Brown, City Clerk TITLE: Resolution No. 2020-21: Amending the Membership of the Housing Element Update Advisory Committee; and Confirming Appointments to the Housing Element Update Advisory Committee ABSTRACT: The Housing Element Update Advisory Committee was created pursuant to Resolution No. 2020-6 to serve as a forum for public participation, to guide a focused update of the Housing, Land Use and Circulation Elements of the General Plan, and to build upon the progress already established by the General Plan Update Steering Committee. RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; b) Adopt Resolution No. 2020-21, A Resolution of the City Council of the City of Newport Beach, California, Amending the Membership of the Housing Element Update Advisory Committee; and b) Confirm Mayor Will O'Neill's appointments to the Housing Element Update Advisory Committee, as follows: 1. Chairperson Larry Tucker — Legal background and highly experienced in leading public meetings 2. Jeff Bloom — Knowledge and experience in real estate financing 3. Susan DeSantis — Knowledge and experience in stakeholder outreach for the purpose of engaging individuals and/or organizations within the City in the Housing Element Update process 4. Ex Officio — Mayor Will O'Neill FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: On January 14, 2020, the City Council adopted Resolution No. 2020-6 which dissolved the General Plan Update Steering Committee and established the Housing Element Update Advisory Committee, comprised of a Chair, Vice Chair, and residents of the community with specific expertise appointed by the Mayor and confirmed by the City Council. The Housing Element Update Advisory Committee is an ad hoc committee with limited terms, is subject to the Brown Act, and will be responsible for (1) ensuring there is sufficient public outreach and stakeholder input regarding the update to the Housing, Land Use and Circulation Elements of the General Plan and any other Elements deemed necessary, (2) reviewing responses to the Request for Proposal for services to update the Housing, Land Use and Circulation, and other Elements as deemed necessary, (3) making recommendations to the City Council regarding the Housing, Land Use and Circulation, and other Elements as deemed necessary, (4) providing guidance to City staff regarding the consultant through the outreach process, (5) providing guidance to City staff and the consultant on goals and policies related to the update of the Housing, Land Use and Circulation, and other Elements as deemed necessary by the Committee or City Council, and (6) making other recommendations to the City Council regarding the update of the General Plan, as necessary. Pursuant to Resolution No. 2020-6, the City Clerk prepared and posted a Notice of Opportunity to be Appointed to the Housing Element Update Advisory Committee on Wednesday, January 15, 2020, in the City Clerk's Office, at the Central Library, on the bulletin board in the City Council Chambers, and on the City's webpage; and also had the Notice published in the Daily Pilot on Saturday, January 18, 2020. As provided in the Notice, applications were accepted until Saturday, January 25, 2020. The City Clerk's Office received 44 applications. 6-2 Resolution No. 2020-21: Amending the Membership of the Housing Element Update Advisory Committee; and Confirming Appointments to the Housing Element Update Advisory Committee February 25, 2020 Page 3 Mayor Will O'Neill appointed himself, Mayor Pro Tem Brad Avery and Council Member Joy Brenner to the ad-hoc Appointments Committee. At the conclusion of the application period, the applications were forwarded to the ad-hoc Appointments Committee for their review and scheduling of interviews, which occurred on Wednesday, February 5, 2020. Mayor O'Neill considered the recommendations of the ad-hoc Appointments Committee and is recommending that his appointments to the Housing Element Update Advisory Committee be confirmed by the City Council. Mayor O'Neill notes that the application and interview process revealed that the categories needed slight modification in that two candidates for architecture/land use are preferable, the legal category is filled by the recommended chairperson, one candidate (Kiley) did not meet specific criteria but would be a good addition based on general experience in the community, and transit is better covered by a consultant. Therefore, Resolution No. 2020-21 is attached to amend the membership of the Housing Element Update Advisory Committee to reflect the modification to the categories (Attachment A). Copies of the applications are attached hereto as Attachment B. The Housing Element Update Advisory Committee's term will sunset without further action upon completion and submittal of a certifiable Housing Element to the California Department of Housing and Community Development. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). Resolution No. 2020-21 Page 2 of 3 NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council hereby amends the membership of the Housing Element Update Advisory Committee ("Committee") as described in Attachment 1, which is attached hereto and incorporated herein by this reference. Section 2: The City Council hereby repeals all prior resolutions, or parts thereof, related to the Committee that conflict with this resolution. Section 3. If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 5: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly and the formation of a committee is not a project. 