HomeMy WebLinkAbout399 - Deafeated at Election• 0 9 • 0 • ORDINANCE NO. 399 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING ORDINANCE N0. 334 OF THE CITY OF NEWPORT BEACH AND PROVIDING FOR THE LEVY AND COLLECTION FOR EACH FISCAL YEAR OF A TAX OF FIVE CENTS (50) ON EACH ONE HUNDRED DOLLARS (,$100.00) OF ASSESSED VALUATION FOR ADVERTISING PURPOSES IN LIEU OF THE TAX OF TEN tiY CENTS (10¢) ON EACH ONE HUNDRED DOLLARS ($100.00) ti FOR ADVERTISING PURPOSES AS PROVIDED FOR BY SAID ORDINANCE NO. 334; PROVIDING THE MANNER OF USING SUCH TAX AND THE TIME OF COLLECTION THEREOF AND ORDERING THE SUBMISSION OF THIS ORDINANCE TO ELECTORS OF THE CITY OF NEWPORT BEACH AT THE NEXT REGULAR. SUCCEEDING MUNICIPAL ELECTION. The City Council of the-City of Newport Beach do ordain as follows: Ordinance No. 334 of the City of Newport Beach is hereby amended to read as follows. SECTION 1. for and levied in each ($100.00) of assessed Newport Beach which is A tax of five cents (5¢) is hereby provided fiscal year upon each one hundred dollars valuation of all property in the City of taxable therein for municipal purposes. SECTION 2. The tax provided for in Section 1 of this Ordinance shall be in addition to all other taxes now authorized by law to be levied. The Tax Collector shall compute the amount of said tax to be paid by each tax -payer based upon the equalized assessed value of property assessed to such tax -payer and said tax shall be added to the tax roll of the City of Newport Beach and shown upon all tax statements and tax receipts issued by the Tax Collector. The time of collecting said tax and the mode and manner of levying and collecting the tax herein provided for shall be the same as is provided for, applied to and governing in the assessment and collection of other municipal taxes in and for the City of Newport Beach. SECTION 3. The said tax when collected shall be paid into the treasury of the City of Newport Beach in the same manner and at the same time as all other taxes of the City of Newport Beach, to the credit of the advertising fund and the money realized from said tax shall be expended for legitimate advertising purposes of the City of Newport Beach in such manner as the City Council may deem best, providing that all such advertising shall be first submitted to and approved by the City Council and all money expended therefore shall be by the usual claim presented against the City, duly audited, and a warrant issued upon the Treasury of the City of Newport Beach, charged against said advertising fund. SECTION 4. This Ordinance shall not become effective until the same shall have been submitted to the electors of the City of Newport Beach at the next regular municipal election to be held at and within the City of Newport Beach on the 11th day of April, 1932, and at said election there shall be and is hereby submitted to the electors of the City of Newport Beach this Ordinance and the electors of the City of Newport Beach shall be and are hereby invited to vote for or against this Ordinance, and the adoption thereof and the form in which said Ordinance shall be submitted to said electors as hereinbefore provided for shall be as follows: Shall Ordinance No. 399 providing for the levy. and collection for each fiscal year of a tax of $.05 on each $100.00 for advertisin purposes YES in lieu of the tax of $.10 on each 1100.00 for advertising purposes as provided for in Ordinance No. 334 of the City of Newport Beach, be adopted? Shall Ordinance No. 399 providing for the levy and collection for each fiscal year of a tax of NO $:05 on each $100.00 for advertising purposes in 0 lieu of the tax of $.10 on each $100.00 for advertising purposes as provided for in Ordinance iJo. 334 of the City of Newport Beach be adopted? SECTION 5. If at said election the majority of the votes cast on said proposition are in favor of this Ordinance and if upon canvassing the votes so cast thereat a majority of them are found to be in favor of the Ordinance, it shall become effective and said tax shall be levied and collected and used in the manner provided for herein. . SECTION 6. The Clerk of the City of Newport Beach shall give notice of the submission of this Ordinance, in the manner required by law, and shall also give notice by publishing a copy of said proposition to be submitted, at the same time as he shall publish the names of the nominees for public office, prior to said election. SECTION 7. The above and foregoing Ordinance shall be published once in Newport News, a newspaper of general circulation, printed, published and circulated in the City of Newport Beach and upon said publication and being voted in favor of by a majority of the votes cast at the election as shown by the canvass of said votes, it shall take effect and be in force. The above and foregoing Ordinance was passed at a regular meeting of the City Council of the City of Newport Beach on the • 29th day of February, 1932, by the affirmative vote of the following named members thereof: AYES: Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson.
