Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Peter Tauscher, Civil Engineer, ptauscher@newportbeachca.gov PHONE: 949-644-3316 TITLE: Newport Theater Arts Center Building Improvements - Award of Contract No. 7022-2 (151`02) ABSTRACT: Staff received construction bids for the Newport Theater Arts Center Building Improvements project and requests City Council's approval to award the contract to Optima RPM, Inc. RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; b) Approve the project drawings and specifications; c) Award Contract No. 7022-2 to Optima RPM, Inc. for the total bid price of $188,851.00, and authorize the Mayor and City Clerk to execute the contract; and d) Establish a contingency of $29,000.00 (approximately 15 percent) to cover the cost of unforeseen work not included in the original contract. FUNDING REQUIREMENTS: The current adopted budget includes sufficient funding for this project. Various DISCUSSION: Purpose Construction Contract $ Construction Contingency $ Printing & Incidentals $ Total: $ Amount 188,851.00 29,000.00 2,000.00 219,851.00 At 10:00 a.m. on June 2, 2016, the City Clerk opened and read the following electronic bids for this project: BIDDER TOTAL BID AMOUNT Low Optima RPM, Inc. $ 188,851.00 2 State Link Construction, Inc. $ 324,650.00 The low bid amount is ten percent below the engineer's estimate of $210,000.00. The low bidder, Optima RPM, Inc., possesses a California State Contractors License Classification "B" as required by the project specifications. A check of the contractor's references indicates satisfactory completion of similar projects for the City of Newport Beach and other public agencies. As part of the Facilities Maintenance Master Plan (FMMP), City facilities were recently inspected and scheduled for necessary capital maintenance. Upon inspection of the Newport Theater Arts Center, it was discovered that the existing exterior roof beams atop the building fronting Cliff Drive are damaged by insect infestation. A structural engineering firm was hired by staff to investigate the damage severity and develop an action plan. Upon engineering analysis, it was determined that since the beams act as primary support members for the Newport Theater Arts Center roof, it was prudent to have these beams repaired or replaced. The cost of repairing the damage is nearly the same cost to replace the beams due to lack of access from the building interior and the need to support the existing roof during the work. Staff determined that it is more cost effective over the long term to replace the beams with new units. Furthermore, the existing roof membrane and asphalt roofing material covering the Newport Theater Arts Center was installed more than 20 years ago and is approaching the end of its service life. Several areas showed signs of leaking this past winter. Upon completion of the structural roof beam replacement work, the contractor will then replace the entire existing roof with a similar roof system. Work necessary to complete this contract consists of distributing construction notices to nearby businesses and residents; removing and disposing of existing roofing and structural beams; making repairs to existing structural supports; installing new wood beams, asphalt fiberglass composite roof and TPO flat roof system; providing required building accessibility improvements; and completing other incidental items in place as required by the contract documents. 12-2 Newport theater Arts Center Building Improvements - Award of Contract No. 7022-2 June 28, 2016 Page 3 Pursuant to the contract specifications, the Contractor will have 35 consecutive working days to complete the work and the work is planned for this summer. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Upon City Council's approval of this determination, staff will file the necessary Category Exemption Notice for the project. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
