Badum, Public Works Director 949 - 644 -3311, sbadum @newportbeachca.gov PREPARED BY: Andy Tran, Senior Civil Engineer APPROVED: zt� C \yL _ y TITLE: Submittal of OCTA Proposition 1 B State -Local Partnership Program Funding Applications ABSTRACT: The Orange County Transportation Authority (OCTA) is currently administering a call for projects under the Proposition 1B State -Local Partnership Program (SLPP). Staff submitted three funding applications to receive the maximum available SLPP funds. As part of this program, local agencies are required to enter into a cooperative agreement and adopt a resolution affirming the City's commitment to use Measure M Turnback or Fair Share funds as the required matching funds. RECOMMENDATION: Adopt Resolution No. 2012- 37 affirming the City's commitment to use Measure M Turnback or Fair Share funds as the required matching funds. FUNDING REQUIREMENTS: The proposed Fiscal Year 12 -13 Capital Improvement Program includes $1,975,500 for the Balboa Blvd. and Channel Road Pavement Reconstruction project, excluding the Proposition 1 B SLPP fund. If OCTA approves our funding application, the maximum amount of Proposition 1B SLPP fund (approximately $692,000) will be used in lieu of the programmed funds. The City will still be expending the remaining amount of $1,283,500 of programmed funds. DISCUSSION: Approximately $21 million of California Proposition 1B SLPP funds are available to the 34 Orange County cities and Unincorporated County of Orange. Funds will be disbursed on a formula basis to each of the 35 local agencies. The City of Newport Submittal of OCTA Proposition 1 B State -Local Partnership Program Funding Applications June 12, 2012 Page 2 Beach is projected to receive $692,224 of Proposition 1B SLPP funds. Depending on the number of local agencies participating in this call for projects, additional funds may become available. OCTA is currently administering a one -time call for projects in order to disburse the funds. As part of this funding program, local agencies are required to come up with a minimum 50 percent match. Local agencies are also required to use Measure M Turnback or Fairshare funds as the source of matching funds. Proposition 1B SLPP funds can only be used for construction phase activities. In addition, proposed improvement projects must extend the useful life of the facility by at least 15 years. Staff submitted three funding applications for the following pavement improvement projects: 1. Balboa Boulevard and Channel Road PCC Pavement Reconstruction 2. Bayside Drive Pavement Rehabilitation 3. Irvine Avenue Pavement Rehabilitation Location maps for each of the three projects have been attached. In accordance with the OCTA application submittal instructions, Project No. 1 above is identified as the City's 'Priority" project. The other two projects are listed as "Back -up" projects in the event that additional funds become available. Based on preliminary construction cost estimates, all of the projected Proposition 1B SLPP funds will be exhausted with Project No. 1 alone, including the required 50% Measure M matching funds. OCTA is currently in the process of drafting the Cooperative Agreement. Once finalized, staff will recommend the approval of this Cooperative Agreement with OCTA to participate in the Proposition 1 B SLPP Call for Projects. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it 2 Submittal of OCTA Proposition 1 B State -Local Partnership Program Funding Applications June 12, 2012 Page 3 has no potential for resulting in physical change to the environment, directly or indirectly. Badum to facilitate the delivery of the project. NOW, THEREFORE, BE IT RESOLVED that the City of Newport Beach, hereby authorizes Andy Tran as the official representative of the City of Newport Beach to apply for the SLPP funding under the Proposition 1 B Highway Safety, Traffic Reduction, Air Quality, and Port Security Bond Act of 2006 for the above referenced projects. BE IT FURTHER RESOLVED, that the City of Newport Beach, agrees to fund its share of the project costs and any additional costs over the identified programmed amount.
