A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING EXECUTION OF AN
AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH
AND THE SHERMAN FOUNDATIONr AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE QUITCLAIM
DEEDS IN CONNECTION THEREWITH, RELATING TO THE
VACATION OF AN ALLEY AND PUBLIC UTILITY EASEMENT
IN BLOCK 632, CORONA DEL MAR TRACT
WHEREAS, at the request of the Sherman Foundation, a
Delaware corporation,the City Council of the City of Newport Beach
commenced proceedings for the vacation of an alley in Block 632,
Corona del Mar Tract, and in Block D, Tract 323, as set forth and
described in Resolution of Intention No. 7400 adopted by the City
Council on the 12th day of April, 1971; and
WHEREAS, the City Council has required as a condition
of the completion of said alley vacation proceedings that the
Sherman Foundation enter ,into an agreement with the City providing
for the acceptance of responsibility by the Foundation for the
existing sanitary sewer in the portion of the alley to be vacated,
and for the transfer of the City°s interest in said sewer by
means of a quitclaim deed which the Foundation has agreed to
accept; and
WHEREAS, said agreement also provides that the Foundation
will accept a quitclaim deed from the City conveying all rights to
the water main in the alley to be vacated; and
WHEREAS, said agreement has been presented to the City
Council for its consideration;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the Mayor and City Clerk are hereby
authorized and directed to execute the agreement between the City
of Newport Beach and the Sherman Foundation, relating to the
vacation of the alley in Block 633, Corona del Mar Tract and in

Block D, Tract 323;
BE IT FURTHER RESOLVED that the Mayor and City Clerk are
authorized to execute separate quitclaim deeds conveying the
City's interest in the sanitary sewer and the water main presently
located on a portion of the alley to be vacated.
ADOPTED this 24th day of May, 1971.
