The proposal would amend the setback requirement from 20 feet to five feet, which is consistent with the historic front yard setback for these properties. Staff believes the 5 -foot setback was inadvertently left off the Setback Map in the 2010 Zoning Code update. Section 20.66.020 of the Municipal Code requires City Council action to initiate City - sponsored amendments. RECOMMENDATION: Initiate an amendment to Zoning Code Setback Map. No S-213 that specifies five feet as the required front yard setback for 3008, 3010, and 3012 Balboa Boulevard. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The standard front yard setback for residential properties zoned Two -Unit Residential (R-2) is 20 feet, unless a different distance is depicted on a setback map or applicable specific plan. In the pre -2010 Zoning Code, 3008, 3010, and 3012 Balboa Boulevard (Properties) were within Specific Plan SP -6 (R-2) Zone which identified the front yard setback as five feet. When the City adopted the 2010 Zoning Code, Specific Plan SP -6 was dissolved and the five-foot front yard setback was maintained and called out on the 13-1 Code Amendment Initiation for Properties Located at 3008, 3010 and 3012 Balboa Boulevard (PA2015-196) January 12, 2015 Page 2 appropriate setback map (Attachment A Setback Map S-213). However, the five-foot setback was not applied to the Properties. The intent of dissolving these SP -6 (R-2) properties into the R-2 Zone did not include changing the setbacks. This can be seen on all of the other similar lots that were previously zoned SP -6 (R-2) that have the five-foot front yard setback called out on the S-213 Setback Map (shown in exhibit below) and on the S -2C Setback Map. This discrepancy was brought to staff's attention by a property owner that intends to construct a new duplex. Staff believes an amendment to the setback map is appropriate to correct the inequity. The 15 -foot difference between a five-foot and 20 -foot setback not only affects building placement, but also impacts buildable area and ultimately the maximum size of a home on the property. Initiation of the process does not have any binding effect on future decisions and the amendment may ultimately change based upon additional staff analysis, public outreach, or direction from the Planning Commission and City Council. 13-2 Code Amendment Initiation for Properties Located at 3008, 3010 and 3012 Balboa Boulevard (PA2015-196) January 12, 2015 Page 3 ENVIRONMENTAL REVIEW: The City Council's initiation of a zoning amendment is exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15262 (Feasibility and Planning Studies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. No final action on the amendment will be taken and the initiation of the amendment does not have any legally binding effect upon future consideration of the amendment itself. Environmental review will be conducted prior to the consideration and potential approval of the amendment. NOTICING: A courtesy notice was mailed to the subject properties as well as properties within a 300 -foot radius. Also, the agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
