TITLE: Supplemental Report for Call for Review of Planning Commission
approval of Newport Dunes Resort Conditional Use Permit located
at 1131 Back Bay Drive (PA2015-084)
The applicant is requesting a modification to Condition No. 7 (see Staff Report
Attachment A, Exhibit A):
7. Advance Notice of Level 1 Special Events. The applicant shall notify the
Community Development Department of all Level 1 special events authorized by
Condition No. 4 of this permit a minimum of twenty-one (21) days prior to the
special event. Traffic control measures, as determined by the City Traffic
Engineer, shall be implemented to address concurrent special events, if deemed
necessary by the Public Works Director.
This condition requires a twenty-one (21) day advance notice of Level 1 special events.
This condition was added by the Planning Commission in order to address concerns
about concurrent smaller events creating traffic congestion problems. The applicant is
requesting modifying the condition to require six (6) days advance notice, which is the
same as the minimum time prior to an event required for an application for a Level 1
special event permit.
Staff analyzed past Newport Dunes Resort special event permit applications and found
that there have been instances where multiple events were conducted concurrently.
However, the average estimated attendance for these concurrent events was 188
persons and the typical amount of time these events overlapped was about two (2)
hours. Therefore, it is unlikely that multiple Level 1 events conducted concurrently would
result in situations where a traffic control plan would be required.

The revised condition would read as follows:
7. Advance Notice of Level 1 Special Events. The applicant shall notify the
Community Development Department of all Level 1 special events authorized by
Condition No. 4 of this permit a minimum oftwenty-ene Q-1� six 6 days prior to
the special event. Traffic control measures, as determined by the City Traffic
Engineer, shall be implemented to address concurrent special events, if deemed
necessary by the Public Works Director.
