RECESS V. RECONVENE AT 7:00 P.M. FOR REGULAR MEETING VI. ROLL CALL VII. CLOSED SESSION REPORT VIII. PLEDGE OF ALLEGIANCE This Special Meeting of the City Council is subject to the Ralph M. Brown Act Among other things, the Brown Act requires that the Council agenda be posted and distributed to Council Members, and members of the media requesting notice, at least 24 hours in advance of each Special Meeting and that the public be allowed to comment on agenda items before the City Council and items not on the agenda but are within the subject matter jurisdiction of the City Council. The City Council may limit public comments to a reasonable amount of time, generally either three (3) or five (5) minutes per person. It is the intention of the City of Newport Beach to comply with the Americans with Disabilities Act (ADA) in all respects. If, as an attendee or a participant at this meeting, you will need special assistance beyond what is normally provided, the City of Newport Beach will attempt to accommodate you in every reasonable manner. IX. NOTICE TO THE PUBLIC The City provides a yellow sign -in card to assist in the preparation of the minutes. The completion of the card is not required in order to address the Council. Speakers must limit comments to five (5) minutes on agenda items. The Council has the discretion to extend or shorten the time limit on agenda or non - agenda items. As a courtesy, please turn cell phones off or set them in the silent mode. X. PUBLIC COMMENTS Public comments are invited on non - agenda items generally considered to be within the subject matter jurisdiction of the Council. Speakers must limit comments to three (3) minutes. Before speaking, please state your name for the record. XI. CURRENT BUSINESS RENTAL RATES FOR COMMERCIAL MARINAS OVER CITY- MANAGED TIDELANDS. a) Direct that the fair market rent charged to commercial marina uses be the greater of $1.45 /square foot of tidelands rented (on an annual basis) or 20% of gross revenue from slip rentals; and b) direct that the fair market rental increases be phased -in through 2015, as outlined in the staff report. XII. ADJOURNMENT NOTICE OF SPECIAL MEETING NOTICE IS HEREBY GIVEN that a Special Meeting of the City Council of the City of Newport Beach has been scheduled for Wednesday, September 12, 2012, at 6:30 p.m. to conduct a Closed Session and 7:00 p.m. for the purpose of discussing Rental Rates for Commercial Marinas over City- Managed Tidelands.
