RECOMMENDATION: a) Find the issuance of the permit exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15301 of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3; b) Receive and review the report; c) Find no further investigation is necessary pursuant to NBMC 14.28.050 Issuance - Conditions; and d) Authorize the City Manager to execute the permit. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The City of Newport Beach received an application for renewal from J&J Marine Acquisition, LLC to obtain an industrial waste permit. Per NBMC 14.28, Industrial Wastes, any person/company disposing of industrial waste into the public sewer system must receive a permit from the City of Newport Beach. Following the receipt of the application, Staff investigated all conditions including capacity of the city's infrastructure, character of the waste to be discharged, and acceptance of the waste by the treatment facility owned and operated by the Orange County Sanitation District (OCSD). The applicant provided a valid Industrial Waste 13-1 Grant Industrial Waste Permit to J&J Marine Acquisition Company, LLC June 14, 2016 Page 2 Permit acquired by OCSD as part of the application process. Staff concludes that the applicant meets all conditions of the acceptance of industrial waste into the City's system as well as meeting all the conditions of NBMC 14.28, Industrial Wastes. Therefore Staff recommends that Council grant the industrial waste permit as the following conditions have been met: • There is available capacity in the sewer system that is not necessary for transportation of domestic sewerage of the City. • The waste will not result in damage to pipe lines and other disposal facilities. • The amount and character of the waste proposed to be discharged by the applicant can be transported and treated in a manner that complies with all applicable state laws, regulations, and Orange County Sanitation District requirements. • The Orange County Sanitation District has issued a permit to the applicant to accept the industrial waste. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15301 of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. The Class 1 exemption includes the operation and permitting of existing public and private facilities where there is negligible or no expansion of use. The proposed project involves permitting industrial waste into the City's existing sewer system, which has been designed to accommodate and transport such materials. The sewer system has been determined to have adequate capacity and the waste meets all applicable regulations by the Orange County Sanitation District pursuant to Industrial Wastewater Discharge Permit No. 1-551152. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). F O, RNP CITY OF NEWPORT BEACH INDUSTRIAL WASTE PERMIT In accordance with all terms and conditions of the City of Newport Beach's Municipal Code 14.28 Industrial Wastes and also with any applicable provisions of federal and state law or regulations, the below named permit holder, is hereby authorized to industrial wastes into the public sewer system or any municipal industrial waste pipe line of the City, subject to permit holder's compliance with the Industrial Waste Permit conditions. CNB may amend this permit to include revisions during the term of the permit. J&J Marine Acquisition Company, LLC 151 Shipyard Way, Ste 7, Newport Beach CA 92663 INDUSTRIAL WASTE PERMIT NO. 2016-0601 Effective Date June 14, 2016 Expiration Date: June 14, 2018 Dave Kiff City Manager By obtaining this permit the applicant agrees to the conditions and terms in the City of Newport Beach Municipal Code Chapter 14.28 Industrial Wastes. In the event that that the terms of the industrial waste permit are violated, the permit holder shall be required to pay to the City of Newport beach for damaged caused by and the cost of any cleaning of any portion of the public sewerage system and/or industrial waste pipe lines. The City manager also has the power to temporarily shut off any premises from the use of the public sewerage system where the user or occupant of the premises is placing waste substance in violation to 14.28. See 14.28.080 (Payment of Costs for Sewer Damage), 14.28.090 (Temporary Shut -Off by City Manager), 14.28.100 (Penalty for Violations) for all details. 13-6
