Brown, City Clerk APPROVED: TITLE: UNSCHEDULED VACANCIES ON THE HARBOR COMMISSION AND PLANNING COMMISSION ABSTRACT: Due to the resignations of Vince Valdes from the Harbor Commission and Robert Hawkins from the Planning Commission, the City Council must fill the position pursuant to Policy A -2, Board and Commission Appointments. RECOMMENDATION: a) Confirm Mayor Gardner's appointment of Mayor Nancy Gardner, Council Member Ed Selich, and Council Member Rush Hill to serve on the Ad -Hoc Appointments Committee. b) Direct the City Clerk to post and publish a Special Vacancy Notice requesting that applications for either commission be submitted by 4:00 p.m. on Wednesday, February 8, 2012, and schedule the submission of nominations to the City Council on February 28, 2012 with the final appointment to be made on March 13, 2012. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. Unscheduled Vacancies on the Harbor Commission and Planning Commission January 24, 2012 Page 2 DISCUSSION: On January 10, 2012, the City Clerk received a Letter of Resignation from Harbor Commissioner Vincent Valdes effective immediately. Mr. Valdes was appointed to a four -year term on the Harbor Commission effective July 1, 2009. His term expires on June 30, 2013. Planning Commissioner Robert Hawkins resigned during the January 10, 2012 City Council meeting effective immediately. Mr. Hawkins was reappointed to serve a second four -year term on the Planning Commission effective July 1, 2008. His term expires on June 30, 2012. Pursuant to Council Policy A -2, the City Clerk will prepare a Special Vacancy Notice for posting and publication of the unscheduled vacancy. As per the notice, applications will be accepted by the City Clerk's Office until 4:00 p.m. on Wednesday, February 8, 2012. At the close of the application period, the current applications on file and any new application will be forwarded to the newly- appointed ad -hoc appointments committee for them to review and conduct any necessary interviews. The two nominations for the Harbor Commission and the two nominations for the Planning Commission will be forwarded to the full City Council for confirmation on Tuesday, February 28, 2012, with the final appointment scheduled for Tuesday, March 13, 2012. Also pursuant to Council Policy A -2, the City Council has the discretion to appoint a replacement to serve the balance of the Planning Commission unexpired term plus one full term of four -years since the unscheduled vacancy is occurring within one -year of the expiration of the term (June 30, 2012). If desired, the new Planning Commissioner's term would expire on June 30, 2016. Once the final appointment to the Planning Commission is made by the City Council, this Ad Hoc Appointments Committee will automatically sunset without further action by the City Council. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
