TITLE: APPOINTMENTS TO THE AVIATION COMMITTEE ABSTRACT: At the February 14, 2012 City Council meeting, the City Clerk was directed to handle the Aviation Committee positions as unscheduled vacancies and advertise and accept applications from interested citizens, pursuant to Council Policy A -2 - Boards and Commission, and Resolution No. 2011 -31. RECOMMENDATION: a) Confirm Council Member Leslie Daigle's appointment of Tom Meng as the District 4 representative to the Aviation Committee. b) Extend the deadline to 4:00 p.m. on Thursday, March 22, 2012. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: At the Regular Meeting of February 14, 2012, the City Council directed the City Clerk to advertise the vacancies on the Aviation Committee pursuant to Council Policy A -2. Resolution No. 2011 -31 which established the membership of the Aviation Committee states, in part, that the Aviation Committee shall consist of seven members, one from each City Council district, nominated by the District Council Member and confirmed by Appointments to the Aviation Committee March 13, 2012 Page 2 the City Council; and seven alternates, one from each City Council district, nominated by the District Council Member and confirmed by the City Council. The Notice of Vacancies was posted in the City Clerk's Office on February 15, 2012, and advertised in the Daily Pilot on Saturday, February 18, 2012. The deadline to submit an application was Wednesday, February 29, 2012. At the conclusion of the application period, the City Clerk's Office received one application from District 4; however, no applications from Districts 1 or 3. It is the desire of Council Members Mike Henn, Rush Hill, and Leslie Daigle to extend the deadline to receive applications from their Districts in order to fill the following positions: District 1 Representative District 1 Alternate Member District 3 Alternate Member District 4 Alternate Member ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. I am currently the Vice President of the Eastbluff Homeowners Community Association (Eastbluff). Eastbluff has 450 homes situated on the east side of the back bay. As the airlines takeoff flight path has moved further to the east our community members have become very concerned about the increasing noise and pollution. I believe that by serving on the City's Aviation Committee, I can: Provide the Eastbluff community with current/correct information about what is going on at the John Wayne Airport and the respective flightpath. Keep the City informed as to Eastbluff reactions to the proposed and actual changes the airport is making as it relates to the airport take off procedures. Workwith the Aviation Committee, Airport/FAA,.and the Citytofind workable solutions for the community as a reaction or recommendation to the airport take off procedures. Brown, City Clerk APPROVED: A TITLE: UNSCHEDULED VACANCIES ON THE AVIATION COMMITTEE ABSTRACT: Due to recent resignations on the Aviation Committee and members not residing in their appointed districts, the City Council may appoint new members pursuant to City Council Policy A -2 and Resolution No. 2011 -31. RECOMMENDATION: a) Declare the following seats vacant: Dan Gilliland - District 1 seat; Henry Arjad - District 1 alternative; Sue Hogan - District 3 alternate; Bonnie O'Neil - District 4 seat; and Ron Darling - District 4 alternate. b) Direct the City Clerk to post and publish a Special Vacancy Notice requesting that applications be submitted by 4 :00 p.m. on Wednesday, February 29, 2012, and schedule confirmation of nominees to be made on March 13, 2012. DISCUSSION: Dan Gilliland (District 1 seat), Henry Arjad (District 1 alternate), Sue Hogan (District 3 alternate), and Ron Darling (District 4 alternate) have resigned from the Aviation Committee in order to allow other residents an opportunity to serve on the Aviation Committee. Bonnie O'Neil does not reside in District 4 and is no longer eligible for appointment as a representative of District 4. Unscheduled Vacancies on the Aviation Committee February 14, 2012 Page 2 Resolution No. 2011 -31 which established the membership of the Aviation Committee states, in part, that the Aviation Committee shall consist of seven members, one from each City Council district, nominated by the District Council Member and confirmed by the City Council; and seven alternates, one from each City Council district, nominated by the District Council Member and confirmed by the City Council. Pursuant to Council Policy A -2, the City Clerk will prepare a Special Vacancy Notice for posting and publication of the unscheduled vacancies. As per the notice, applications will be accepted by the City Clerk's Office until 4:00 p.m. on Wednesday, February 29, 2012. At the close of the application period, the current applications on file and any new applications will be forwarded to Council Member Mike Henn (District 1 Council Member), Council Member Rush Hill (Distri 3 Council Member), and Council Member end Leslie Daigle (District 4 Council Member) r t eir review and nomination. Council Member Henn, Hill, and Daigle's nominees are scheduled to come before the City Council for confirmation on Tuesday, March 13, 2012.
