City Clerk <br />ABSTRACT: <br />The City of Newport Beach Charter, Articles V and VI, establishes the powers, duties and <br />responsibilities of the City Council's three appointed positions, City Manager, City <br />Attorney, and City Clerk ("Appointees"). Their terms and conditions of employment are <br />defined by their respective. Employment Agreements. From time to time, the City Council <br />and the Appointees renegotiate the employment terms, including adjustments to <br />compensation and/or benefits. During the Closed Sessions on February 14, 2017 <br />February 28, 2017, March 14, 2017, and April 11, 2017, the City Council conducted and <br />finalized performance reviews of the City Manager, City Attorney and City Clerk and <br />considered compensation and/or benefit changes for them. <br />RECOMMENDATION: <br />a) Determine that the action is exempt from the California Environmental Quality Act <br />(CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines <br />because it will not result in a physical change to the environment, directly or indirectly; <br />b) Approve and authorize the Mayor to execute the Fifth Amended and Restated <br />Employment Agreement between the City of Newport Beach and Dave Kiff, City <br />Manager, subject to the terms and conditions approved by the City Council; <br />c) Approve and authorize the Mayor to execute the Fourth Amended and Restated <br />Employment Agreement between the City of Newport Beach and Aaron Harp, City <br />Attorney, subject to the terms and conditions approved by the City Council; <br />d) Approve and authorize the Mayor to execute the Fourth Amended and Restated <br />Employment Agreement between the City of Newport Beach and Leilani Brown, City <br />Clerk, subject to the terms and conditions approved by the City Council; and <br />16-1 <br />
