Filson and carried, the President and Clerk was authorized to sign in the name of the City all pertinent resolutions that appear to be necessary in the furtherance of the harbor. City Hall, Newport Beach, Dec. 4, 1922. The Board of Trustees of the City of Newport Beach met in regular session at 7 :30 o'clock P. N. on above date. The meeting was called to order by President J. J. Schnitker. The roll was called as follows: Present, Trustees J. J. Schnitker, H. C. Sloan, ueo. P. Glilson, Conrad Richter, L. S. I!ilkinson. Absent, Trustees None. The minutes of the previous meeting were read and approved. The reports of the heads of the departments were read and on motion of Trustee L. S. Wilkinson seconded by Trustee H. C. Sloan and carried, the reports were accepted and filed. The communications were read and referred to the proper order of business. PASSED TO i'Y.. 3USI15ESS . This being the day and hour set for opening bids for the sale of the I,:unicipal Gas Distributing System, the Board in open session opened, examined and declared all sealed bids received for same, which were Southern Counties Gas Co. - - - - - - - - - -44,000.00 The bid was discussed and on motion of Trustee H. C. Sloan seconded by Trustee Geo. P. Wilson, the bid was accepted by the following vote: Ayes, Trustees J. J. Schnitker, H. C. Sloan, Geo. P. Wilson, Conrad Richter, L. S. 'lilkinson. Noes, Trustees None. Absent, Trustees None. The application of the Southern Counties Gas Co. of California for a franchise to lay, construct, maintain, use and operate pipe lines, mains and conduits, in, under and along the streets, alleys, lanes, highways and public places of and in the purpose of carrying and distributing gas City of Newport Beach, for the to be used for heat, light, power and other purposes, for a term of forty years, was presented and read, and upon motion made by Trustee H. C. Sloan, duly seconded and carried, IT IS ORDERED that the Clerk of this Board be, and he is hereby directed to cause to be published in the Newport News, a weekly newspaper published in the City of Newport Beach, California, a notice of sale of said franchise, in the manner and according to the provisions of law applying thereto. That the date for receiving bids shall be, and the same is hereby fixed at January 29, 1923 before the hour of 7:30 o'clock P. I.., and the amount of the penal bond to be given by the successfv'_ bidder is hereby fixed at the sum of ,,,500.00. M166 On motion of Trustee I'. C. Sloan seconded by Trustee Goo. P. The bid of Freeman, Smith & Camp Co. for the purchase of the bonds of 1,:unicipal Improvoment District No. 2 of the City of Newport Beach was considered, and Trustee H. C. Sloan introduced a resolution awarding the bonds to said Company, and directing the Clerk to deliver the same upon payment therefor in accordance with the bid. The roll was called and the resolution passed by the following vote: Ayes, Trustees J. J. Schnitker, H. C. Sloan, Goo. P. Wilson, Conrad Richter, L. S. Wilkinson. Noes, Trustees None. Absent, Trustees None. RESOLUTION OF APIARD. WHEREAS, Freeman, Smith & Camp Co. bid for and offered to buy from the City of Newport Beach the bonds of 1,1unicipal Improvement District Ito. 2 of the City of Newport Beach in the sum of '?60,000.00 and bid par therefor together with interest accrued at the date of delivery and ,?100.00 premium; 1,7HEREAS., the City of Newport Beach desires to sell said bonds at the price bid, which is the value thereof; RESOLVED, that the bid of Freeman, Smith & Camp Co. for sixty bonds of Municipal Improvement District No. 2 of the City of Newport Beach, each in the denomination of 51,000.00, be and is hereby accepted and said bonds sold and awarded to Freeman, Smith & Camp Co. RESOLVED, that the Clerk of the City of Newport Beach is hereby directed to cause said bonds to be printed, and when the same have been signed as provided by law, to deliver the same to Freeman, Smith & Catn Co. upon receiving the par value thereof, interest to date of their delivery, and a premium of ,5100.00 lawful money of the United States. I hereby certify the foregoing resolution was regularly introduced before the Board of Trustees of the City of Newport Beach at a regular meeting thereof held on the 4th day of December, 1922, and passed by the vote of the following named members thereof: Ayes, Trustees J. WHEREAS, on the 31st day of October, 1922, by Ordinance IIo. 217 of the City of Newport Beach, there was