Brown, City Clerk PHONE: 949-644-3005 TITLE: Appointment of a New Finance Committee Member to Fill an Unscheduled Vacancy ABSTRACT: Due to the resignation of Bill McCullough from the Finance Committee, the City Council is being asked to confirm Council Member Scott Peotter's appointment to fill the unscheduled vacancy, pursuant to Resolution No. 2015-5. RECOMMENDATION: Confirm Council Member Scott Peotter's appointment of Jim Mosher to fill the unexpired balance of Bill McCullough's term on the Finance Committee. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: On January 13, 2015, the City Council adopted Resolution No. 2015-5 which, among other changes, amended the membership of the Finance Committee as follows: • The Finance Committee consists of seven members. • Three Council Members are appointed by the Mayor, subject to approval by the full City Council. The terms of the Council Members would be indefinite, pending specific City Council action to replace them. • Four "Citizen Advisors" would be recommended by the four Council Members not on the Finance Committee, and these four Citizen Advisors would be subject to approval by the full City Council. Each Citizen Advisor term would last one-year, but reappointments could be made annually. Appointment to the Finance Committee October 13, 2015 Page 2 • The Citizen Advisors would have equal voting status. • The Mayor appoints the Finance Committee chair, subject to confirmation of the full City Council. On September 23, 2015, the City Clerk received Finance Committee Member Bill McCullough's resignation from his seat on the Finance Committee. His term was scheduled to expire on January 27, 2016. Pursuant to City Council Policy A-2 (Board, Commission and Committee Appointments), Council Member Peotter's appointee will serve Mr. McCullough's unexpired term. Pursuant to the Maddy Act and City Council Policy A-2, the City Clerk prepared and posted a Special Notice of Unscheduled Vacancy on Thursday, September 24, 2015, in the City Clerk's Office, at the Central Library, on the bulletin board in the City Council Chambers, and on the City's webpage, and published the Special Notice in the Daily Pilot on Saturday, September 26, 2015. As provided in the Special Notice, applications were accepted by the City Clerk's Office until 12:00 p.m. on Thursday, October 1, 2015. Mr. Mosher's application is attached hereto as Attachment A. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
