Due to unforeseen field- changed conditions and inclement weather this past winter season, the contractor is allowed additional working days to complete construction. Amendment No. 2 with Anderson Penna is needed to extend construction management services to the end of July 2012. RECOMMENDATION: Approve Amendment No. 2 with Anderson Penna for additional construction management services at a not -to- exceed price of $48,631 for the Jamboree Road Bridge Widening Over State Route 73 project and authorize the Mayor and City Clerk to execute the Amendment. FUNDING REQUIREMENTS: The current adopted budget includes sufficient funding for this purchase. It will be expensed to the Measure M Competitive account in the Public Works Department, 7284- C2002019. DISCUSSION: The Jamboree Road Bridge Widening Over State Route 73 project involves widening the west side of the Jamboree Road bridge overcrossing State Route 73 to accommodate one additional thru lane in each travel direction. The roadway leading to the bridge is also being widened in order to transition to the proposed lane configuration Jamboree Road Bridge Widening Over State Route 73 - Approval of Amendment No. 2 with Anderson Penna June 12, 2012 Page 2 across the bridge. Construction is currently 75 percent complete and is scheduled to be substantially complete in July 2012. The City requested proposals from five firms to provide construction management services and selected Anderson Penna based on their project understanding, expertise of project team, and previous experiences. The Professional Services Agreement with Anderson Penna in the amount of $533,850 did not include civil inspection service which was to be provided by City staff. Due to the loss of a Public Works inspector, Amendment No. 1 in the amount of $104,995 was processed to include civil inspection service. We encountered several unforeseen field changed conditions such as unidentified existing utilities and unfavorable soil conditions. As a result, the contractor was allowed additional working days to complete construction. The time extension was also partly attributed to the inclement weather during the past winter season. Amendment No. 2 with Anderson Penna is needed to extend construction management services to the end of July 2012. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the. California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. FOR CONSTRUCTION MANAGEMENT SERVICES FOR'JAMBOREE ROAD BRIDGE WIDENING OVER STATE ROUTE 73 THIS AMENDMENT NO. TWO TO PROFESSIONAL SERVICES AGREEMENT ( "Amendment No. TWO "), is entered into as of this day of - 2012, by and between the CITY OF NEWPORT BEACH, a California Municipal Corporation ( "City "), and ANDERSONPENNA PARTNERS, INC. a California Corporation whose address is ,309 Agate Street, Laguna Beach, California 92651 ( "Consultant "), and is made with reference to the following: RECITALS: A. On June 8, 2010, City and Consultant entered into a Professional Services Agreement ( "Agreement ") for construction management services for the Jamboree Road Bridge Widening over State Route 73 ( "Project "). B. On, June 23, .2011, City and Consultant entered into Amendment. No. One to the Agreement to increase the scope of services and to, increase the total compensation ( "Amendment No. One "). C. City desires to enter into this Amendment No. TWO to reflect additional services not included in the Agreement or prior Amendment and to increase the total compensation. D. City and Consultant mutually desire to amend the agreement, as provided below. NOW, THEREFORE, .it, is mutually agreed by and between the undersigned parties as follows: 9. SERVICES TO BE PERFORMED Section 2 of the Agreement, as amended shall be supplemented to include the Scope of Services dated March 15, 2012 which is attached hereto as Exhibit'A' and incorporated herein by reference. The City may elect to delete certain tasks of the Scope of Services at its sole discretion. 2. COMPENSATION The introductory, paragraph to Section 4 of the Agreement as amended shall be amended in its entirety and replaced with the following: City shall pay Consultant for the services on a time and expense not -to- exceed basis in accordance with the provisions of this Section and the Schedule of Billing Rates attached to the Agreement as Exhibit 0 'B' and incorporated herein by reference. Consultant's total amended compensation for all work performed in accordance with this Agreement and all prior amendments, including all reimbursable items and subconsultant fees, shall not exceed Six Hundred Eighty -Seven Thousand, Four Hundred Seventy -Six Dollars and no /100 ($687,476.00) without prior written authorization from City ( "Total Amended Compensation "). No billing rate changes shall be made during the term of this Agreement without the prior written approval of the City. 2.1 The Total Amended Compensation reflects Consultant's additional compensation for additional services to be performed in accordance with this Amendment No. Two, including all reimbursable items and subconsultant fees, in an amount not to exceed Forty -Eight Thousand, Six Hundred Thirty -One Dollars no /100 ($48,631.00), without prior written authorization from City. 3. INTEGRATED CONTRACT Except as expressly modified herein, all other provisions, terms, and covenants set forth in the Agreement as amended shall remain unchanged and shall be in full force and effect. This Amendment request is for the amount of $48,631. With this Amendment APP'S remaining budget will cover: • APP's Resident Engineer, estimated level of effort of approximatly 8 hours per week, through the completion of the project in July, • APP's Structures Representative through the completion of the Jamboree Bridge widening, • APP's Structures Inspector through the completion of the bridge, and • APP's Geotechnical Subcontractor, estimated remaing level of effort to the end of the project of $11,500. As you know, we have made every effort to cut costs and absorb as much of the unforeseen impacts as possible through reducing staff time and substantially reducing billing rates. Attached is a revised fee estimate detail for your consideration. The fee estimate assumes the project will be substantially complete by mid June.
