ABSTRACT:
Staff has received construction bids for the Tidegate Improvement Project and is
requesting City Council approval to award the construction contract to Paulus
Engineering, Inc. of Anaheim, California.
RECOMMENDATION:
a) Approve the project plans and specifications;
b) Award Contract No. 6270 to Paulus Engineering, Inc. (Paulus) for the total base bid
amount of $168,710.00, and authorize the Mayor and City Clerk to execute the
associated construction contract; and
c) Include in the project construction contract encumbrance an additional contract
contingency allocation of $17,290.00, (approximately 11 percent of the total bid) to
cover unforeseen conditions, extra work and/or material quantities.
FUNDING REQUIREMENTS:
The current adopted budget includes sufficient funding for the award of this contract.

DISCUSSION:
The City operates and maintains a large number of drainage tidegates in various
conditions throughout the City. Some have surpassed their service life, requiring
additional maintenance or parts that are no longer manufactured. This Tidegate
Improvement Project will address three critical locations (two on Balboa Island and one
near Channel Place Park, Attachment A) through replacement of existing valves.
At 2:00 p.m. on February 23, 2016, the City Clerk opened and read the following bids
for this project:

The low bid amount is 13.9 percent below the Engineer’s Estimate of $196,000. The low
bidder, Paulus, possesses a California state contractor’s license classification “A” as
required by the project specifications. The contractor is registered with the California
Department of Industrial Relations as required by California law to work and bid on

public contracts. A check of the contractor’s references indicates satisfactory completion
of similar projects for the City and other public agencies.
The work necessary for the completion of this contract consists of mobilization,
providing traffic control; removing and disposing of the existing tidegates, vault lid,
motor, and controls; and furnishing and installing new tidegates, actuators, controls and
vault lids; and connecting to existing electrical facilities.
Pursuant to the Contract Specifications, the Contractor will have 125 consecutive
working days to complete the work. Up to 100 consecutive working days shall be
granted for shop drawing preparation, review and approval, tide valve manufacturing
and delivery.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this project exempt from the California
Environmental Quality Act (“CEQA”) pursuant to Class 2 Section 15302(c)
(Reconstruction of existing facility involving negligible or no expansion of capacity) of
the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
