Continued guidance from the BVAC is sought to complete the implementation of the Balboa Village Implementation Plan and provide recommendations to the City Council for the allocation of funding from the Balboa Village Area Benefit District (Parking Benefit District). RECOMMENDATION: Adopt Resolution No. 2016-50, A Resolution of the City Council of the City of Newport Beach, California, Amending the Term and Responsibilities of the Balboa Village Advisory Committee. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The BVAC has met monthly since December 2012 and has made significant progress in implementing the strategies contained within the Balboa Village Implementation Plan (Implementation Plan). However, there is more to be accomplished, and several projects are in process, as detailed in Attachment A. Clarification is also needed stating that the BVAC is the sole entity responsible for providing recommendations to the City Council regarding funding for Balboa Village projects derived from the Parking Benefit District and other sources. The amendments are in Exhibit A of the draft resolution (Attachment B) and shown in Attachment C. ENVIRONMENTAL REVIEW: This action is not subject to the California Environmental Quality Act (“CEQA”) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). Established a residential parking permit program (RP3). City approved. Waiting for Coastal Commission approval. 2. Established a commercial parking benefits district to create permanent, ongoing revenue source. 3. Removed time limits for all metered spaces; implemented demand based pricing for all public parking. 4. Established employee parking permit program. 5. Eliminated parking requirements for new commercial development and intensification of use applications. 6. Eliminated in-lieu parking fee permanently, including current payers. Economic Development 1. Allocated additional funding to Balboa Village BID. 2. Modified boundaries of Balboa Village BID to delete area from Adams to Coronado Streets. 3. Assumed maintenance of boardwalk area. 4. Developed Commercial Facade Improvement Program. 5. Developed special events initiative in support of BVMA. 6. Updated Balboa Village Design Guidelines. 7. Pursue adoption of Local Coastal Plan (anticipated to be complete in 2016). 6-4 RESOLUTION NO. 2016-50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, AMENDING THE TERM AND RESPONSIBILITIES OF THE BALBOA VILLAGE ADVISORY COMMITTEE WHEREAS, on September 25, 2012, the City Council adopted Resolution No. 2012-85 creating the Balboa Village Advisory Committee (Committee) to oversee the timely implementation of recommendations provided in the Balboa Village Implementation Plan (Implementation Plan); WHEREAS, on July 9, 2013, the City Council adopted Resolution No. 2013-58 amending the membership of the Committee; WHEREAS, the Committee is made up of seven (7) members consisting of two (2) City Council members, one of which shall represent District 1, one (1) Balboa Village Business Merchants Association Board Member, one (1) representative of ExplorOcean, one (1) representative of the Balboa Peninsula Point Homeowners Association, one (1) representative of the Central Newport Beach Community Association, and one (1) at large member; WHEREAS, the Committee has overseen the successful implementation of several of the recommendations of the Implementation Plan; however, continued guidance from the Committee and public involvement is needed to complete this effort; WHEREAS, in 2014, the City Council established the Balboa Village Area Benefit District (also referred to as the “Parking Benefit District”), which receives revenue from parking fees for the purposes of enhancing or supplementing services in Balboa Village ; and WHEREAS, the Committee’s responsibilities include providing recommendations to the City Council regarding allocation of funding from the Parking Benefit District, but a governing board is also referenced with the same responsibility. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: SECTION 1. Extend the term of the Committee to December 31, 2018, and confirm that the Committee is the sole entity responsible for providing recommendations to the City Council regarding funding for Balboa Village projects derived from the Parking Benefit District and other sources. SECTION 2. The City Council approves the revised description of the Committee, which is attached as Exhibit A, and incorporated herein by reference. ATTACHMENT B 6-5 SECTION 3. The City Council hereby repeals Resolution No. 2012-85 and Resolution No. 2013-58. SECTION 4. The recitals provided above are true and correct and incorporated into the operative part of this resolution. SECTION 5. The City Council finds the adoption of this resolution and the amendment of the Committee is not subject to the California Environmental Quality Act (“CEQA”) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. SECTION 6. If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION 7. This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the reso lution. Provide recommendations to the City Council regarding: 1) the adoption of specific programs or projects consistent with the Implementation Plan; and 2) allocation of funding for Balboa Village projects derived from a proposed Parking Benefit District and other sources. C. Provide recommendations to the City Council regarding the addition, modification, or elimination of revitalization strategies. D.
