HomeMy WebLinkAbout10 - Marina Park Project – Marina Docks (Bid Package 4) – NOC of Contract No. 3897 (15P14)10-1 NEWPORT BEACH City Council Staff Report COUNCIL STAFF REPORT CITY OF February 9, 2016 Agenda Item No. 10 ABSTRACT: On February 10, 2015, City Council awarded Contract No. 3897-D, Marina Park Project – “Marina Docks” to Bellingham Marina Industries, Inc. (BMI) for a total contract cost of $2,937,661.00 plus a 10 percent contingency allowance. The required work is now complete and staff requests City Council acceptance and contract close out. RECOMMENDATIONS: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project; b) Authorize the City Clerk to release the Labor and Materials Bond sixty-five (65) days after the Notice of Completion has been recorded in accordance with applicable portions of the Civil Code; and c) Release the Faithful Performance Bond one (1) year after acceptance by the City Council. FUNDING REQUIREMENTS: The current adopted budget includes sufficient funding for this request. It will be expensed to the Tidelands Capital Fund account in the Public Works Department, 10101-980000-15P14. Unused project funds will be returned to the Tidelands Capital Fund account. A summary of the construction contract cost is as follows: Original Bid Amount:$2,937,661.00 Actual Cost of Bid Items Constructed:$2,937,661.00 Total Change Orders:-$10,809.00 Final Contract Cost:$2,926,852.00 The 10-acre Marina Park project is located on the bay side of the Balboa Peninsula between 15th Street and 19th Street. This long awaited project includes construction of a new 23-slip visitor marina and sailing program basin, 10,500-square-foot community center, 11,000-square-foot sailing center, nautical-themed children’s playground and picnic area, two half-court basketball surfaces, a fitness circuit, a restaurant operated privately under lease, reconstruction of the 19th Street public restroom facility, frontage beach improvements, and 177 on-site parking spaces. Due to the complex and prominently different types of construction operations needed to build this new facility, the Marina Park project was divided into four (4) general construction plan sets and bid packages. The first two (2) construction bid packages, 1) demolishing and removal of the prior mobile home park; and 2) dredging and construction of the new marina basin, as well as the deep foundation work for the new buildings, are complete. The third construction bid package, which includes multiple new buildings, surface parking lots, park amenities, and landscaping is substantially complete, pending final close-out items. The fourth and final construction package, which staff is now requesting City Council accept and close-out, is for the constructed marina docks and associated amenities. The final construction contract cost for the Marina Docks was approximately 0.37 percent below the original bid amount. One (1) additive and two (2) deductive change orders were issued for a net credit of $10,809.00. A summary of the project schedule is as follows: The project was substantially complete as of November 30, 2015 with all marina docks and appurtenances ready for public use. All training and close-out items are now complete, and therefore, a Notice of Completion action is recommended. ENVIRONMENTAL REVIEW: All significant environmental effects for the Marina Park project have been adequately addressed in the previously certified Environmental Impact Report No. (SCH No. 2008051096) (EIR). Said EIR also included mitigation, monitoring & reporting program, and statement of overriding considerations, and the City of Newport Beach intends to use said document for this approval. Copies of the previously prepared environmental document are available for public review and inspection on the City of Newport Beach website at www.newportbeachca.gov/ceqadocuments. NOTICING: This agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
