Brown, City Clerk TITLE: Appointment by Mayor of Ad Hoc Appointments Committee to Review Applications and Make Recommendations to the Full Council for the Board and Commission Vacancies ABSTRACT: The annual vacancies on City Boards and Commissions will occur on June 28, 2016. Additionally, an unscheduled vacancy on the Board of Library Trustees will occur on June 30, 2016. The process to fill the vacancies shall be followed in accordance to City Council Policy A-2 (Board, Commission and Committee Appointments) and consistent with the Maddy Act. RECOMMENDATIONS: a) Confirm Mayor Diane Dixon's appointment of Mayor Diane Dixon, Mayor Pro Tem Kevin Muldoon, and Council Member Tony Petros to serve on the Ad Hoc Appointments Committee to review applications and make recommendations to the full City Council for the Board and Commission vacancies; and b) Direct the City Clerk to post and publish a Vacancy Notice requesting that applications be submitted by noon on Wednesday, May 11, 2016; schedule confirmation of nominees to be made on June 14, 2016; and make appointments on June 28, 2016. FUNDING REQUIREMENTS: , There is no fiscal impact related to this item. DISCUSSION: On June 30, 2016, the following vacancies will occur on City Boards and Commissions: Board of Library Trustees (two seats) - Seats held by Robyn Grant (eligible for reappointment) and John Prichard (resigned from the Board effective June 30, 2016). 12-1 Appointment by Mayor of Ad Hoc Appointments Committee to Review Applications and Make Recommendations to the Full Council for the Board and Commission Vacancies April 26, 2016 Page 2 Building and Fire Board of Appeals (two seats) — Seats held by Khosrow Nourmohammadi (eligible for reappointment) and James Pirdy (eligible for reappointment). City Arts Commission (two seats) - Seats held by Rita Goldberg (not eligible for reappointment) and Robert Smith (not eligible for reappointment). Civil Service Board [Fire and Police nominees] (two seats) - Seats held by Debra Allen (not eligible for reappointment) and James (Mickey) Dunlap (not eligible for reappointment). Harbor Commission (one seat) - Seat held by Paul Blank (eligible for reappointment). Parks, Beaches and Recreation Commission (one seat) - Seat held by Kathy Hamilton (not eligible for reappointment). Planning Commission (two seats) - Seats held by Tim Brown (eligible for reappointment) and Erik Weigand (eligible for reappointment). Consistent with City Council Policy A-2, vacancies will be advertised on Saturday, April 30, 2016, and applications will be accepted until noon on Wednesday, May 11, 2016. Following the interview process, if any, the nominations will be scheduled for confirmation by the full City Council on Tuesday, June 14, 2016, and final appointments will be made on Tuesday, June 28, 2016. All new terms will be effective on July 1, 2016, with an expiration date of June 30, 2020, except for the unscheduled vacancy on the Board of Library Trustees (JohnPrichard's seat) which will expire on June 30, 20179, and will be eligible to reapply for their respective seats to serve for a full four- year term. City Council Policy A-2 also establishes the procedures for making appointments to the various Boards and Commissions. Pursuant to City Council Policy A-2, the Ad Hoc Committee's duties are as follows: A. Review all the applications for positions to the City Boards and Commissions; B. Conduct any necessary interviews with individual applicants; and C. At least two (2) weeks prior to the date of appointment, recommend to the full City Council at a regular public meeting, two (2) or more candidates for each Board or Commission vacancy. Members of the City Council may wish to interview the recommended candidates further prior to final selection by the City Council. By requiring two (2) or more candidates for each vacancy, it is the intent of the City 12-2 Appointment by Mayor of Ad Hoc Appointments Committee to Review Applications and Make Recommendations to the Full Council for the Board and Commission Vacancies April 26, 2016 Page 3 Council that at least two (2) separate individuals should be considered for each vacancy (i.e., if there are two (2) vacancies, at least four (4) separate individuals will be considered). Pursuant to Charter Section 710 (Civil Service Board), two members of the Civil Service Board shall be appointed by the City Council from a list of five persons to be nominated by vote of the employees in the Classified Service (Fire Department and Police Department). The names and applications of the five nominees shalt be presented to the City Council at the June 14, 2016 City Council meeting. The Ad Hoc Appointments Committee will dissolve on December 31, 2016. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(0)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A — Notice of Vacancies 12-3 ATTACHMENT A NOTICE OF VACANCIES The City of Newport Beach is currently accepting applications to fill the following vacancies (most are four-year terms expiring June 30, 2020): • Board of Library Trustees (two seats - one seat is for a four-year term expiring June 30, 2020, and one seat is for a term that expires on June 30, 20197) • Building and Fire Board of Appeals (two seats - both are four-year terms expiring June 30, 2020) • City Arts Commission (two seats - both are four-year terms expiring June 30, 2020) • Civil Service Board (two seats - both are four-year terms expiring June 30, 2020) • Harbor Commission (one seat - four-year term expiring June 30, 2020) • Parks, Beaches & Recreation Commission (one seat - four-year term expiring June 30, 2020) • Planning Commission (two seats — both are for four-year terms expiring June 30, 2020) All seats will become vacant when the existing terms expire on June 30, 2016. All applicants must be qualified electors of the City, none of whom shall hold any paid office or employment in City government (Section 702 of the City Charter). The deadline for filing applications is noon on Wednesday, May 11, 2016.
