HomeMy WebLinkAbout(1990, 10/22) - I-1 - AdoptedI -1 IN LIEU FEE ZONES Chapter 19 of the Municipal Code provides for park dedication and /or the payment of fees in lieu of land dedication. This chapter provides that the money collected under these regulations shall be used for the purpose of developing new, or rehabilitating existing park or recreational facilities reasonably related to serving the subdivision which provides the fees in lieu of land dedication. There shall hereby be created one zone in the City for the placement of funds collected to date and those collected in the future. The use of these funds must be consistent with Chapter 19 of the City's Municipal Code. A finding is hereby made that in general the City's size is small enough in permit residents from all regions of the City to use each of the parks or recreational facilities within the City. However, when money is spent from the in lieu fund the City Council shall make a specific finding that the item for which the expense is made is reasonably related to the subdivision donating the in lieu fee. If this finding cannot be made, the City shall not use this fund for the proposed activity. It is the intent of the City Council that to the extent feasible and possible, the funds should be used for park land acquisitions in deficient areas of the City. Adopted - October 22, 1990
