SUBJECT: COUNCIL POLICY MANUAL REVIEW
Background:
Over the past several years a number of the marina facilities in
the harbor have begun to arrange rafting in their marinas to
accomodate events such as boat shows and yacht club regattas.
This additional berthing is usually over and above the numbers for
which the marina was originally designed. The City Fire
Department has been concerned that some of these requests pose
safety problems, particularly in the fire fighting area. The Fire
Department feels that in appropriate situations these deviations
from the designed use can be granted, if they are reviewed on an
individual basis and conditions are imposed for the event that
would mitigate potential problems.
To facilitate this process, the Marine Department, the Fire
Department and the Orange County Sheriff's Harbor Patrol met and
discussed methods whereby a review process could be instituted.
It was felt by those involved, and after a meeting with Bob
Burnham at the City Attorney's office, that a change in the City
Council Policy Manual under Section H could establish a method
whereby these events could be reviewed and the appropriate
conditions placed. In that regard it was suggested that under
Section H of the Council Policy Manual, under a new heading, 4.L.,
a paragraph be added that would require the Harbor Permittee, if
he proposed a use of his marina in violation of the policies or
the Municipal Code, apply for a SPECIAL EVENTS PERMIT. In the
Special Events Procces, the Marine and Fire Departments and the -
Harbor Department could review the request on a case by case basis
and impose conditions they felt to be appropriate.
Recommendation:
The Marine Department is requesting that the following paragraph
be added to the Harbor Permit Policies:

4. GENERAL PROVISIONS FOR HARBOR PERMITS
LLSpeci.al Events Permits. If a Harbor Permittee_.proposes
a use _of_the harbor_ installation, other than that allowed
by the Newport Beach Municipal Code or the Council Harbor
Permit Policies, he must first obtain ate,"Special Events
Permit" as provided _by Section 510 of the Newport Beach
Municipal Code. Upon issuance of the`Special_Events Permit_
the City of Newport Beach_mgy impose conditions on the permit
to assure that the proposed use does not affect the health,_
safety or welfare of the residents of_Newport Beach.
