Webb, Public Works Director — 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Antony Brine, City Traffic Engineer tbrine(o-)_newportbeachca.gov PHONE: 949-644-3329 TITLE: Newport Heights Stop Signs ABSTRACT: Staff is recommending that STOP signs be installed in Newport Heights on the cul-de- sac streets of Gary Place, Powell Place, Aldean Place, and Michael Place at their intersections with 15th Street. RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution 2016-101, A Resolution of the City Council of the City of Newport Beach, California, to Post Stop Control on Gary Place, Powell Place, Aldean Place and Michael Place at their Intersections with 15th Street. FUNDING REQUIREMENTS: The current adopted budget includes sufficient funding for these installations. It will be expensed to the Traffic Signage, Striping and Marking account in the Public Works Department, 01201927-980000-17T03. DISCUSSION: The Newport Heights community has requested the City to review and implement measures that could enhance roadway safety conditions and provide for better interaction between vehicles, bicyclists and pedestrians. The initial focus will be on 15th 6-1 Newport Heights Stop Signs August 9, 2016 Page 2 Street and other streets in Newport Heights and Cliff Haven may be reviewed at a later date. Staff is recommending the installation of STOP signs on the cul-de-sac streets of Gary Place, Powell Place, Aldean Place and Michael Place at their intersections with 15th Street. The California Vehicle Code establishes the right-of-way rule at intersections having no regulatory traffic control signs (such as STOP signs). It requires the driver of the vehicle approaching the intersection yield the right-of-way to any vehicle or pedestrian already in the intersection. Installation of the STOP signs at these intersections will reinforce this legal requirement. Implementation is planned for the coming weeks. Additionally, it is noted that Donald Place is a private road which also intersects with 15th Street. Staff is working separately with the residents of Donald Place in an effort to receive permission to install the STOP control devices on this private roadway. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378). NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENTS: Attachment A - Location Map Attachment B - Resolution 6-2 Attachment A ® Proposed STOP sign Location Map N CITY OF NEWPORT BEACH PUBLIC WORKS DEPARTMENT 08/09/16 w 6-3 ATTACHMENT B RESOLUTION NO. 2016- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, TO POST STOP CONTROL ON GARY PLACE, POWELL PLACE, ALDEAN PLACE AND MICHAEL PLACE AT THEIR INTERSECTIONS WITH 15TH STREET WHEREAS, Section 12.36.010 of the Newport Beach Municipal Code provides that whenever any ordinance or resolution of this City designates and describes any intersection at which vehicles are required to stop at one or more entrances thereto, the City Traffic Engineer shall erect and maintain STOP signs at those entrances at each intersection where a stop is required; and WHEREAS, it has been determined that there is a need to stop traffic on Gary Place, Powell Place, Aldean Place and Michael Place at their intersections with 15th Street; NOW THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: That all vehicles are required to STOP on Gary Place, Powell Place, Aldean Place and Michael Place at their intersections with 15th Street; BE IT FURTHER RESOLVED that the City Traffic Engineer is hereby directed to erect and maintain all necessary signs at the above locations. The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution. ADOPTED this 9th day of August, 2016.
