The reading of all ordinances and resolutions under All Ayes consideration was waived, and the City Clerk was directed to read by titles only. D. HEARINGS: 1. Mayor Heather opened the continued public hearing an Malazian City Council review of action taken by the Planning U/P 2089 commission on July 2.2, 1982, to approve USE PERMIT (88) NO. 2089, a request of GARY E. MALAZIAN, Newport Beach, to permit the construction of a four unit residential condominium development and related garage facilities in the R -3 District. The proposal also included a request to allow a portion of the development to exceed the twenty -four foot basic height on the front one -half of the lot located in the 24/28 Foot Height Limitation District, and the acceptance of an Environmental Document. Report from the Planning Department, was presented. The City Manager advised that at the.City Council meeting of September 27, 1982, this matter was con- tinued for the purpose of obtaining additional in- formation on whether the subject property is, or is not a coastal bluff. In the staff report of September 27, 1982, it was indicated that this particular site was not readily identifiable with the bluff system we normally observe bordering the ocean and bay. In addition, it was noted that the orientation of the site is in a northerly direction, as opposed to a westerly or southerly direction, which would look out onto the ocean or bay. Reference was made to a map from the U.S. Coast and Geodetic Survey, which illustrated the bluff system with an opening into a draw which now contains Begonia and Bayside Drive Parks, and is traversed by Carnation Avenue and Bayside Drive. It was also pointed out that the subject develop- ment will require approval of the Coastal Commission Colored slides were shown of the.property in ques- tion from the northerly and westerly sides of the lot, as well as other discretionary projects which have been previously approved by the City Council, such as the Rennekamp residence, the Quandt project, the Stevens residence, and the Britvich residence. Each of these projects involves a site on a coastal • bluff with 50% to 100% of the building covering a slope greater than 2:1. Volume 36 - Page 296 INDEX Malazian U/P 2089 Gary Malazian, 4827 Courtland Drive, Applicant, in response to Council inquiry, stated there are primar- ily multi - family homes in the immediate area, with the exception of two single - family houses adjacent to his property on either side. In addition, as stated in his letter of September 30, 1982 to the Mayor, JoAnn Sullivan of the Coastal Commission would not classify the subject property as a coastal bluff from a cursory look at the plans and photographs. Tully H. Seymour, 1151 Dove, Attorney representing Harvey Pease, owner of property at 314 Carnation Ave- nue, addressed the Council and stated that, in his opinion, the coastal bluff issue could go either way. However, he did contact JoAnn Sullivan of the Coastal Commission to verify her statement referred to by Mr. Malazian, wherein she denied that she had made any such statement. She stated that she did not have sufficient information, nor had she seen any plans to warrant such a decision. Mr. Seymour submitted photos taken from the view corridor looking out onto the bay from Mr. Pease's property and urged the Council to deny exception of the 28 foot height limit in order to preserve the view :From Mr. Pease's property. A large aerial photograph was displayed depicting view limits from 314 and 311 Carnation Avenue. Harry Lawrence, Engineering Geologist representing applicant, addressed the Council regarding the coasts bluff issue. He stated that the definitions of a coastal bluff as defined by the Coastal Commission are rather vague. The Coastal Commission guidelines discuss seacliffs and bluffs, and in the case of sea - cliffs, they are dealing with land forms over 10 feet in height, subject to active erosion. In the case of a coastal bluff, it's defined as an area above the seacliff which rounds out and then meets the mixed land form. He stated he would attempt with his two illustrations to show why he felt the subject slope was not a coastal bluff. He advised he has three U.S. Geological topographical maps which depict what he feels defines the subject parcel as a stream canyon. Robert Caminiti, 110 -36th Street, addressed the Council regarding height differences. Hearing no others wishing-to address the Council, the public hearing was closed. Council Member Hummel stated that he had contacted .JoAnn Sullivan of the Coastal Commission about two weeks ago and asked her if she could give him a definition of a coastal bluff. At that time she said she would look into it and get back to him. He called Ms. Sullivan again today regarding Mr. Malaz- ian's statement indicating she had stated his prop- erty was not a coastal bluff. Ms. Sullivan informed him that she never made such a statement, and that the Commission has never seen the project. In addi- tion, she stated that the City's planning staff had contacted them for a definition of a coastal bluff, but they had not yet responded. X Motion was made to approve the subject project in concept, providing it is redesigned so it does not exceed the height limit, and that no part of the development be built on a slope which is greater than 2 to i. All Ayes Mr..Curtis stated that the 2 to 1 slope issue was not a concern, inasmuch as the foundation system will be outside of any 2 to 1 slope area. Hearing no others wishing to address the Council, the public hearing was closed. Ayes x x The motion was voted on and FAILED. Noes x x Council Member Hummel stated for the record his reasons for voting no as follows: "This is in violation of our land use plans, and the general plan which has to do with the land use element's. We are violating our own rules which I feel is inappropriate, and which .we continue to do over and over again on this Council." 