Per California Department of Water Resources requirements, water suppliers must release the plan to the public for review, and then hold a public hearing to collect comments. RECOMMENDATION: a) Determine that this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly; b) Conduct a public hearing; and c) Direct staff to include any comments and return item to June 28th Council meeting for adoption. FUNDING REQUIREMENTS: There are no funding requirements associated with this action. 24-1 Public Hearing for 2015 Urban Water Management Plan June 14, 2016 Page 2 DISCUSSION: Every urban water supplier providing water for municipal purposes to more than 3,000 customers, or supplying more than 3,000 acre-feet (AF) of water annually, is required to prepare, adopt, and file an Urban Water Management Plan (UWMP) with the California Department of Water Resources (DWR) every five (5) years in the years ending in zero and five. The purpose of the UWMP is to update the existing and planned water supplies, maintain efficient use of urban water supplies, continue to promote water conservation, ensure sufficient water supplies are available, and provide a mechanism for response during drought conditions. The Department of Water Resources (DWR) reviews the submitted plans to assure compliance requirements identified in the Urban Water Management Planning Act (Division 6 Part 2.6 of the Water Code § 10610 - 10656). The 2015 UWMP is required to be updated and submitted to the DWR by July 1, 2016. The City of Newport Beach, along with 23 other local agencies, are participating in a cooperative agreement with the Municipal Water District of Orange County (MWDOC) to update/develop UWMPs for each agency. Due to the similarity of regional information required for the plan, along with shared requirements mandated from each water source entity, this joint effort minimizes consultant costs through economies of scale. In August 2015, the consulting firm Arcadis was selected from a competitive RFP process to collect data and prepare draft plans. The resulting UWMPs are tailored to provide individual agency information and meet all elements required by the California Water Code. The 2015 UWMP updates the 2010 UWMP in compliance with the requirements of the Act as amended in 2009 and in 2014, and includes a discussion of: • Water Service Area and Facilities • Water Sources and Supplies • Water Use by Customer Type • Distribution System Water Losses • Demand Management Measures • Water Supply Reliability • Planned Water Supply Projects and Programs • Water Shortage Contingency Plan • Recycled Water Use 24-2 Public Hearing for 2015 Urban Water Management Plan June 14, 2016 Page 3 SBx7-7, or the Water Conservation Act of 2009, is part of the Delta Action Plan that stemmed from the Governor's goal to achieve a twenty percent (20%) statewide reduction in urban per capita water use by 2020 ('20 by 2020"). Reduction in water use is an important part of the plan that aims to sustainably manage the Bay/Delta and reduce conflicts between environmental conservation and water supply. The 2009 Act requires the City to include in its 2015 UWMP the following information from its target - setting process: • Baseline Daily Per Capita Water Use • 2020 Urban Water Use Target • 2015 Interim Water Use Target Compliance • Compliance Method Being Used Along with Calculation Method and Support Data • An Implementation Plan to Meet the Targets The most recent amendment to the UWMP set forth by SB 1420 is Distribution System Water Losses. The City must quantify distribution system losses for the most recent 12 - month period available. The water loss quantification is based on the water system balance methodology developed by the American Water Works Association (AWWA). In this plan, the 2015 water loss audit conducted on the City's water system is included. In addition to the information provided in the plan the appendices provides information such as: • Orange County Water District's 2015 Update to their Groundwater Management Plan • Water Use Efficiency Implementation Report • UWMP Checklist • Supply Reliability Methodology We encourage the City Council, our customers and residents to review the draft plan and to make comments at the public hearing. There is a lot of information included and staff is always willing to answer any questions about the Plan.
