ORDINANCE NO. 293. <br />AN ORDINANCE OF THE BOARD <br />OF TRUSTEES OF THE CITY <br />OF NEWPORT BEACH DE- <br />CLARLNO VACANT FOR PUB- <br />LIC STREET PURPOSES CER. <br />TAIN PORTIONS OF OLIVE <br />STREET, SONORA STREET <br />AND CERTAIN ALLEYS WITH- <br />IN SAID CITY. <br />WHEREAS, the Board of True_ <br />tees of the City of : Wport Beach, <br />Ion the 18th day of January, 1926, <br />at a regular meeting of said Board <br />held on that date, duly passed and <br />adopted a Resolution, being Reso- <br />lution No. 364, entitled, "A Reso- <br />lution of the Board of Trustees of <br />the City of Newport Beach declar- <br />ing their intention to vacate, close - <br />up and abandon for public Street <br />,purposes, Certain portions of Olive <br />Street, Sonora Street and certain <br />alleys within said City "; and <br />WHEREAS, the Street Superin- <br />tendent of the City of Newport <br />Beach after the passage of said <br />Resolution caused to be conspic- <br />uously posted along the line of <br />said contemplated improvernput, at <br />,not more than three (3) hundred <br />i feet in distance apart upon said <br />,streets, and not less than three (3) <br />:in all upon said streets, notices of <br />the passage of said Resolution, <br />said notice being headed, "Notice <br />of Public Work," in letters not less <br />than one (1) inch in length and <br />stating the fact of the passage of <br />said Resolution, its date and brief - <br />Ily C:e work of improvement pro - <br />',posed, being that of vacating the <br />(above named streets as herein- <br />after describe(!, and the said no- <br />tice herein mentioned referred to <br />said Resolution for further partic -, <br />ulars; said Street Superintendent; <br />having also caused a notice sho <br />lar to that hereinbefore referred <br />to to be published by four succes- <br />sive insertions in the Newport <br />News, a semi - weekly newspaper <br />printed, published and circulated <br />in said City of Newport Beach <br />(there being no daily newspaper <br />so printed, published and circulat- <br />ed in said City) and more than ten <br />(10) days after the expiration of <br />the time of Publication oI said no- <br />tice having elapsed and no oblec- <br />tions to the said improvement <br />have been delivered to the City <br />Clerk of the City of Newport <br />Beach, and the said Board of Trus- <br />tees having acquired jurisdiction <br />to order the vacation of said streets <br />as hereinafter described; <br />THEREFORE, The Board of <br />( Trustees of the City of Newport <br />Beach do ordain as fellows: <br />SECTION I. <br />That those portions of the Public <br />streets hereinafter described, with - <br />lin said City, be closed -up, vacated <br />'and abandoned for public street <br />,purposes. The said Portions of <br />said streets so closed -up, vacated <br />and abandoned for public street <br />purposes are described as follows: <br />(1) All that portion of Olive <br />Street within said City. from the <br />northeasterly line of the State <br />Highway to the northeasterly line <br />IOt the El Moro Tract, as per Map <br />thereof recorded in Miscellaneous <br />Maps Book 8, page 76, Records of <br />Orange County, California. <br />(2) All that portion of the alley, <br />within said City, extending north- <br />easterly and southwesterly through <br />E1ock 13. of the Seashore COlon, <br />Tract, as per map thereof record- <br />ed in Miscellaneous Maps Book.7, <br />page 26, Records of Orange County, <br />California, and Block E or the El <br />Moro Tract, as per map thereof <br />recorded in Miscellaneous Maps <br />Book 8, Page 76, Records of Orange <br />County, California, from the north- <br />easterly line of the State Highway <br />to the northeasterly boundary line . <br />of the aforesaid El Moro Tract. <br />(3) All that portion of Sonora <br />Street, within said City,. from the <br />northeasterly line of the State <br />Highway to the northeasterlyboun- <br />darY line of the El Moro Tract, as, <br />per Map thereof recorded in MIS-' <br />cellaneous Maps Book 8, page 76,' <br />Records of Orange County, Cali- <br />fornia. <br />(4) All that portion of the, al- <br />ley extending northeasterly and <br />southwesterly through Block 12, of <br />the Seashore Colony Tract„ as per <br />Map thereof recorded in Miscell- <br />aneous Maps Book 7, page 26, Rec- <br />ords of Orange County,. California, <br />and Block F of the EI Moro Tract, <br />as per Map thereof recorded in <br />Miscellaneous Maps Book 8, page <br />76, Records of Orange County, <br />California, from the northeasterly <br />line of the State Highway to the <br />northeasterly boundary line of the <br />aforesaid El Moro Tract. <br />SECTION II. <br />That the Public work herein pro- <br />vided for is the closing -up of the <br />.streets herein described in Sec - <br />tion I. and it appearing to the <br />Board of Trustees that there are <br />no costs, damages or expense oc <br />Icasioned by or arising out of said <br />I work, and that no assessment is <br />;necessary to pay the costs, datn- <br />ages or expenses of said work, and <br />that therefore no commissioners <br />shall be appointed to assess bene- <br />fits and damages. <br />SECTION III. <br />The City Clerk shall certify to <br />the passage of this Ordinance and <br />,shall cause the same to be pub- <br />lished by one insertion in the <br />Newport News, a weekly news- <br />' paper printed, published and cir- <br />culated in said City, and which is <br />hereby designated for that purpose. <br />Passed and approved this 23rd <br />day of August, 1926. <br />CONRAD RICHTER, <br />President of the Board of Trustees. <br />Attest: ALFRED SMITH, <br />City Clerk. <br />STATE OF CALIFORNIA ) <br />COUNTY OF ORANGE ) as. <br />CITY OF NEWPORT BEACH ) I <br />I, Alfred Smith, City Clerk of the <br />City of Newport Beach, do hereby . <br />certify that the foregcing Ordin <br />once being Ordinance No. 293, was <br />passed by the Board of Trustees, <br />I of the City of Newport Beach, sign - <br />III ed by the President of said Board, . <br />and attested by the City Clerk, all <br />at a regular meeting thereof held <br />on the 23rd day of August, IWII, . <br />and that the sa.arse was passed by <br />the following vote, to -wit: <br />AYES — Trustees, Modjeska, <br />Young, Williamson, Richter. <br />NOES — Trustees, None. <br />ASSENT— Trustees, Wilkinson. <br />ALFRED SMITH, <br />City Clerk of the City <br />of Newport Beach. <br />53� <br />