submitted'to the qualified voters of the City of Newport Beach the proposition of selling a public utility owned by said City, being the gas distributing system thereof, and consisting of the following: the gas pipe, and gas pipe lines now constructed, installed and used for receiving, distributing, furnishing and supplying gas to the consumers thereof in the City of Newport Beach, together with all equipment, appliances, apparatus, machinery, tools, material, and supplies owned, held and possessed by the City of Newport Beach belonging to and used with or in connection with the municipal gas distributing system thereof, including all meters for determining the quantity of gas used and consumed and also the following described real property: Located in the City of Newport Beach, County of Orange, State of California, and beginning at the northwest corner of Lot 10 of a resubdivision of Block 227, Section "A" Newport Beach, as shown upon a map thereof recorded in Book 4, page 36, T;?iscellaneous !,taps, records of Orange County, and running thence 11ortheasterly a distance of 118.4 feet to the most northerly corner of said Lot 10, thence southeast -Ply along the northeasterly line of said Lot 10 - 100 feet; thence south - westerly and parallel to the northwesterly line of said Lot 10 to a point in the southwesterly line of said Lot 10; thence northwesterly along said southwesterly line of said Lot 10 - 100 feet to the place of beginning. s., L M The use hereinafter in this Resolution of the words "i..unicipal gas distributing system" means and shall at all times be held and con- strued to mean the public utility above described, and the whole thereof. '. :'iiEREAS, st the said election the voters of tuo- thirds and more of all the voters voting thereat were voted YES and in favor of and authorized the sale of the municipal gas distributing system; 'tiMEREAS, the Board of Trustees of the City of Newport Beach proceeded to sell the municipal gas distributing system and fixed. a date on which bids for the sale thereof would be received; and the manner of filing such bids, and caused notice of such sale to be published and the same was published once a week for two weeks in the ' Pi -;PORT idEJlS, a newspaper published less than six days a week in the City of Newport Beach, and '.71HEREAS, the Southern Counties Gas Company of California, a corporation, at the time and in the manner provided by law and in said notice, filed its bid as a purchaser of the municipal gas distributing system in the sum of ; ?44,000.00, lawful money of the United States; WFER~;AS, at the date fixed for receiving bids the Board of Trustees of the City of Newport Beach opened and examined all bids received, and found that the highest and best bidder therefor was Southern Counties Gas Company of California, a corporation, and that the bid made was not inadequate or disproportionate to the value of the municipal gas distributing system, but that the same :,as the fair, just, and equitable value thereof; N07 M EREFORE, be it resolved, that the bid of Southern Counties Gas Company of California for the municipal gas distributing system be and is hereby accepted, and that the same be and is hereby ordered sold to Southern Counties Gas Company of California, a corporation. That the President of the Board of Trustees of the City of Newport Beach, and the Clerk thereof, be and are hereby authorized, directed and ordered to execute, acknowledge, and deliver for and on behalf of the City of Newport Beach, in its name, and under its corporate seal, a good and sufficient deed, conveying the municipal gas distributing system unto Southern Counties Gas Company of California, the successful bidder, upon receiving the sum of 544,000.00 cash, and the promise of Southern Counties Gas Company of California, a corporation, to continue to operate such public utility. The proceeds of the sale of the gas distributing system shall be placed in the treasury of the City of Newport Beach and shall be applied exclusively for the purposes and objects mentioned in Ordinance No. 217 calling for and giving notice of the election. I hereby certify the foregoing resolution was regularly introduced before the Board of Trustees of the City of Newport Beach at a regular meeting thereof held on the 4th day of December, 1922, and passed by the Vote of the following named members thereof: Ayes, Trustees J. Wilson seconded by Trustee Conrad Richter and carried, a warrant was