LEGAL FRAMEWORK. The strategies, actions and decisions of the City Council and community groups concerned about airport impacts must consider and respect the complex statutory and decisional law related to aircraft operations and airport regulations. The failure of the City Council or community groups to accurately inform Newport Beach residents about the legal framework could lead to unreasonable expectations and ill-advised decisions and/or strategies. Cit Council PolmiCV A-17 options Downside • Disperse more Opposite of NextGen • New Path(s) New communities • STREL Path Balboa Island • Higher Altitude Santa Ana Heights • More turns More noise? FAA? options • The flight paths need to be fanned over the broadest range possible, with no immediate airplane or jet repeat of one path. • City's 2008 ARTS study: "In general, an action that simply redistributes noise from one impact area to another will not be approved. " • The takeoff trajectory and elevation needs to be at the highest point possible. • The thrust of the engines needs to gear down to the lowest range possible. • An Environmental Impact Study and Report needs to be registered and completed semi-annually in an effort to manage the health and safety of all affected residents. Community Petition • Continue to work closely with the County. • Ensure Magvar issue is fixed. • Stay at the table with FAA • Re: NextGen, advocate for: • TOING should be restored • STREL = a fly-over waypoint • 180-day test period • Avoid actions that will impact new communities. • Per the 2008 ARTS Study (pg VI-2), consider review of departure procedure AC91-53A (distant v close-in procedures) "to ensure that (it) represent(s) the optimum procedure. . ." • No changes to Policy A-17 Staff Recommendations ' ". . .consider alternative departure patterns over more unoccupied open water or use of a fan or varied pattern to reduce 4_ direct impact on residents.' l fr - •7 '.r BIIA Letter to FAA, Oct 8, 2015 z L 11 rT N r - R 'r x 0 3 1 1'V r$7'OR7 PIER s Provided by Lee Pearl, Balboa Island Improvement Association Santa Ana _ I -f luff I • Jr- ` f Y1 q. boo`
