Brown, City Clerk APPROVED: 0, TITLE: APPOINTMENTS BY THE MAYOR TO THE COUNCIL /CITIZENS AD HOC COMMITTEES, THE JOINT GOVERNMENTAL COMMITTEES, AND THE CITIZENS ADVISORY COMMITTEES ABSTRACT: Pursuant to Council Policy A -9, the Mayor on an annual basis appoints individuals, subject to City Council confirmation, to serve on the various Council /Citizens Committees, the Joint Governmental Committees, and the Citizens Advisory Committees. DISCUSSION: Due to a recent interpretation by the Fair Political Practices Commission ( "FPPC "), any Council Member nominated to a committee that has a stipend of $250 or more a year should not participate in the appointment process. The City has joined with other cities in Orange County to seek clarification /revision of this FPPC interpretation. In the meantime, staff recommends Council Members voluntarily comply with the FPPC interpretation. There are six committees, listed below, that could provide a stipend of $250 a year or more. Therefore, it is recommended that any Council Member nominated to one of the six committees listed below should recuse themselves from the appointment and confirmation process. Association of Orange County Cities ➢ Orange County Council of Governments ( "OCCOG ") ➢ Orange County Sanitation District ( "OCSD ") ➢ Orange County Vector Control District Board of Trustees ➢ San Joaquin Hills Transportation Corridor Joint powers Agency Board of Directors Southern California Association of Governments ( "SCAG ") APPOINTMENTS BY THE MAYOR TO THE COUNCIL /CITIZENS AD HOC COMMITTEES, THE JOINT GOVERNMENTAL COMMITTEES, AND THE CITIZENS ADVISORY COMMITTEES January 10, 2012 Page 2 To comply with the FPPC interpretation, staff recommends a bifurcated approach to the appointment and confirmation process: (1) the entire City Council may consider the confirmation of all appointments to the non -paid committees; and (2) the City Council may individually consider each appointment for a paid committee position, allowing nominated Council Members the opportunity to recuse themselves from participating in the confirmation process. This entire confirmation process will entail a total of seven separate votes. FUNDING REQUIREMENTS: There is no fiscal impact related to this item ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