6-5 Resolution No. 2020-21 Page 3 of 3 Section 6: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution. Harp City Attorney Attachment 1: Description of the Housing Element Update Advisory Committee ATTACHMENT 1 Housing Element Update Advisory Committee AUTHORIZATION: Established by Resolution No. 2020-6 adopted on January 14, 2020. Membership composition changed by Resolution No. 2020-21 adopted on February 25, 2020. MEMBERSHIP: Ten (10) total. The Mayor, or a City Council Member designated by the Mayor, shall be an ex officio member without the right to vote. Nine (9) residents of the City of Newport Beach ("City") appointed by the Mayor and confirmed by the City Council. MEMBERSHIP TERM: The person elected as Mayor, or the City Council Member designated by the Mayor, shall be a member of the Housing Element Update Advisory Committee ("Committee"). The term of the appointed members of the Committee shall be indefinite pending City Council action, or expiration of the Committee. MEETINGS: Meetings shall be held as required by the business needs of the Committee in such locations, dates and times as allowed by the Ralph M. Brown Act. QUALIFICATIONS OF APPOINTED MEMBERS: Appointed Committee Members shall meet the following qualifications: A. One (1) member with experience in the development of affordable housing and/or senior housing; B. One (1) member with knowledge and experience in the application of the California Environmental Quality Act and other related environmental laws; C. Two (2) members with architectural and/or land use and planning knowledge and experience; D. One (1) member with knowledge and experience in stakeholder outreach for the purpose of engaging 1 6-7 individuals and/or organizations within the City in the Housing Element Update process; E. One (1) member with knowledge and experience in real estate financing; F. One (1) member with knowledge and experience with residential development; G. One (1) member with general knowledge and experience in the community; and I. One (1) chairperson highly experienced in leading public meetings. The Committee Chairperson and a Vice Chairperson shall be appointed by the Mayor. SELECTION OF APPOINTED MEMBERS: Selection of Committee Members shall be done as follows: A. The City Clerk shall prepare a notice letting members of the public know of the opportunity to serve on the Committee and the application process. The notice shall include, but not be limited to, details regarding what information is necessary to be considered for appointment, where to submit an application, and the application deadline. B. The application notice shall be published at least once in a newspaper of general circulation in the City and posted in the City's normal posting location for agendas, as well as the Newport Beach Public Library located at 1000 Avocado Avenue. C. The deadline to submit applications for the Committee shall be one (1) week after the application notice is published in a newspaper of general circulation in the City. 2 6-8 D. The Mayor shall form an ad-hoc Appointments Committee, which shall be comprised of the Mayor and two (2) Council Members to review the applications, the applicants' answers to any questions, and to conduct any necessary interviews. E. In conducting their review of applications and interviews with the individual applicants, if any, the ad-hoc Appointments Committee shall attempt to determine if there exists a potential conflict of interest, which might interfere with the performance of the applicant's duties in an impartial manner free from bias. F. After the applications have been reviewed and any necessary interviews conducted, the two (2) Council Members on the ad-hoc Appointment Committee shall make a recommendation to the Mayor regarding who should be appointed to the Committee. In making a recommendation to the Mayor, the two (2) Council Members on the ad-hoc Appointment Committee shall endeavor to avoid recommending appointments of applicants with a substantial conflict of interest, which would require repeated disqualification from voting on issues that are likely to come before the Committee. G. The Mayor shall consider the recommendation of the two (2) Council Members on the ad-hoc Appointment Committee and, after consideration of the recommendation, decide, in the Mayor's discretion, whom should be appointed to the Committee. H. The Mayor shall inform the City Clerk of the names of the members to be appointed to the Committee and the City Clerk will submit the names of the appointees to the City Council, at an open and noticed meeting, to be considered for confirmation by the City Council. 3 s -s I. Except as otherwise required by law, the process for selecting, appointing and confirming members to the Committee shall follow the process set forth herein. PURPOSE & RESPONSIBILITIES: A. Ensure there is sufficient public outreach and stakeholder input regarding the update to the Housing, Land Use, and Circulation Elements of the City of Newport Beach General Plan and any other Elements deemed necessary; B. Review responses to the Request for Proposal for services to update the Housing, Land Use, Circulation, and other Elements deemed necessary; C. Make a recommendation to the City Council regarding the selection of consultants to assist in the update of the Housing, Land Use, Circulation, and other Elements deemed necessary; D. Provide guidance to City staff and the consultant through the outreach process; E. Provide guidance to City staff, and the consultant, on goals and policies related to the update of the Housing, Land Use, Circulation Elements, and any other Elements deemed necessary by the Committee or City Council; and F. Make other recommendations to the City Council regarding the update of the General Plan, as necessary. I was appointed by Governor George Deukmejian to serve as Director of the California Department of Housing and Community Development in the mid 1980' s. HCD administers the Housing Element Update and the Regional Housing Needs Assessment process. Homelessness was just beginning to emerge as an issue at the state level, and HCD had responsibility to report to the Legislature on causes and solutions to the problem. I have also had experience consulting with regional agencies (SCAG) on the RHNA process, and with cities on housing element issues. have been a member of The California Planning Roundtable since 