At the conclusion of the application period (May 16, 2012) the committee reviewed the applications on file and conducted interviews with selected applicants on Friday, June 8, 2012, and Saturday, June 9, 2012. The appointments to fill these vacancies are scheduled for Tuesday, June 26, 2012. All new terms will be effective July 1, 2012, with an expiration date of June 30, 2016. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Recognizing that several people have submitted applications for consideration for the term commencing July 1, 2012, we believe the reappointment of Mrs. Allen and Mr. Dunlap will serve the City's best interests. Both members reflect a positive image of the City and resolve issues with professionalism and poise. We engaged in a complete and comprehensive review of all the CSB Rules, ordinances, charter provisions and MOU's. Many of these regulations dated from the 1950's and 60's. They were not indexed, confusing and often contradictory. We recommended streamling.That has made the regulations more understandable to the departments and the employees. At the request of the NBPMA, in 2009, we undertook a year long investigation into the police promotional process and compliance with Council policy F20 regarding rehiring retired employees. The evidence and the report remain confidential, I believe the interested parties were satisfied that our investigation was thourough and fair. In 2010 and 2011, 1 served on the interview panel that led to the City Manager's selection of Scott Poster as our Fire Chief. I have judged both open and closed disciplinary hearings and have been told that my rulings were accepted as fair to all parties. Finally, I have fought hard and sucessfully to maintain the independance of the CSB. This assures that due process is respected and our hearings are fair and have the appearance of fairness. I am an attorney with 26 years experience representing the County of Orange and its employees in all manner of tort and civil litigaiton. I have served as an arbitrator, and a judge pro tem hearing civil, small claims and settlement conferences. I take pride in my professional reputation as a hard worker and fair hearing officer. Bivens In addition to earning my BA with a major in Industrial Relations at the University of Arizona, I have more than 35 years of practical experience. I worked in several very structured wage, salary and job -grade organizations. I participated in and led many task forces which focused on re- organizations, evaluation design, position grading and salary structure. At Chrysler Corporation, my experience included both domestic and international assignments. Functional responsibility ranged from headquarters, field, manufacturing and sales; for 2 years I managed Chrysler's operations in Australia. One of the most urgent and important duties of the Civil Service Board is to hear and adjudicate appeals to disciplinary actions taken against city employees. This formal quasi - judicial process is a huge responsibility for each of the five Civil Service Board Members. A fair and honestjudgment must be made because the interests of an employee's career must be carefully weighed and balanced with the ability of city management to impose fair and appropriate discipline. I respectfully submit that with my business ownership background, participation in leadership positions in civic and volunteer activities, and with my long law enforcement experience, coupled with 12 years experience on the Civil Service Board during which I have participated in many difficult hearings and ruled on a number of thorny issues, I would provide valuable continuity and experience to the Board and to the City of Newport Beach. In successfully growing and operating a small business I have learned valuable management and people skills that would be both applicable and useful in my continued service as a Civil Service Board member. Prior to my retirement I served for 47 years as a Reserve L.A. County deputy sheriff, state certified and authorized to work street patrol. I served in all reserve ranks from deputy to reserve chief with responsibility for 620 reserve deputies. This experience has given me insight into the interests and concerns of civilian and safety personnel, from those of line employees to those of executive management. After working closely with City officials, citizens and other community volunteers to produce arts and cultural programs for the City, I hope to continue to represent the City on the Board of Library Trustees or Civil Service Board. I have been Chair of the Arts Commission for the past four years; prior to that I acted as Vice Chair for two years and Secretary for one year. During my tenure, the Commission achieved a number of accomplishments. We regularly experience record attendance at our programs including the Annual Juried Art Show, Concerts in the Park, Shakespeare by the Sea, Lectures and Museum Tours. The Commission also led the City's largest community- funded public art project, the "McFadden Centennial Legacy Square," to commemorate the 100 -year anniversary of the City of Newport Beach, coordinated a collaboration with Orange County Museum of Art to curate an outdoor sculpture collection for the new Civic Center and secured for the City a collection of watercolors by a longtime Newport Beach resident along with a cash bequest of $50,000. For many years I have also been fortunate to volunteer for a number of civic, philanthropic and charitable organizations. This work provides me the opportunity to collaborate with local activists and leaders as well as assist communities in need. My projects have been varied, from spearheading capital campaigns to fund the arts, to providing pro Bono legal services to non - profits, to hands on volunteer activities with local organizations. My legal experience includes a focus on general contract and real estate law while specializing in environmental law and land use planning. I look forward to employing my legal skills, commitment to community and experience as an Arts Commissioner to continue to serve the City of Newport Beach. I am a long time user of the Newport Beach Library in many capacities and anticipate bringing the some dedication to that Board as I employed on the Arts Commission to enhance the City's library programs and services.