ordered drawn in favor of the City Tax Collector for ;23.66 covering taxes on 2.54 acres assessed to Levi N. Wallace and belonging to the City. On motion of Trustee E. C. Sloan seconded by Trustee Geo. P. bJilson and carried, the S4OO.00 peace bond money collected by the City ' Recorder from E. Grabfelder was refunded. The matter of an audit of the City books was referred to a Committee consisting of Trustees H. C. Sloan and L. S. TTilkinson. On motion of Trustee L. S. Wilkinson seconded by Trustee Geo.P. Clilson and carried, the map of Tract No. 345 being; a subdivision of Lot 27 of Fairview Farms coming within the three mile limit, was approved. The Clerk was instructed to write the Christian Science Society of Newport Beach that vacant lots owned by churches were not exempt from taxes. The communication from the Newport Harbor E;arine Corp. for permission to build a pleasure pier for C. Fi. Price was referred to the City Lnginoer for 'report. The communication from Gus C!. Johnson for permission to cut the curb for marine railroads in front of Block 5 Section 5 Balboa Island was referred to the City Engineer for report. 68 On motion of Trustee L. S. 'ilkinson seconded by Trustee II.C. � Sloan and carried, the City Engineer was asked to furnish the necessary plans showing the outside boundaries, etc. to the City Attorney so that he can prepare the necessary proceedings for vacating the alley in Block 13 of Section B as asked for by the school Trustees. On motion of Trustee Goo. P. Wilson seconded by Trustee L.S. ': lilkinson and carried, the application of J. P. Orr for transfer of his license No. 139 to V. Florentino U Co. was granted. On motion of Trustee L. S. C ;'ilkinson seconded by Trustee Goo.?. �Jilson and carried, the application of Borland & Davis for transfer of their Dance Hall license to Fr. Rogers was granted. On motion of Trustee H. C. Sloan seconded by T ustee L. S. Wilkinson and carried, the application of Frank Suttora For a permit ' and license to operate a Fish tarket on Lot 19, Block 21, was granted. On motion of Trustee Conrad Richter seconded by Trustee L.S. Wilkinson and carried, a hearty vote of thanks was tendered Er. H. L. Sherman for the creditable display at Fullerton on Armistice Day. On motion of Trustee L. S. Wilkinson seconded by Trustee H.G. Sloan and carried, the Superintendent of Streets was instructed to put the material used in the'Armistice Day float where it will be best taken care of, whether with the Civic League or elsewhere. - On motion of Trustee Goo. P. Wilson seconded by Trustee H.C. Sloan the offer of 0. A. Haley to furnish new steel whoels for the fire truck for 1,100.00 cash difference was accepted by the following vote, Ayes, Trustees J. J. Schnitker, H. C. Sloan, Goo. P. Wilson, Conrad Richter, L. S. '.'ilkinson. Noes, Trustees None. Absent, Trustees Prone. The communication from Ueo. T. Peabody in regard to advertising the City was discussed, and on motion of Trustee L. S. Wilkinson seconded by Trustee Goo. P. Vilson and carried, an invitation was extended to the Balboa and Newport Beach Chambers of Commerce to meet r•rith this Board at 7:30 o'clock P. I'. on Thursday, December 28, 1922 to discuss the matter of consolidation of the two Chambers of Commerce. I "r, R. C. Woerz reported that he could not get the .,,•indow in the Pacific Electric Building in Los Angeles for less than ;;450.00 and perhaps a little more, and on motion of Trustee H. C. Sloan seconded by Trustee L. S. Wilkinson, I-r. Cloerz was instructed to go ahead and secure , the window if he could do so at a cost not to exceed 52500.00, by the following vote: Ayes, Trustees J. J. Schnitker, H. C. Sloan, Goo. P. Wilson, Conrad Richter, L. S. I.Vilkinson. Floes, Trustees None. Absent, Trustees none. On motion of Trustee L. S. Wilkinson seconded by Trustee Ii.C. Sloan and carried, the advertising in the Santa Ana and Huntington Beach papers is to be discontinued. On motion of Trustee L. S. Wilkinson seconded by Trustee H.C. Sloan and carried, the Advertising Committee of the Chamber of Commerce were instructed to get out 10,000 of the small panphkets the same as gotten out for the Santa Ana Realtors meeting, but with the two blank cages filled in. On motion of Yrustee L. S. '.Wilkinson seconded by Trustee H.C. Sloan and carried, demands ITo. 785 to 932 inclusive having been signed and approved by the Finance Committee, were allowed and warrants to be drawn for same. On motion of Trustee H. C.