1990, serving as President in 1993-94. The California Planning Roundtable (CPR) is an organization of experienced planning professionals that was formed in 1981. Its mission is advancing the practice of planning through innovation and leadership. Each year, the Roundtable chooses one or more timely add significant California planning issues for study and publishes the results of the inquiries in papers or articles that are widely distributed to California planners, the California legislature, and local public officials. The Roundtable is an excellent resource on cutting edge planning issues, and a sounding board on what planners are thinking and experiencing in the field on general plan and housing issues. Prepared the EIR for a 238 -unit single family residential development on a 720 acre site in Violin Canyon, Castaic, California. The lead agency for this project was the County of Los Angeles. Served as an expert witness on a CEQA lawsuit that involved an approximately 180 acres of residential development, including 200 low-density single-family dwelling units, 110 medium density residential units, six estate lots and two parks. Prepared an EIR for the ConocoPhillips PM10 and NOx Reduction Project. Provided consulting services to Alt Air for the preparation of a Negative Declaration and air quality permitting for modifications to existing refinery structures to produce renewable jet fuel and renewable diesel fuel from non -edible vegetable oil and high- quality technical beef tallow. EAI prepared a health risk assessment in compliance with SCAQMD Rule 1401 analysis for a new flare related to the Hydrogen Plant. The lead agency for this work was the SCAQMD. Provided technical support to Chevron Products Company in the technical review and comment on the Chevron Marine Terminal Lease Renewal EIR prepared by the California State Lands Commission. Environmental topics addressed include oil spill response capability; system safety and reliability; water and sediment quality; biological resources; air quality including criteria pollutants, TAC, and GHGs; aesthetics; geological resources; land use, planning, and recreation; noise energy; cultural resources; and, socioeconomics and environmental justice. Prepared the Negative Declaration for the Polychemie Facility in Los Angeles, California. The proposed project included modifications to add new storage tanks and vessels at the facility. An HRA under the SCAQMD Rule 1401 requirements for the modifications to stationary sources at the Polychemie facility. The lead agency for this work effort was the SCAQMD. Prepared a Negative Declaration for the Ultramar Inc. Cogeneration Unit at the Wilmington Refinery. The project included the installation of a Cogeneration Unit to minimize the potential for power outages at the Refinery. Also prepared a health risk assessment to address the health impacts of toxic air contaminants. Assisted the SCAQMD and the Joint Powers Authority in the preparation of an EIR for the Intermodal Container Terminal Facility (ICTF) EIR. The project would expand and modernize the existing ICTF facility to allow the increased handling of container traffic from the Ports of Los Angeles and Long Beach onto rail for transport out of the Los Angeles region. Responsibilities include: preparing the Initial Study; preparing a construction emission inventory and analyzing construction air quality impacts; preparing environmental setting, project impacts, and mitigation measures for aesthetics, hazards, hydrology/water quality, land use, noise, and utilities and service system impacts. Prepared a Mitigated Negative Declaration for the Hixson Metal Finishing Risk Reduction Project, in Newport Beach, California. The proposed project consisted of on- site tank, spray booth, and oven relocation; installation of additional air pollution control systems; construction of permanent total enclosures; installation of covers on wastewater treatment tanks, preparation and implementation of an improved housekeeping and dust minimization plan, and improvements to the Facility's electrical system. The overall focus of the project was to reduce the Facility's emissions associated with anodizing, testing, plating, and coating operations for aerospace and defense industries. The lead agency for this work effort was the SCAQMD. Prepared a Subsequent Negative Declaration for the proposed re -start of mining operations for the Molycorp Mountain Pass mining facility. The proposed project included modifications to mining operations to improve the efficiency of the operation and extraction of rare earth elements, as well as a 49.9 MW Cogeneration facility to increase operational efficiency. Prepared an inventory of criteria, TAC, and greenhouse gas emission changes associated with the proposed project for stationary and mobile sources, modeled the project emissions, and completed a health risk assessment to determine the potential for significant impacts. GHG emission impacts and mitigation measures were developed. Major issues included aesthetics, air quality, greenhouse gas emissions, biological resources, hazards, noise, and transportation/traffic. Prepared a Negative Declaration for proposed modifications to SCAQMD permits for the PetroDiamond Marine Terminal in the Port of Long Beach. The lead agency for this Negative Declaration was the SCAQMD. The environmental analysis included a detail review of the emissions inventory for the proposed Terminal modifications including stationary and mobile sources. EAI prepared responses to comments received on the Draft Negative Declaration. HEALTH RISK ASSESSMENTS Prepared the AB2588 Toxic Hot Spot HRAs for a number of refineries in the SCAQMD. These initial HRAs followed the California Air Pollution Control Officers Association (CAPCOA) guidelines and the more recent updates to the HRAs follow the California Office of Environmental Health Hazard Assessment (OEHHA) Air Toxics Hot Spots Program Guidance Manual for the