HomeMy WebLinkAbout(1987, 01/12) - A-9 - AmendedA -9 CITY COUNCIL COMMITTEES City Council Ad Hoc and Standing Committees: Unless otherwise provided for in the resolution creating the particular committee, all City Council ad hoc and standing committees will consist of one or two members of the Council to make committee meeting scheduling less cumbersome and to permit the Mayor, or in the absence of the Mayor, the Mayor Pro Tem to participate in committee deliberations as ex- officio members with full voting rights. The Mayor will appoint members to Council ad hoc and standing committees and will appoint the chairman of these committees. City Council standing committees will be reviewed by the full Council and implemented by repealing the prevailing enabling resolution and adopting a new enabling resolution incorporating work tasks and any special procedural requirements that should govern the committee's conduct of its affairs. All City Council ad hoc committees will expire in accordance with a "sunset clause," a date certain when the committee's work is reasonably anticipated to be completed. Upon that date, unless terminated sooner by act of the City Council, the committee will automatically cease to exist and can be deleted from the City Council committee roster unless its life is extended by formal action of the City Council. Citizens Advisory Committee: All citizens advisory committees will be appointed by the Council upon the recommendation by each Council Member and will serve at the pleasure of the recommending Council Member, with the exception of those ad hoc citizen advisory committees, whose membership is appointed by the Mayor. All members shall be residents of the City of Newport Beach. All citizens advisory committees' memberships'shall consist of fourteen citizens; two nominations to be made by each individual Council Member, with the following exceptions: (1) Those citizens advisory committees whose membership differs, pursuant to the resolution creating the particular committee; those ad hoc citizens advisory committees whose membership is appointed by the Mayor; (3) members of the Technical Oil Advisory Committee shall be nominated by the City Council Appointments Committee and appointed by the City Council; and (4) those citizens advisory committees, or ad hoc citizens advisory committees whose membership is expanded as a result of the addition of Council liaison members. Appointments will be made on an annual basis from January 1 to December 31 (or any portion thereof) and may be renewed at the pleasure of the Council upon recommendation by each Council Member. A -9 CITY COUNCIL COMMITTEES - Page 2 All citizens advisory committees will expire in accordance with a "sunset clause," which will specifically set the expiration date at the time the committee is constituted. Upon that date, unless terminated sooner by act of the City Council, the committee will automatically cease to exist and can be deleted from the City Council committees roster, unless its life is extended by formal action of the City Council. The Ralph M. Brown Act applies to all commissions and boards created by charter, and possibly to certain advisory committees created by formal action of the City Council. All meetings of these boards and commissions, and those advisory committees subject to the Brown Act, must be held within the City of Newport Beach, open to the public, and otherwise conducted in conformance with this policy and the Brown Act. These boards, commissions and committees shall comply with the following rules for noticing and conducting meetings: 1. An agenda containing a brief description of each item of business to be transacted or discussed must be posted at a location freely accessible to the public at least 72 hours before each regular meeting; 2. All meetings shall be open and public, and all persons shall be permitted to attend; 3. All meetings shall be held in the City of Newport Beach at a location accessible to the general public. The time for holding regular meetings shall be established by appropriate action of the board, commission or committee and, if at any time a regular meeting falls on a holiday, the regular meeting shall be held on the next business day; 4. No action may be taken on an off - agenda item unless; a) Majority of those present determine that an emergency situation exists; or b) Two- thirds of the members, or all of the members if less than two - thirds are present, determine that the need to take action on the item arose subsequent to the posting of the agenda; or c) The item was included in a properly posted agenda for prior meeting occurring not more than five days prior to the meeting at which the action is taken and the matter was continued to the meeting at which action is taken. r A -9 CITY COUNCIL COMMITTEES - Page 3 It is inevitable that subjects will be discussed, either during the course of consideration of agenda items or during public comments, on which no action can be taken because the circumstances outlined in (a) through (c) above do not exist. In such event, the Presiding Officer shall have the power to refer the matter to staff, or to place the item on the agenda of a future meeting, or both. 5. Every agenda for a regular meeting must provide an opportunity for members of the general public to speak on an item of interest to the public within the subject matter jurisdiction of the board, commission or committee provided, however, the agenda need not provide an opportunity for members of the public to address the board, commission or committee on any item that has already been considered by a committee, composed exclusively of members of the board, committee or commission at a public meeting wherein all interested members of the public were afforded the opportunity to address the committee on the item, unless the item has been substantially changed since the item was heard. 6. Charter created boards and commissions, and any advisory commission or committee subject to the Brown Act may adopt rules for the noticing and conduct of meetings so long as those rules are not inconsistent with provisions of the Brown Act or this policy. Committee Reports: During the study session at the first regular meeting of the month, all City Council standing committees and liaisons to citizens advisory committees will report to the City Council and will be agenda item one; City Council ad hoc and representatives to joint governmental committees will be agenda item two. These reports may be verbal or written and will cover the status of the committee's work, timing and any difficulties which should be brought to the attention of the full Council. Annual Review: In October of each year, the City Council and City Manager shall review the Boards, Commissions and Committees Manual for any needed additions, changes or deletions deemed appropriate at the time. Nothing in this policy shall prevent any individual member of the Council, the City Manager or City Attorney from bringing to the Council's attention any suggestions for Manual revisions at other times during the year.
