HomeMy WebLinkAboutF-3b - City/County Newport Harbor Mooring AgreementCITY OF NEWPORT BEACH Marine Department January 23, 1989 TO: MAYOR AND CITY COUNCIL FROM: Marine Director Agenda Item No. F -3-b BY THS +:ITY COUNCIL CITY 01' NEWPORT BEACH JAN 2 3 1989 SUBJECT: CITY/COUNTY NEWPORT HARBOR MOORING AGREEMENT Recommendation: If desired, authorize the Mayor and City Clerk to execute a renewed agreement which provides for the County to administer, regulate and enforce all City and County ordinances dealing with the ON and OFF SHORE mooring regulations. Discussion: Since 1976 the City and the County of Orange have maintained a Joint Powers Agreement for the purpose of mooring administration in Newport Bay. The agreement establishes and defines responsibility of the City and County in conjunction with the ON and OFF SHORE mooring system over both City and County controlled tidelands. The County of Orange has submitted a Mooring Administration Agreement for the period beginning January 1, 1989 through December 31, 1993. The agreement proposes that the City of Newport Beach reimburse the County of Orange for their costs in the amount of $52,945 for the calendar year 1989. In each of the four years after 1989 the County anticipates a 6% cost increase factor to offset their increases in County salaries, etc. The City staff is recommending that the City Council authorize a five year agreement as proposed by the County. The County staff has indicated that they prefer a multi-year agreement rather than agreements on a year to year basis. The reason for this is that it reduces their staff costs by eliminating the necessity for Board of Supervisor approval for each agreement. There are 1226 ON and OFF SHORE moorings in Newport Bay. All but 23 of these moorings are over City tidelands. The agreement provides that either party may terminate this agreement by notifying the other of termination in writing not less than 90 days prior to the date of anticipated termination. A new 5 -year Agreement with City for continued mooring administration has been negotiated. ADDITIONAL DATA: On January 23, 1989, Newport Beach City Council executed subject Agreement. Agreement establishes respective responsibilities of City and County in administering vessel anchorages and moorings located upon City and County controlled tidelands. Agreement generally provides: 1) City will reimburse County (Sheriff's Harbor Partol) enforcement of City ordinances dealing with anchorage and mooring regulations, and 2) City will collect and remit to County, fees for vessel anchorages and moorings located upon County controlled tidelands in accordance with fee schedule adopted by your Board of Supervisors. The currently approved regional recreational facilities fee schedule'directs such fee be increased in 1989 by the most recent annual Cost -of -Living Adjustment (COLA) factor granted to general County employee unit, subject to confirmation of calculated fee by your Board. The FY 1988-89 COLA to the general employee unit was effected in two installments, July 1 and December 16. The combined rate was 6.3 percent. Based on such rate, the mooring fee would be increased to $26.58/lineal foot during 1989. COMPLIANCE WITH CEQA: Recommended action is not a project as defined by CEQA.
