SUBJECT: ORANGE COUNTY TRANSPORTATION AUTHORITY MASTER
FUNDING AGREEMENT
RECOMMENDATION:
Approve Master Funding Agreement known as Cooperative Agreement
No. C-95-985 between the City of Newport Beach and the Orange County
Transportation Authority and authorize the Mayor, City Manager and City
Attorney to execute the Agreement.
DISCUSSION:
On January 23, 1995, the Orange County Transportation Authority
(Authority) Board of Directors authorized the Chief Executive Officer to enter into a
Master Funding Agreement (Agreement) with each local agency. The purpose of the
Agreement is to clarify the roles and responsibilities of the Authority and each local
jurisdiction with respect to the delivery of projects funded by Measure M in the
Combined Transportation Funding Program (CTFP) and the Bicycle and Pedestrian
Facilities Program (BPF).
Each year the City receives Measure M funding from the Authority for
capital projects. The City must now enter into this Agreement in order to maintain
eligibility to receive funding, By signing the Agreement, the Authority agrees to fund all
approved projects in accordance with the CTFP and BPF procedures.
Correspondingly, the City of Newport Beach agrees to complete all phases and
activities of approved projects in a timely manner. If the City fails to implement and/or
complete an approved project, the full amount of the funding programmed for the City
project by the Authority must be returned to the Authority.
