Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov David Keely, Senior Civil Engineer, dkeely@newportbeachca.gov 949-644-3349 Request to Install Three Sidewalk Cafes along East Coast Highway within the Newly Constructed Corona del Mar Entry Area Sidewalk The owners (Owners) of three restaurants (Rothschild's, The Bungalow, and Avila's EI Ranchito) along East Coast Highway from Begonia Avenue and Carnation Avenue are requesting to install sidewalk cafes in the newly constructed Corona del Mar (CdM) Entry sidewalk area within the East Coast Highway public right-of-way. RECOMMENDATION: a) Find this action is categorically exempt from the State California Environmental Quality Act (CEQA) Guidelines pursuant to Section 15303 — Class 3 (New Construction or Conversion of Small Structures) on the basis that the improvements associated with the outdoor dining area are considered accessory to the main structure; b) Waive a portion of City Council Policy L-21, Sidewalk Cafe Standards and Procedures, to allow six-foot and seven -foot -wide minimum pedestrian clear widths in potentially heavy pedestrian traffic areas and to allow permanent barriers with a maximum height of 42 inches; and c) Direct owners to apply for an Annual Outside Dining Encroachment Permit and pay all applicable fees. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. 19-1 Request to Install Sidewalk Cafe along East Coast Highway within the Newly Constructed Corona del Mar Entry Area June 14, 2016 Page 2 DISCUSSION: The owners of Rothschild's Restaurant, The Bungalow and Avila's EI Ranchito have requested to install sidewalk cafes in the newly constructed CdM Entry sidewalk area within the East Coast Highway public right-of-way. New hardscape, trees and landscaping within the CdM Entry project area have recently been installed. Project plans for the section of East Coast Highway from Begonia Avenue and Carnation Avenue are included in Attachment A. The CdM Entry project has created some large open pedestrian areas along the southerly side of East Coast Highway between and including Begonia Avenue and Carnation Avenue. Three existing adjacent restaurant owners have met with Community Development and Public Works staff to review the proposed sidewalk Cafe areas. In order to allow outdoor dining, all three restaurants were required to amend their existing Use Permits. These three Use Permit Amendments to allow for outdoor dining were reviewed and approved by the Planning Commission on June 9, 2016. Rothschild's Restaurant (2407 East Coast Highway) and The Bungalow (2441 East Coast Highway) propose to provide a 7 -foot minimum clear continuous pedestrian path adjacent to their outdoor dining area. The design of both of these sidewalk cafe areas propose to follow the arc of the seat wall at the edge of the pedestrian area. City Council Policy states that "areas with heavy pedestrian traffic may be required to maintain a minimum of 8 feet clear width on the sidewalk." These two restaurants also propose a permanent decorative wrought iron barrier with a maximum height of 42 inches along the perimeter of their sidewalk cafe area. These barriers are proposed to be bolted in place. The City Council Policy requires that the "barriers shall be designed to be sectional in nature and easily removed by no more than two people." All other design standards of the City Council Policy will be satisfied. The proposed description, layout and photos of the Rothschild's Restaurant and Bungalow sidewalk cafes are provided in Attachments B and C, respectively. Avila's EI Ranchito (2515 East Coast Highway) proposes to provide a 6 -foot minimum clear continuous pedestrian path. The 6 -foot clear area will be provided in areas adjacent to Southern California Edison vents, cabinets and street light poles. All other areas will have a minimum 8 -foot clear pedestrian path. The existing bike rack in front of Avila's EI Ranchito along East Coast Highway will be relocated to the Carnation Avenue frontage. The relocation of the bike rack will be at the restaurant owner's expense. The restaurant also proposes a permanent decorative wrought iron barrier with a maximum height of 42 inches along the perimeter of the sidewalk cafe area. The barrier is proposed to be bolted in place. As indicated above, City Council Policy may require a minimum 8 -foot clear pedestrian path in high pedestrian areas and the barriers shall be removable by no more than two people. All other design standards of the City Council Policy will be satisfied. The proposed description, layout and photos of the Avila's EI Ranchito sidewalk cafe are provided in Attachment D. Staff recommends the approval of the requests as we feel after review and consideration of this particular segment of sidewalk, the proposed improvements provide adequate pedestrian clearance and do not diminish future rights of the public. City Council Policy L-21, Sidewalk Cafe Standards and Procedures, is provided as Attachment E. As indicated under the General Provisions, the Public Works Director 19-2 Request to Install Sidewalk Cafe along East Coast Highway within the Newly Constructed Corona del Mar Entry Area June 14, 2016 Page 3 may revoke the encroachment permit at any time if it is determined that continued operation of the sidewalk cafe is detrimental to the public interest or the Permittee is in violation of the conditions of the permit. This recommendation is made under the condition that Owners agree to apply for an Annual Outside Dining Encroachment Permit, comply with all other design standards and pay all applicable fees. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is categorically exempt under Section 15303, of the State CEQA (California Environmental Quality Act) Guidelines — Class 3 (New Construction or Conversion of Small Structures) on the basis that the improvements associated with the outdoor dining area are considered accessory to the main structure. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). The area would accommodate an estimate of a mixture of two top table and four top tables or 20 additional diners. The patio would be enclosed by a decorative black rod iron fence (42" high) similar to the one that is currently being used by the Golden Spoon Restaurant and also to match the rod iron that is used for the handrail that is being used for the stairs on the right side of the building.