2. Mayor Heather opened the public hearing regarding Ord 82 -21 ORDINANCE NO. 82 -21, being, Plang /Coastl Dev AN ORDINANCE OF THE CITY OF NEWPORT (68) BEACH ESTABLISHING INTERIM COASTAL DEVELOPMENT PERMIT PROCEDURES. Report from the Planning Department,was presented which pointed out that adoption of the Interim Coastal Development Procedures will allow the City to issue certain Coastal Development Permits, which currently must receive approval from the Coastal Commission; administrative permits can be processed quicker by the City than by the Coastal Commission; regular permits can tie issued in a similar time frame; permits which are appealed will take a significantly longer period of time to process; and adoption of the interim ordinance will establish procedures for Coastal Permits which differ from typical City permit and hearing procedures. • Reference was made to adding the language, "exclud- ing dedicated rights -of -way" to Part A.3 of Section 1.030, wherein the City Attorney advised this would Volume 36 - Page 297 CITY OF NEWPORT REACH C bktiG U NCti9 IL ti MsE � ' vG 8 ' O � R S MINUTES R0I I C October 12. 1982 Volume 36 - Page 298 be permissible without reintroducing the ordinance, inasmuch as it was not a substantial change. • Hearing no one wishing to address the Council, the public hearing was closed. Council Member Strauss pointed out several of his concerns as noted on pages 4, 12 and 14 of the ordinance, indicating he felt there should be an involvement of the City Council in these areas. Report from the Building Department, was presented. • The City Manager pointed out that there would be no change in fees for building and grading permits; however, the fees for mechanical and plumbing per- mits will be increased approximately 4% and elec- trical 11 %. He stated that there had not been an increase in these rages for a number of years. Mayor Heather opened the public hearing on ORDINANCE Ord 82 -27 NO. 82 -27, being, Fire Code (41) AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING TITLE 9, CHAPTER 9.04 OF THE NEWPORT BEACH MUNICIPAL CODE BY ADOPTING THE 1979 UNIFORM FIRE CODE THERETO AND DELETING CHAPTERS 9.08, 9.16, 9.28 AND 9.40 FROM THE MUNICIPAL CODE. Report dated September 13, 1982, from the Fire Chief, was presented. With respect to confining campfires within the City ,to the rings on the beach, Council Member Hummel questioned if the ordinance would preclude braziers on the beach. The City Manager replied in the affirmative. Hearing no one wishing to address the Council, the public hearing was closed. Motion x Motion was made to adopt Ordinance No. 82 -27. All Ayes 5. Mayor Heather opened the public hearing on the Ambulance/ Application of Medix Ambulance Service for a Medix Apli Certificate of Convenience and Necessity. (22) Report from the Assistant to the City Manager, was presented, wherein it was noted that the municipal code requires that ambulance companies desiring to perform service within the City must obtain a Certificate of Convenience and Necessity. These Certificates are granted following a review by the City Council of a company's application at a public hearing. The City is currently serviced by two ambulance companies, Seal's andSchaefer's. It was pointed outthat Medix Ambulance Service only wishes to provide service from Newport Beach medical facilities when requested to do so by a nurse or physician. The former Ambulance/ • service involves the transportation of patients requiring a high level of medical support, while Medix the latter involves the transportation of patients requiring a minimal level of medical support. In accordance with the request of Medix, and based on the recommendations of the Police and Fire Departments, it was recommended that Medix Ambulance Service be granted a Certificate of Convenience and Necessity. As noted in the Fire Department recom- mendation, this Certificate would authorize advanced life support ambulance service and other services involving responses to requests made by nurses or physicians at health care facilities. With respect to rates, it was recommended that Medix be authorize to charge currently approved uniform rates for basic ambulance service. It was further recommended that the rates for wheelchair transportation and Advanced Life Support Transportation be approved pursuant to the Medix application. Phil Gazzo, Vice President of Operations, Schaefer' Ambulance Service, requested clarification of the subject application, the type of service to be pro- vided, and the rates for that service. Mr. Gazzo distributed a handout to the Council enumerating the cost comparison for Advanced Life Support Rates. He stated that there are only three ambulance services authorized by the Orange County Health Officer to provide Advanced Life Support ambulance service. Since these rates are consider- ably higher than basic ambulance rates, he felt the Council would be interested in the comparison. The City Manager stated that Medix Ambulance will comply with the City's basic rates currently being charged