RECOMMENDATION: Continue the item to the September 22, 2015 City Council meeting. FUNDING REQUIREMENTS: There is no expenditure of funds related to this item. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to Government Code Section 66018(a) (two publications with at least five days intervening between the two dates), Government Code Section 66016(a) (notice mailed at least 14 days prior to the meeting to any interested party who files a written request) (mailed notice to the Building Industry Association of Southern California, AT&T, and Southern California Gas Company on August 25, 2015), and the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). 20-1 CITY OF NEWPORT BEACH NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that on Tuesday, September 8, 2015, at 7:00 p.m. or soon thereafter as the matter shall be heard, a public hearing will be conducted in the Council Chambers at 100 Civic Center Drive, Newport Beach. The City Council of the City of Newport Beach will consider the following item: Approval of Master Fee Schedule and Change in Subsidies— The City Council will consider the establishment of cost of services fees which include development review fees as well as an amendment to Newport Beach Municipal Code Section 3.36.030. Also to be considered, updates to the Paramedic Subscription Service and an amendment to Newport Beach Municipal Code Section 5.60.020 granting the City Manager authority to waive all or part of paramedic user fees. NOTICE IS HEREBY FURTHER GIVEN that this code amendment is not subject to the California Environmental Quality Act ("CEQA") pursuant to Section 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICE IS HEREBY FURTHER GIVEN that on June 11, 2015, by a vote of (6-0) Council Member Petros with an excused absence, the Finance Committee of the City of Newport Beach recommended approval of the proposed changes in fees to the City Council. All interested parties may appear and present testimony in regard to this item. If you challenge the Master Fee Schedule and Change in Subsidies in court, you may be limited to raising only those issues you raised at the public hearing or in written correspondence delivered to the City, at, or prior to, the public hearing. As required by Government Code Sections 66016 and 66018, prior to the public hearing data indicating the amount of estimated cost required to provide the services, which is the basis for the proposed fees, may be reviewed at the Revenue Division (Bay A, 1 St Floor) and City Clerk's Office (Bay E, 2nd Floor), 100 Civic Center Drive, Newport Beach, California, 92660.
