SUBJECT: Appointment to the Coastal /Bay Water Quality Citizens Advisory
Committee
ISSUE:
Who should be appointed to fill a District #4- appointed resident vacancy on the
Coastal /Bay Water Quality Citizens Advisory Committee?
RECOMMENDATION:
Confirm the appointment of as Council Member Adams' appointment
to the Coastal /Bay Water Quality Citizens Advisory Committee.
DISCUSSION:
Background: The Coastal /Bay Water Quality Citizens Advisory Committee is a 9
member Citizens Advisory Committee (with 2 members of the City Council appointed by
the Mayor and 7 residents, each appointed by each of the 7 Council members) charged
with:
Improv(ing) and preserv(ing) Newport Bay and the Newport Beach
coastline as a resource for swimmers, boaters, marine life, and waterfowl.
The Committee meets monthly (every 2nd Thursday at 3:00 p.m.) and has addressed
issues such as:
• Water quality testing in Newport Bay;
• Habitat restoration and improvement in the Upper Bay;
• The OCSD's ocean outfall and its transition to the discharge of wastewater
treated to a secondary treatment level (the "301 [h] Waiver');
• The Harbors pumpout program;
• The four Total Maximum Daily Loads (TMDLs) for Newport Bay;
• The City's municipal separate storm sewer system (MS4) permit under the
National Pollutant Discharge Elimination System;

• Improving the City's regulations relating to fats, oils, and grease in wastewater
lines and improving the City's sanitary sewer overflow (SSO) responses;
• Amending the Newport Beach Municipal Code to better protect water quality;
• The installation of capital projects (including storm drain -to -sewer diversions and
catch basin screens and filters) to reduce beach postings and closures;
• Water quality educational programs, including the 5th Grade educational program
at the Newport Harbor Nautical Museum and water quality videos; and
• Better ways for the City's municipal operations to protect water quality (street
sweeping, pet waste enforcement, etc.).
The Committee's structure and duties are described in Attachment A. The Committee's
membership -- previous to this vacancy -- was as follows:

District #7 Appointment -- Dennis Baker
Today, one vacancy exists on the Committee -- District #4's appointed position. This
open position resulted f rom the May 31, 2003 death of longtime Committee member
Bud Frenzel.
This staff report asks for the Council's concurrence with Council Member Gary Adams's
expected appointment. The District #4 appointment is not required to be a resident of
District #4, but it is Council Member Adams' appointment to make.
Environmental Review: The City Council's approval of this Agenda Item does not
require environmental review.
Public Notice: This agenda item may be noticed according to the Ralph M. Brown Act
(72 hours in advance of the public meeting at which the City Council considers the
item).

COASTAL /BAY WATER QUALITY
CITIZENS ADVISORY COMMITTEE
AUTHORIZATION:
Established by Resolution No. 86 -59, adopted on July 14, 1986. Amended by
Resolution No. 99 -45, adopted on June 28, 1999. Amended by Resolution No. 2000 -9,
adopted on January 25, 2000. Duties and name changed (formerly Harbor Quality
Citizens Advisory Committee) by Resolution No. 2002 -9, adopted on January 22, 2002.
MEMBERSHIP:
The Committee shall consist of seven (7) private citizens and two (2) members of the
City Council. Each member of the City Council shall nominate one of the private
citizens; the nomination to be confirmed by the City Council.
The Mayor shall appoint the two (2) Council Members to serve on the Committee; the
Harbor Resources Division or the City Manager's Office shall provide staff assistance,
including the preparation of minutes, agendas and reports. The Committee shall have
Chairman and Vice - Chairman, each of whom is to be appointed by the Mayor. The
Mayor has the discretion to appoint either a Council Member or a citizen to these two
positions.
MISSION:
To improve and preserve Newport Bay and the Newport Beach coastline as a resource
for swimmers, boaters, marine life, and waterfowl.
PURPOSE & RESPONSIBILITIES:
The Committee shall advise and make recommendations to the City Council on policies,
projects and programs that will achieve the Committee's mission, including Council
efforts to:
A. Educate the watershed's population about the value of Newport Bay and the
ocean;
B. Enforce and /or strengthen existing regulations on actions that impair water
quality or wildlife habitat;
C. Advocate for policies, programs and projects that improve the water quality of
Newport Bay and the ocean;
D. Oppose policies, programs or projects that detract from good water quality in the
Newport Bay watershed and the ocean; and
E. Develop, fund, and monitor water quality initiatives, including testing and
structural projects, that meet the Committee's mission.
TERMINATION:
This Committee shall have no specific date of termination.
