Peninsula Point Alley Replacement G In the list of bids received (near the beginning of the Discussion on page 2) bid Number 7 for $1,293,293 from EBS General Engineering Inc appears to be substantially lower than the bid accepted. Is this a misprint for $2,293,293? Or was there some other reason for rejecting it? o Since the description of the work to be performed is so sketchy, it would be helpful if the Discussion mentioned the Request for Proposal (RFP) which the bids are in response to or included a copy of the draft contract indicating the scope of services to be performed. G At the March 8, 2012 meeting of the Coastal /Bay Water Quality Citizens Advisory Committee; the committee and the public heard a presentation from Fuscoe Engineering describing the environmental advantages of adding permeable features to the concrete drainage culverts that typically run down the middles of alleys. Mayor Gardner and Council Member Henn both questioned why such features are not being incorporated into the City's many routine renovation projects. Were such features part of this RFP? If not, could they be added? Would doing so qualify for water quality related grants? Item 5. Streetlight Improvement Project As with the previous item, it would be helpful if the Discussion referenced the RFP and /or the draft contract so the public would be better informed about the scope of services being contracted for. Does this upgrading of the existing lighting and circuitry involve adding new above ground utility boxes to underground areas? If so, could such boxes be undergrounded? If not, why not? Item 7. Bulkhead and Seawall Repairs As best I can understand the Discussion, to take advantage of the favorable contracting environment staff is recommending adding 25% to the bid amount to pay for additional work which will be requested but which was not mentioned in the RFP. Has the contractor agreed to this? Is the additional work included in the "scope of services "? If not, it seems poor policy to expect work to be performed that is not mentioned in the contract. Item 8. Planning Commission Agenda Report for March 8, 2012 C Regarding the Study Session on the Newport Banning Ranch DEIR, it might be noted that due to the late arrival of one of the Planning Commissioners, and the Commission's wish to allow time for public comment before the end of the meeting, there was no opportunity for the commissioners to ask questions of the presenters. Also, despite what March 13, 2012 Council Meeting comments by Jim Mosher Page 2 of 2 is reported here, and a notice that appeared in the Daily Pilot on March 10"', I do not recall any announcement at this Study Session to the effect that a public hearing on the project would be held before the Commission at its March 22, 2012 regular meeting. Item 9. General Plan Annual Status Report The staff report mentions that the Status Report was reviewed by the Planning Commission on February 23, 2012, but fails to mention that at that meeting two members of the public questioned the claim on page 4 (handwritten page 8) under General Plan Implementation Task 8 that "The exploration of the acquisition of Banning Ranch (as permanent open space) is continual." The two members of the public suggested the City had done nothing to "support active pursuit' of this goal in calendar year 2011. Although staff was unable to provide any examples of pursuit or support of the activities called for in LU 6.3.2, the statement that there was "continual" activity during 2011 remains unaltered. Item 10. Water and Wastewater Multi- Hazard Mitigation Plan Update C The heading "A. No Fiscal Impact' under "Funding Requirements" on the first page of the staff report suggests there may be additional funding requirements ( "B," etc.) that may have been inadvertently omitted. Item 11. Appointments to the Aviation Committee G It might be useful to extend the deadline for applications to a date after the next meeting of the Aviation Committee (March 26) so that the search for applicants could be announced there. Item 14. Newport Beach Country Club — Golf Realty Fund Government Code Section 65869 (repeated in CNB Municipal Code 15.45.090), says that until a city obtains certification of its local coastal program, development agreements are not applicable to land in the Coastal Zone unless approved by formal action of the California Coastal Commission. Who will be taking the lead to see that this Development Agreement (and that with the Newport Beach Country Club, Inc. applicant) will be reviewed and approved by the Coastal Commission, and who will be paying the costs? Item 16. Balboa and Corona del Mar Fire Rings The staff report does not make clear that of the 19 people who spoke against fire rings at the February 7, 2012 Parks, Beaches and Recreation Commission meeting, all appeared to be from Corona del Mar. I do not recalling anyone speaking about or objecting to the fire rings near the Balboa Pier. Planning Commission Agenda Report for March 8, 2012 C Regarding the Study Session on the Newport Banning Ranch DEIR, it might be noted that due to the late arrival of one of the Planning Commissioners, and the Commission's wish to allow time for public comment before the end of the meeting, there was no opportunity for the commissioners to ask questions of the presenters. Also, despite what March 13, 2012 Council Meeting comments by Jim Mosher Page 2 of 2 is reported here, and a notice that appeared in the Daily Pilot on March 10`h, I do not recall any announcement at this Study Session to the effect that a public hearing on the project would be held before the Commission at its March 22, 2012 regular meeting. Item 9. General Plan Annual Status Report C The staff report mentions that the Status Report was reviewed by the Planning Commission on February 23, 2012, but fails to mention that at that meeting two members of the public questioned the claim on page 4 (handwritten page 8) under General Plan Implementation Task 8 that "The exploration of the acquisition of Banning Ranch [as permanent open space] is continual." The two members of the public suggested the City had done nothing to "support active pursuit" of this goal in calendar year 2011. Although staff was unable to provide any examples of pursuit or support of the activities called for in LU 6.3.2, the statement that there was "continual" activity during 2011 remains unaltered. Item 10. Water and Wastewater Multi- Hazard Mitigation Plan Update o The heading "A. No Fiscal Impact"' under "Funding Requirements" on the first page of the staff report suggests there may be additional funding requirements ( "B," etc.) that may have been inadvertently omitted. Appointments to the Aviation Committee It might be useful to extend the deadline for applications to a date after the next meeting of the Aviation Committee (March 26) so that the search for applicants could be announced there. Newport Beach Country Club — Golf Realty Fund Government Code Section 65869 (repeated in CNB Municipal Code 15.45.090), says that until a city obtains certification of its local coastal program, development agreements are not applicable to land in the Coastal Zone unless approved by formal action of the California Coastal Commission. Who will be taking the lead to see that this Development Agreement (and that with the Newport Beach Country Club, Inc. applicant) will be reviewed and approved by the Coastal Commission, and who will be paying the costs? Balboa and Corona del Mar Fire Rings The staff report does not make clear that of the 19 people who spoke against fire rings at the February 7, 2012 Parks, Beaches and Recreation Commission meeting, all appeared to be from Corona del Mar.
