POLICY TO COORDINATE FUTURE DEVELOPMENT
WITH TRANSPORTATION FACILITIES
The City Council f the City of Newport Beach finds that overdevelopment
of real property to ated in the City of Newport Beach has created an uncon-
trolled demand on th City's street system, which is harmful to the public's
health, safety and gen ral welfare. Pending a revision to the City's
General Plan, which wil be aimed at preventing further overcrowding and
traffic congestion, the 'ty Council wishes to adopt this policy as a
guideline for the City St f, City Council, Planning Commission and
persons wishing to develop Ivroperty in the City of Newport Beach prior to
said revisions in the Genera Plan.
Section 1.
No building or grading permit sha be issued for a commercial or industrial
project having a gross floor area ual to or more than 10,000 square feet,
or any residential project which isIPqual to or more than ten dwelling
units, unless the Planning Commission nd /or City Council make the following
findings:
a. That traffic during any 2.5 ho peak traffic period
on each "major," "primary- modifi d" or "primary"
street which will have an unsatis actory level of
traffic service prior to, or as a suit of, the
project will be increased less than \

generated from the project.
b. If by a vote of 4 /5ths of the entire ommission
and /or City Council that the benefitoject to
the City of Newport Beach outweigh ts
anticipated negative impact, the pro approv ed,
notwithstanding the requirements of above.
Section 2.
Unsatisfactory level of traffic service" for the purposes of t is policy
means peak period traffic service which is worse than "Level of ervice D"
for more than one hour, determined according to standard traffic gineer-
ing practices. "Level of Service D" is that level of traffic se .i a set
forth in the Highway Capacity Manual (1965), or any subsequent editi
thereof; provided, however, that such level of service does not excee the
following criteria:
i) intersection capacity utilization of 0.90;
ii) 1,450 vehicles per hour using Critical Movement
Summation Method; or
iii) volume- capacity ratio of 0.90.

Section 3.
The City Traffic Engineer, subject to review by the Planning Commission,
shall be responsible to conduct the necessary studies and to evaluate the
project pursuant to the \regulations of this policy. The Traffic Engineer,
subject to review by the\Planning Commission, shall exercise responsible
discretion in determining traffic periods on "major," "primary- modified"
or "primary" streets, intersections which will be significantly affected
by the proposed project, vo2,ume- capacity ratio studies and other criteria
essential for the administration of this policy. If ambiguity exists in
the administration of this policy, the Planning Commission and /or City
Council is to be consulted to provide the proper interpretation.
