AYES: Ameri, Brown, Hillgren, Kramer, Myers, Toerge, Tucker NOES: None ABSENT: None ABSTAIN: None Public Hearing Items: ITEM NO. 2 Lugonia Setback Determination (PA2012 -119) Site Location: 431 Lugonia Street SUMMARY: Associate Planner Fern Nueno gave a presentation summarizing the application and discussion ensued regarding the applicants' modified request to allow a 3 -foot rear and side yard setback, where 10 -foot rear and 4 -foot side yard setbacks are required. The Planning Commission voted unanimously to approve the project with the change to allow a 3 -foot side and rear yard setback (7 ayes). AYES: Ameri, Brown, Hillgren, Kramer, Myers, Toerge, Tucker NOES: None ABSENT: None ABSTAIN: None Planning Commission Agenda Report for November 8, 2012 November 13, 2012 Page 2 ITEM NO. 3 Chizhik Variance (PA2012 -113) Site Location: 20361 SW Cypress Street SUMMARY: Assistant Planner Kay Sims gave a presentation summarizing the applicants' requests to allow fencing, hedges, and lattice to exceed the maximum height allowed per the Zoning Code. The Planning Commission approved the project as recommended (5 ayes, 2 noes). AYES: Ameri, Brown, Kramer, Toerge, Tucker NOES: Hillgren, Myers ABSENT: None ABSTAIN: None ITEM NO. 4 Emerson Island Annexation (PA2012 -034) SUMMARY: Associate Planner Fern Nueno gave a presentation summarizing the City's request to establish the General Plan land use designations and pre -zone the approximate 2- acre area referred to as Emerson Island located within the City's Sphere of Influence. The Planning Commission voted unanimously to recommend to the City Council approval of the request (7 ayes). AYES: Ameri, Brown, Hillgren, Kramer, Myers, Toerge, Tucker NOES: None ABSENT: None ABSTAIN: None ITEM NO. 5 Woody's Wharf Use Permit (PA2011 -055) Site Location: 2318 Newport Boulevard SUMMARY: Senior Planner Jay Garcia gave a presentation summarizing the applicants' requests to modify the operations of the existing restaurant. The Planning Commission voted to (4 ayes, 3 noes): Approve a. Extending the opening hour from b. Extend the hours of the outdoo r p.m. on Friday and Saturday only; c. The use of valet service on entertainment was offered; and d. Waiver of six parking spaces 11:00 a.m. to 10:00 a.m.; dining area from 11:00 p.m. to 12:00 an as needed basis and when live 2. Deny a. Patron dancing b. The removal of tables and chairs within the outdoor dining area; and c.