Preparation of Health Risk Assessments (March 2015). The guidance Manual was developed by OEHHA in conjunction with the Air Resources Board (ARB) for implementing the Air Toxics Hot Spots Program. The same methodology is also used to determine the level of impacts for some projects under the California Environmental Quality Act (CEQA). Prepared the HRA for a film reproduction company with laboratories in various locations to determine if emissions of toxic air contaminants would require Proposition 65 notification. Conducted source testing for an automobile manufacturer to determine if paint products would require Proposition 65 notification. Prepared the HRA to determine appropriate soil clean up levels for residual lead concentrations at a former paint manufacturing plant located in Los Angeles, California. The risk assessment estimated exposure via multipathways to lead and determined the blood lead concentration following site clean up. The HRA was approved by the lead agency and used as the basis for establishing clean up levels for lead. Prepared the AB2588 HRA for the Petro -Diamond Marine Terminal located in the Port of Long Beach, California. This HRA included emissions associated with the storage of petroleum products and combustion emissions from heaters. The HRA included calculation of carcinogenic risk and evaluation of non - carcinogenic impacts via multipathways. Because the Council is seeking to populate the Housing Element Update Advisory Committee (the "Committee") with nine (9) members with defined knowledge/experience, I will provide more detail about my background than I would otherwise so if the Council decides that my application merits selection to the Committee, the Council will have several options as to which area(s) of knowledge/experience 1 could fulfill. Paragraph refererces below correspond to the areas of knowledge and experience enumerated in the Notice of Vacancies for the Committee. 2. Knowledge of CEQA: As a one-time lawyer for real estate developers, then a real estate developer and also a Planning Commissioner, I have become very familiar with CEQA. In one of my development projects it was clear from the beginning that I would be sued under CEQA. There is nothing that leads to an understanding of a law quite like knowing that if you fail to comply it will cost a lot of money and a lot of time in litigation. 4. Knowled e of Land Use and Planning: I served on the Planning Commission for eleven (11) years, three (3) years of which were as Chair. During that time, I gained extensive knowledge of our Housing Element and our planning process, including the workings of traffic reports. I used this knowledge to assist City staff in having well written documents of approval from time to time. For example, I provided significant edits to the Planned Community Text, Design Guidelines and Conditions of Approval for Uptown Newport, the highest density project in the City (50 units to the acres). 6. Knowledge of Real Estate Financing: As a real estate lawyer representing developers, and while working on my own projects, I have been involved in numerous real estate financings. The development business is based upon leverage and my background as a Certified Public Accountant has been very helpful in being able to understand the financial and financing aspects of real estate development. 7. Knowledge of Residential Real Estate Development; Earlier in my career I was also a licensed real estate broker. In representing owners or buyers of residential development land, I became very familiar with the steps a developer goes through in determining what product works for a given site and how those decisions are made. I used this expertise to assist in brokering the sale of three parcels for residential development purposes. Later in my career, I became the Co -Managing Member of Baker Ranch Properties, LLC, which owned land in Lake Forest, CA. I was involved in the planning and entitlement of the land which was ultimately sold for housing development upon completion of the entitlements. Development of the land required approvals from the Army Corp of Engineers, the Federal Fish & Wildlife Service, the State Department of Fish and Wildlife, the Regional Water Quality Control Board, the County Flood Control District, the Department of the Navy and the Airport Land Use Commission (until MCAS EI Toro was finally sold). 8. Legal Background: I practiced law as a full-time occupation from 1975-1989 and then part time from 1990-1998 at which time I converted to inactive status. I represented landholders with entitlement issues and residential, shopping center and industrial developers. Although I was no longer licensed to actively practice law after 1998, 1 occasionally perform some of the same legal related functions for myself that I did for clients when I was practicing law. 0=1 9. Experience Leading Public Meetings• As noted above, during my eleven (11) years on the Planning Commission I was Chair three (3) times. Most meetings were somewhat routine, but several a year involved hearings on controversial projects. I was also the Chair of the City Hall Design Committee. The Design Committee was charged with conducting a design competition and ultimately recommending an architect to the City Council. Since I am not a design professional, the Council did not make me a voting member of that Committee, but rather I was appointed by the Mayor, and confirmed by the City Council, to run a fair and open process so the design professionals could focus on their tasks without having to react to public comments about what was then a disputed location of a to be relocated City Hall. It was particularly important that the neighbors across MacArthur had a chance to voice their opinions and suggestions about the project since they had been promised that the City Hall site would remain open space, but all that had unexpectedly changed due to a ballot measure over their strenuous objections. 6-47
