(I) (we) do hereby covenant and agree with said City that the above legally described land shall only be used as a site for the construction, erection, and maintenance of a single family dwelling, This Covenant and Agreement shall run with the land, and shall be binding upon (myself) (ourselves), and future owners, encumbrances, their successors, heirs, assignees and shall continue in effect until such time that the Newport Beach Municipal Code unconditionally permits the- use of the property for another purpose. Owner agrees to execute and deliver to City any instrument that may be deemed necessary to effect ch subordination to this Covenant of any mortgage or deed of trust or other hypothecation already recorded against the Property, such that the covenants, conditions, and restrictions in this Agreement shall be binding upon and effective against any owner whose title is derived through foreclosure or trustee's sale or otherwise.
