPAC) Alternates: Peterson, Kathleen (Library Trustee) Dunlap, James Jr (Civil Service) Fitzgerald, Maggie (EQAC) Lugar, Phillip (GPAC/EQAC) Root, Larry (GPAC- Aviation) Wampole, Daniel (NCAC) Jeannette, Brion (Building Code Appeals) Alternates will be used just as in a typical jury pool. Any individuals choosing not to participate, including alternates, will be filled by subsequent alternates, chosen by continuing the same process through the remaining "letters" (M,V,A, H, B, X, Y) The City Clerk can confirm these selections using the same system with the most current City list of Boards, Commissions, and Committees. In conclusion, I hope that others will come forth this evening to support this effort to manifest a more representative process.
