The site is currently utilized for outdoor storage of vehicle inventory associated with Fletcher Jones Motorcars, which was previously approved for a limited duration. DISCUSSION: Pursuant to Chapter 20.62 of the Newport Beach Municipal Code (NBMC), all items requiring a public hearing are required to be mailed, posted and ,published in a newspaper of general circulation. Notice of this item was mailed and posted at each project site; however, a notice was not published in a newspaper. Therefore, this item must be continued to the City Council Meeting of October 11, 2011, to be properly noticed and comply with the provisions of the NBMC. RECOMMENDATION: Continue the item to the City Council Meeting of October 11, 2011. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). The key vote was 4 to 3, and there were issues regarding the interpretation of the old zoning code relating to percentage of remodel, the cost of remodel in comparison to cost of new construction, and the issue of prolonging the life of a non- conforming structure that may benefit from Council review in light of improved guidance on these issues in the new zoning code.
