Section 3 of Or- <br />dinance No. 277 of the City of <br />Newport Beach is hereby amend- <br />ed to read as follows: <br />"The Superintendent of the mu- <br />nicipal water system shall have <br />full authority to employ and dis- <br />charge all persons necessary to be <br />employed by him in' the mainten= <br />ante and operation of the mu- <br />nicipal,aater system, but shall be <br />authorized to pay only such wages <br />or per diem as the City Council <br />may havg previously fixed and es- <br />tablished. <br />He shall also have authority to <br />purchase.all needed fuel, supplies <br />and equipment for the mainten- <br />ance and operation of the munici- <br />pal water system when the expen- <br />diture doss not exceed the sum of <br />$200.00, in all other cases the <br />same shall be. purchased only upon <br />authorization of the City Council, <br />and as prdvided for by law. <br />SECTION 2. Subdivision "B" <br />Of Section 6 of Ordinance No. 277 <br />of the City, 6f Newport Beach is <br />hereby amended to -read as fol- <br />lows i' <br />"The minimum rates to be <br />charged 'and collected monthly <br />frdin consumers of water supplied <br />by the City of Newport Beach, <br />State of California, for water <br />supplied by said City, or to any <br />person, firm, company, association <br />or corporation, are hereby fixed, <br />determined and established as <br />follows: <br />METER RATES <br />First: The monthly rate for <br />water consumed through meters <br />shall be as follows: <br />For % inch meters, first 800 <br />'feet or less, $1.00. <br />For - 3/4 inch meters, first 800 <br />feet or less, $1.00. <br />For 1 inch meters, first 1100 <br />feet or less, $1.30. <br />Fd'r 11/2 inch meters, first 1500 <br />feet or less, $1.70. <br />Fpr 2 inch meters, first 1800 <br />feet or less, $2.00. <br />For 3 inch meters, first 2800 <br />feet Or less, $3.00. <br />For each additional 100 cubic <br />feet and up to 10,000 cubic feet, <br />per 100 cubic feet, $.10. <br />For all over 10,000 cubic feet <br />and up to 40,000 cubic feet, per <br />100 cubic feet, $.09. <br />For all above 40.000 cubic feet, <br />per 100 cubic feet, $.08. <br />Water used for commercial pur- <br />poses shall be subject to special <br />rates to be fixed by the City Coun- <br />cil under separate agreement with <br />the consumers. <br />SECTION 3. There is hereby <br />added to Ordinance No. 277 of the <br />City of Newport Beach a new sec- <br />tion to be known and designated <br />as Section 6%, and shall read as <br />follows: <br />"No service connection less than <br />three - fourths ( %) inch in size <br />shall be installed. <br />The fees for the installation of <br />water services, or for enlarging <br />those already in, shall be as fol- <br />lows: <br />For a three - fourths O inch <br />service, $15.00. <br />For a one inch (1 -1n.) uervice, <br />$25.00. <br />For a one and one -half inch <br />(11/d -in.) service, $35.00. <br />For a two inch (2 -1n.) service, <br />$65.00. <br />For sizes larger than two (2) <br />inch, or where it becomes neces- <br />sary to open paved street, the <br />actual cost of labor and material <br />in laying such a service and re- <br />placing the pavement shall be <br />charged plus ten per cent (10%) <br />for overhead. In such cases the <br />cost of materials and labor shall <br />be estimated by the Superintend- <br />ent and the estimated cost shall <br />be paid to the City Water Depart- <br />ment by the person applying for <br />such installation before the work <br />of connecting the main with the <br />'Property is begun; provided, that <br />whenever the e,5timated cost is <br />not sufficient to cover the total <br />expense for labor and material, <br />the deficit shall be charged to the' <br />property for which such installa- <br />tion was made and to the owner <br />thereof: provided, further, that <br />any excess payment shall be re- <br />turned to the person applying for <br />the installation." <br />SECTION 4. This ordinance is <br />an emergency measure and is re- <br />quired for the immediate preser- <br />vation of the public peace and <br />morals, the facts constituting its <br />urgency being as follows: <br />There are a great number of <br />people in the City of "Newport <br />Beach who are effected by the <br />terms of this ordinance, in this, <br />to -wit, that water rates through- <br />out the city will be lowered when <br />this ordinance goes into full force' <br />and effect; that there is an emer -' <br />gency existing at this time for a <br />reduction in water rates as con- <br />sumers generally throughout said <br />city are having difficulty in pay- <br />ing their water bills and there is <br />a surplus of water at this time <br />in the City of Newport Beach. <br />SECTION 5. The City Clerk <br />shall certify to the separate vote <br />on the urgency of this ordinance, <br />and to its passage by the vote of <br />five (6) members, of the City <br />Council of the City of Newport <br />Beach, and cause the same to be <br />published once in NEWPORT'' <br />NEWS, a newspaper of general' <br />circulation in the City of Newport <br />Beach, and it shall thereupon <br />take effect. <br />I hereby certify that the ques- <br />tion of the urgency of the fore- <br />going ordinance was passed and <br />t h e foregoing ordinance w a s <br />adopted by a vote of five (5) <br />members of the City Council of <br />the City of Newport Beach, at its <br />meeting of December 12th, 1932. <br />AYES, Councilmen: Gordon, <br />Claire, Ellsworth, Garfield, Hil- <br />mer. <br />NOES, Councilmen: None. <br />ABSENT, Councilmen: None. <br />HERMANN HILMER, <br />Mayor of the City of <br />Newport Beach. <br />Attest: <br />FRANK L.
