ABSTRACT:
In order for the City of Newport Beach to receive
Emergency Management Performance Grant (EMPG),

There is no fiscal impact related to this item.
DISCUSSION:
The City's Emergency Management Program is currently managed by the Fire
Department and includes several key components, such as education, training, funding,
response, and multi- agency coordination. The City is served by the Orange County
Sherriff's Department Emergency Management Bureau, which is the lead agency of the
Orange County Operational Area (OA). The OA is the County -wide advisory body
responsible for preparing for, responding to, and mitigating local emergencies. A
primary function of this group is the coordination of the State and Federal grants.
The EMPG program provides grants to states to assist state, local, tribal and territorial
governments in preparing for all hazards, as authorized by the Robert T. Stafford

Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et sec.). Title VI of the
Stafford Act authorizes FEMA to make grants for the purpose of providing a system of
emergency preparedness for the protection of life and property in the United States from
hazards and to vest responsibility for emergency preparedness jointly in the federal
government and the states and their political subdivisions. The purpose of EMPG is to
sustain and improve comprehensive emergency management programs at the state,
tribal, territorial governments and local levels from all man -made and natural disasters
through the prevention, mitigation, response and recovery for all hazard events.
The City has received EMPG since 1998 and previously used the funding to purchase
equipment for the Emergency Operations Center (EOC), to conduct Citywide EOC
emergency exercises, and training city staff on the National Incident Management
System (NIMS), as well as the Disaster Service Worker program.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE CITY
MANAGER AND THE FIRE CHIEF TO ACT AS THE
CITY'S "AUTHORIZED AGENTS" TO SIGN AND
EXECUTE DOCUMENTS FOR THE PURPOSE OF
PARTICIPATING IN THE EMERGENCY MANAGEMENT
PERFORMANCE GRANT PROGRAM.
WHEREAS, the Federal Emergency Management Agency, in partnership with
the California Emergency Management Agency, administers the Emergency
Management Performance Grant Program nationally as state and local emergency
preparedness assistance; and
WHEREAS, the City of Newport Beach is eligible to apply for Emergency
Management Performance Grant funds; and
WHEREAS, the procedures established by the Federal Emergency Management
Agency and the California Emergency Management Agency require the applicant to
certify by resolution the designation of the individuals authorized to sign and execute the
Emergency Management Performance Grant Program.
NOW THEREFORE, BE IT RESOLVED that the City Council authorize the City
Manager and the Fire Chief to act as the "Authorized Agents" to execute on behalf of
the City any actions necessary to obtain federal financial assistance provided by the
Federal Emergency Management Agency and sub - granted through the State of
California.