with one exception. Inasmuch as the City does not have a rate for Advanced Life Support and wheelchair rate, and until the entire rate structure has been reviewed by the staff, he recommended the Council accept the rate recommended by Medix in their application for this specific service. Michael S. Dimas, owner of Medix Ambulance Service, addressed the Council; discussed the rate structure for Advanced Life Support service and answered questions of the Council. Mr. Dimas stated that he will adhere to the City's basic ambulance rates, as set forth on page 2 of the staff report. Mr. Dimas stated that his rates for critical care are higher than those of Schaefer's Ambulance because there are distinct differences in the service. He stated that they are proud of the fact that their fees are higher, and that users of their service are made aware of those charges. He stated that they are the only provider in Orange County of two certified mobile critical care units. In conclu- • sion, he commented that they simply wish to allow the residents of Newport Beach to utilize their service, if they so desire. He indicated, he did not feel it was necessary • for Medix Ambulance to apply for a Certificate of Necessity, inasmuch as Medix has a business license, and has been providing the service for over one year. He urged the Council to deny the request, indicating he felt Schaefer's Ambulance Service and his company provided adequate coverage to the City. Hearing no others wishing to address the Council, the public hearing was closed. Motion x Motion was made to adopt Resolution No. 82 -135, granting Medix Ambulance Service a Certificate of Convenience and Necessity, pursuant to Newport Beach Municipal Code Section 5.14. Discussion ensued with respect to the City's present rate structure, wherein the City Attorney advised that pursuant to the Municipal Code, the City Council can at anytime amend the rate structure for ambulanc service. Mayor Heather opened the public hearing on ORDINANCE Ord 82 -28 NO. 82 -28, being, Transient Ocpncy Tx AN ORDINANCE OF THE CITY OF NEWPORT (40) BEACH TO INCREASE THE TRANSIENT • OCCUPANCY TAX RATE FROM SIX PERCENT (6 %) TO EIGHT PERCENT (8 %). Reports from the City Manager dated September 27, and October 12, 1982, were presented. Richard Luehrs, Executive Director of the Newport Harbor Area Chamber of Commerce, addressed the Council in opposition to the proposed increase. He stated that they felt it would be unfair to the hotel and convention industry, and that it is being proposed at the wrong time. He also felt it was not in line with the intent of Proposition 13, and urged the Council to vote against the ordinance. Victor Rumbellow, 29 Bodega Bay Drive, owner of Newport Channel Inn, spoke in opposition to the proposed increase in tax. He displayed exhibits depicting occupancy percentage from January 1977 to September 1982, and relative income adjusted for inflation for the same period. He stated that he feels guests will notice the 2% increase, as people are very "price- conscious" these days. He also stated that Newport Beach is not "recession proof" as has been stated by some people. Jim Dale, 1921 Tradewinds, employee at the Villa Nova Restaurant, also spoke in opposition to the proposed ordinance. He discussed the visitor in- • dustry, and stated that the current economy was too weak to support a tax increase at this time. He stated that the business- • es in Lido Village have declined anywhere from 10% to 25 %, and therefore, he did not feel it was appro- priate at this time to increase the transient occupancy tax. Peggy Ford, President of the Newport Beach Conven- tion and Visitors Bureau, also addressed the Council in opposition to the proposed increase in tax. She cited the amount of monies collected for transient occupancy tax for the last four years, noting that the amount had almost doubled during that time. She indicated that due to the economy she felt it was time to be conservative. Donald Rafferty, 920 Irvine Avenue, also spoke against the proposed ordinance. He stated that even though more than 60% of the electorate voted for the increase, it did not receive the two- thirds vote required by law at that time. Hearing no others wishing to address the Council, th public hearing was closed. Council Member Cox spoke in support of the ordinance and expressed his concerns as to why he felt it should be adopted. Mayor Pro Tem Hart indicated she felt it was prema- ture to vote on this issue at this time, and that the Council should wait until January to review it again. Motion x Motion was made to adopt Ordinance No. 82 -28. Motion x Substitute motion was made to adopt Ordinance No. 82 -28, changing the effective date to April 1, 1983. Council Member Strauss stated that he accepted the substitute motion. Council Members Hummel, Plummer and Mayor Heather discussed their reasons for not supporting the ordinance. Mayor Heather opened the public hearing on the Zoning/ proposed exemption of the "Fun Zone" District from "Fun Zone" the development standard requirements of Ordinance (94) No. 82 -13 regulating electronic video games. Under State Planning Law and the City's Code, amendments to the Zoning Code require processing through the Planning Commission. It was recommended that the Council close the public hear- ing and refer the subject to the Planning Commission by passing the proposed Resolution of Intention. Hearing no one wishing to address the Council, the public hearing was closed.
